California Fire Lawsuits: Edison, LADWP, and State Farm

The January 2025 Los Angeles wildfires produced one of the largest waves of California fire lawsuits in state history, with hundreds of civil suits, a federal civil action, insurance antitrust claims, and a federal arson prosecution now moving through the courts. Two blazes drive the litigation: the Eaton Fire in Altadena and the Palisades Fire on the west side of Los Angeles. Together they killed at least 29 people, destroyed more than 16,000 structures, and caused estimated property and capital losses of $76 billion to $131 billion.1UCLA Anderson School of Management. Eaton Fire Lawsuits Against Southern California Edison

Nearly every civil case tied to the Eaton Fire targets Southern California Edison. Plaintiffs contend the fire ignited directly beneath SCE transmission lines in Eaton Canyon on January 7, 2025, and that faulty equipment on the company’s idled Mesa-Sylmar line was the source. SCE told the California Public Utilities Commission in February 2025 that a tower on that line showed “potential arcing and damage on the grounding equipment” and that a fault occurred around the time the fire started.3Los Angeles County. Sue Edison Eaton Fire Pedro Pizarro, CEO of SCE’s parent company, said publicly that “we believe that SCE equipment could have been associated with the ignition.”4CalMatters. The Federal Government’s Own Suit

On September 4, 2025, the U.S. Department of Justice sued SCE in federal court (Case No. 2:25-cv-08357), alleging the utility negligently maintained its infrastructure and that its lines ignited the Eaton Fire, which burned nearly 8,000 acres of the Angeles National Forest.8Courthouse News Service. Edison Eaton Fire Lawsuit The complaint raises eight claims including negligence, trespass by fire, strict liability under SCE’s Forest Service use permit, and violations of California fire-safety statutes. The government seeks more than $40 million in suppression and rehabilitation costs plus compensation for property damage, habitat loss, and reforestation, with potential double or triple damages for injury to timber under California Civil Code ยง 3346. Acting U.S. Attorney Bill Essayli said the suit aims to recover taxpayer dollars and drive “a culture change at Southern California Edison.”9Utility Dive. SCE’s Cross-Complaints Against the County and Water Agencies

On January 16, 2026, the court-imposed deadline, SCE filed cross-complaints naming Los Angeles County, Pasadena Water and Power, five additional water agencies, and Southern California Gas Company as parties who allegedly made the fire deadlier than it needed to be.10ABC7. SoCal Edison Files Lawsuit Over Deadly Eaton Fire Alleging Los Angeles County, Other Utilities Are to Blame Against the county, SCE alleges that the first evacuation alert for east Altadena went out 30 minutes after the fire started and that west Altadena, where 18 of the 19 fire deaths occurred, did not receive an evacuation order until 3:25 a.m. the next morning.11Pasadena Weekly. Trial Date and SCE’s Voluntary Compensation Program

Judge Seigle set the first bellwether trial for January 25, 2027, involving 50 plaintiffs selected in spring 2026, with pre-trial filings due January 4, 2027. The court has prioritized elderly and medically fragile plaintiffs.13Lieff Cabraser Heimann & Bernstein. Separately, SCE launched a voluntary Wildfire Recovery Compensation Program. As of early January 2026, the company had received roughly 1,800 applications and made offers to 82 claimants totaling $34.4 million, all accepted.14CalMatters. Southern California Edison Eaton Fire Compensation The program has drawn criticism from survivors and plaintiff attorneys. Participants must waive all rights to sue, including claims for punitive damages and future health-related compensation. Construction reimbursements are capped at $550 to $750 per square foot, which attorneys say falls short of actual rebuild costs. The program also pays children 50% to 65% of the adult rate for residential losses, or $75,000 for a child versus $115,000 for an adult. The Eaton Fire Survivors Network asked SCE to provide up to $200,000 per displaced household for housing. SCE declined.

Palisades Fire Lawsuits: Government Agencies and an Arson Prosecution

The Palisades Fire burned roughly 23,700 acres, destroyed more than 6,800 structures, and killed 12 people.15Smart Cities Dive. $10B Lawsuit Targets LA Over Epic Failures in Palisades Fire Its litigation is more fractured than Eaton’s because the defendants span multiple government agencies, and the ignition itself is now a federal criminal case.

The Federal Arson Case

Federal investigators concluded that the Palisades Fire was a holdover from an earlier blaze, the Lachman Fire. Prosecutors allege that Jonathan Rinderknecht, a 29-year-old Uber driver from Melbourne, Florida, maliciously set the Lachman Fire just after midnight on January 1, 2025, on land near Skull Rock in Temescal Canyon.16U.S. Department of Justice. Florida Man Arrested on Federal Criminal Complaint The LAFD extinguished the visible fire that day, but embers allegedly smoldered underground in dense vegetation for nearly a week, resurfacing when high winds hit on January 7.17Fox News. The evidence is largely circumstantial. Geolocation data placed Rinderknecht 30 feet from the fire’s origin as it grew. Investigators found an AI-generated image of a burning city on his computer and a ChatGPT message sent shortly after the fire started: “Are you at fault if a fire is lit because of your cigarettes?”18Los Angeles Times. Civil Suits Against LADWP, the City, and the State

