California Financial Responsibility: Car Insurance Requirements

To drive legally in California, you must carry financial responsibility at all times, and the California car insurance requirements set a floor of $30,000 for injury or death of one person, $60,000 per accident for all injuries, and $15,000 for property damage. Those limits took effect for any policy issued or renewed on or after January 1, 2025, replacing the old 15/30/5 minimums. The rule comes from Vehicle Code Section 16020, and it applies before you ever turn the key.

Minimum Liability Limits

Your policy must include at least:

  • $30,000 for bodily injury or death of one person in a single accident
  • $60,000 for bodily injury or death of all people in a single accident
  • $15,000 for damage to another person’s property in a single accident

Vehicle Code Section 16056 sets these amounts, and Section 16451 requires your policy to cover accidents anywhere in the continental United States, not just inside California.1California Legislative Information. California Vehicle Code VEH 16451

Another increase is already on the books. For policies issued or renewed on or after January 1, 2035, the minimums rise to $50,000 per person for bodily injury, $100,000 per accident for bodily injury, and $25,000 for property damage.2California Legislative Information. California Vehicle Code VEH 16056

These are floors, not ceilings. If damages from an accident you cause exceed your limits, you are personally responsible for the balance.

Uninsured Motorist Coverage

California insurers must include uninsured motorist coverage in every liability policy they sell. It protects you when you are hit by a driver who has no insurance, whose limits cannot cover your injuries, or who flees the scene and cannot be identified.

Under Insurance Code Section 11580.2, your insurer must offer this coverage with limits matching the bodily injury limits on your policy, though the required offering is capped at $30,000 per person and $60,000 per accident. You can waive the coverage entirely or reduce it below your policy limits in a signed written agreement, but you cannot reduce it below the financial responsibility minimums in Vehicle Code Section 16056.3California Legislative Information. Alternatives to a Standard Policy

Buying a policy is the usual path, but Vehicle Code Section 16021 allows other ways to prove financial responsibility.4California Legislative Information. California Vehicle Code VEH 16021

You can make a cash deposit with the DMV in the amount set by Vehicle Code Section 16056, which currently matches the 30/60/15 minimums. The DMV holds the funds as a guarantee that you can pay a judgment arising from an accident.5California Legislative Information. California Code Vehicle Code 16054.2

A surety bond from a company licensed in California works similarly. The bond is a contract guaranteeing the surety will pay damages up to the required limits if you are found liable.

If you have 25 or more vehicles registered in your name, you can apply for a DMV-issued certificate of self-insurance. The DMV must be satisfied that you have the financial ability to pay judgments at least equal to the minimum liability amounts.6Justia. Proof You Must Carry

Vehicle Code Section 16020 requires you to carry evidence of financial responsibility in the vehicle at all times. For most drivers, that is the insurance ID card from your insurer, showing the company name, policy number, and the dates the policy is active.7California Legislative Information. California Vehicle Code VEH 16020

California accepts electronic proof. A card displayed on a smartphone or tablet is treated the same as a paper card so long as it contains the same information.8Legal Information Institute. 13 CCR 82.00 – Insurance Card If you use an alternative like a cash deposit or self-insurance certificate, carry the official DMV authorization letter or certificate instead.

When You Have to Show It

Several situations trigger a demand for proof:

  • Traffic stops. Any officer can ask during a stop or investigation, and failure to produce proof can be cited under Vehicle Code Section 16028.
  • Accident scenes. All drivers involved in a collision must exchange insurance information regardless of fault.
  • Accident reports. If anyone is injured, no matter how slightly, or if property damage exceeds $1,000, you must file a Report of Traffic Accident (Form SR-1) with the DMV within 10 days.9California Department of Motor Vehicles. Report of Traffic Accident Occurring in California (SR-1)
  • Vehicle registration. The DMV verifies your insurance when you register or renew. If its automated system detects a canceled policy with no replacement, your registration can be suspended.

Penalties for Driving Without Insurance

A first offense under Vehicle Code Section 16029 carries a fine of $100 to $200, plus penalty assessments that can multiply the base fine several times over. A second or subsequent offense within three years raises the base fine to $200 to $500, again plus assessments. The court cannot drop below the statutory minimum unless it finds you genuinely cannot pay, and it may order your vehicle impounded.10California Legislative Information. Your registration is separately at risk. If your insurer cancels your policy and you do not submit a replacement within 45 days, the DMV will suspend your registration. To lift the suspension, you must provide proof of new insurance and pay a $14 reinstatement fee.11California Department of Motor Vehicles. Suspended Registration Reinstatement

Any gap in coverage, even a day or two, signals higher risk to insurers. Expect higher quoted rates afterward, high-risk classification, or outright refusal from standard carriers.

SR-22 for High-Risk Drivers

An SR-22 is not insurance. It is a certificate your insurer files with the DMV confirming you carry at least the minimum liability coverage. The DMV requires one after certain serious violations, including:

  • A DUI or wet-reckless conviction
  • Being in an accident while uninsured
  • Accumulating enough points to be declared a negligent operator

You must maintain continuous SR-22 coverage for three years from the date of the triggering event, and the underlying liability must meet at least the current 30/60/15 minimums. Before the DMV reinstates your driving privilege, you also pay a $125 reissue fee. If your SR-22 policy lapses at any point during the three-year window, your insurer must notify the DMV, and your license will be suspended again.

Non-Owner Policies

If you drive regularly but do not own a vehicle, whether you borrow, rent, or need to keep an SR-22 active, a non-owner policy can satisfy California’s financial responsibility requirement. It provides liability coverage for bodily injury and property damage you cause while driving someone else’s car.

Non-owner insurance is secondary. It pays only after the vehicle owner’s primary policy is exhausted. It does not cover damage to the vehicle you are driving, and it generally excludes business use and other members of your household. Depending on the insurer, you may be able to add uninsured motorist or medical payments coverage.

Rideshare and Delivery Driving

Driving for a platform like Uber, Lyft, or DoorDash creates a gap most personal auto policies will not fill. Standard personal policies typically exclude coverage while the vehicle is used as a commercial livery, and that exclusion applies from the moment you log into the app, even before you accept a ride or delivery.

The California Public Utilities Commission regulates rideshare insurance in three periods:

  • Period 1, app on and waiting for a match. The rideshare company must provide primary liability of at least $50,000 per person, $100,000 per accident for bodily injury, and $30,000 for property damage, plus $200,000 in excess coverage per occurrence.
  • Period 2, match accepted and en route to the passenger. The company must carry $1,000,000 in primary commercial liability.
  • Period 3, passenger in the vehicle. The same $1,000,000 in primary commercial liability applies, plus $1,000,000 in uninsured and underinsured motorist coverage.
12California Public Utilities Commission. Insurance Requirements for TNCs

Period 1 is the exposed stretch: your personal insurer has excluded you, and the rideshare company’s coverage during that window is lower than in Periods 2 and 3. A rideshare endorsement on your personal policy is designed to bridge the gap. Delivery platforms raise the same personal-policy exclusion, and not every one of them provides equivalent gap coverage, so check your platform’s insurance terms before your first shift.

California Low Cost Automobile Insurance Program

Drivers who cannot afford standard premiums may qualify for the California Low Cost Automobile Insurance Program (CLCA), established under Insurance Code Section 11629.7.13California Legislative Information. California Code Insurance Code 11629.7 It offers reduced-rate liability coverage to eligible residents so that income is not a reason to drive uninsured.

To qualify, you must meet all of the following:

  • Hold a valid California driver’s license
  • Be at least 16 years old
  • Own a vehicle valued at $25,000 or less
  • Meet income eligibility guidelines based on household size
  • Have a good driving record, meaning no more than one at-fault property-damage-only accident or one point for a moving violation in the past three years, no at-fault accidents involving bodily injury or death in the past three years, and no vehicle-related felony or misdemeanor convictions
14CA.gov. California Low Cost Auto

CLCA policies carry lower limits than the standard minimums: $10,000 for bodily injury per person, $20,000 per accident, and $3,000 for property damage. The program is specifically authorized by statute to operate below the standard floor, and the coverage satisfies California’s financial responsibility requirement for drivers who qualify.