The civil cases do not focus on who struck the match. They focus on whether government agencies let the fire become catastrophic. The consolidated action, Grigsby v. City of Los Angeles (Case No. 25STCV00832), is before Judge Samantha Jessner.21Palisades Fire Litigation Portal. Court Info More than 3,300 victims are party to an amended complaint naming the Los Angeles Department of Water and Power, the city of Los Angeles, and the state of California.22ABC7. Plaintiffs’ allegations fall into three clusters:

  • Failure to extinguish the Lachman Fire. Plaintiffs allege state parks and local officials allowed embers to smolder for a week. Current LAFD Chief Jaime Moore acknowledged the department’s verification process “needed to be stronger.”24NBC Los Angeles. LA Fires: Palisades and Eaton Wildfires
  • Water infrastructure failures. The 117-million-gallon Santa Ynez Reservoir was empty during the fire because LADWP had drained it nearly a year earlier to repair a torn floating cover. Plaintiffs accuse the utility of negligent maintenance and of altering computer logs to conceal a delay of more than four hours in shutting off power to Pacific Palisades on January 7.22ABC7. • Emergency response breakdowns. The lawsuits allege the city ignored brush clearance ordinances, failed to manage overgrown vegetation on city-owned lots, and ran a response plagued by confusion over which agency was responsible for what.15Smart Cities Dive. $10B Lawsuit Targets LA Over Epic Failures in Palisades Fire

LADWP denies any role in starting the fire and says its power lines in the Palisades area were de-energized by 2:16 p.m. on January 7, before the alleged secondary ignitions. It says the log modifications were routine corrections, not a cover-up, and that no investigating authority has linked LADWP facilities to the ignition.22ABC7. New Allegations in Amended Palisades Fire Lawsuit Government defendants are also asserting governmental immunity defenses. A November 2025 state agency investigation found that even if the Santa Ynez Reservoir had been full, the water system would have been “quickly overwhelmed,” with pressure losses driven by unprecedented hydrant demand and leaking pipes in destroyed buildings rather than by a shortage of stored water.25CalEPA. Insurance Antitrust Suits and State Farm Enforcement

A separate legal front has opened against the insurance industry. In April 2025, two antitrust suits including Ferrier v. State Farm Group were filed in Los Angeles County alleging that State Farm, Farmers, and roughly 25 other companies representing about 75% of California’s home insurance market conspired to cancel policies and stop writing new coverage in high-risk fire areas in 2023.26CBS News. Insurers California Wildfires Collude Limit Coverage, Lawsuits Allege The suits allege this forced homeowners in Pacific Palisades, Malibu, and Altadena onto the California FAIR Plan, the state’s last-resort insurer, which caps coverage at $3 million and charges premiums more than double typical rates.27Larson LLP. CA Wildfire Antitrust Lawsuit By the time the fires hit, more than 555,000 policies were on the FAIR Plan, over double the 2020 count, leaving many homeowners dramatically underinsured. The American Property Casualty Insurance Association called the suits “meritless.”

State Farm is also facing regulatory enforcement. California’s Department of Insurance opened an investigation in June 2025 after complaints about delayed and denied claims. A review of 220 residential claims uncovered 432 violations of state law, including failures to investigate claims within 15 days, unreasonably low settlement offers, and repeated reassignment of adjusters.28California Department of Insurance. Press Release 019-2026 In 2026, the department filed an accusation seeking millions of dollars in penalties and corrective action. Why California Utilities Face Strict Liability

What makes the Eaton Fire litigation so dangerous for Southern California Edison is California’s inverse condemnation doctrine. Under that rule, an electric utility is strictly liable for property damage caused by its equipment, even if the company followed every safety regulation and acted reasonably. The rationale is that utilities, as quasi-public entities, should spread wildfire costs across their ratepayer base rather than leaving individual victims uncompensated.31Cal Advocates, California Public Utilities Commission. Wildfire Safety Inverse Condemnation Policy Paper In practice, once plaintiffs show utility equipment substantially caused a fire, the utility pays. Whether shareholders or ratepayers absorb that cost depends on whether the CPUC finds the utility acted prudently.

Behind SCE sits the California Wildfire Fund, created by the legislature in 2019 to absorb catastrophic utility wildfire costs. The fund was designed with about $21 billion in claim-paying capacity but held roughly $13.5 billion in capitalization as of June 2025.32California Wildfire Fund. 2025 Annual Report The fund’s administrator acknowledged that if SCE is found liable, Eaton Fire claims alone “may be substantial enough to fully exhaust the Fund.” If that happens, SCE is responsible for the remainder. Governor Newsom proposed an additional $18 billion to shore up the fund as of July 2025.33Stanford Law School. The Laws That Hold Utilities Liable for Wildfires Are Changing

Where the Cases Stand

As of mid-2026, the Eaton Fire mass tort has selected bellwether plaintiffs and is headed toward a January 2027 trial, with SCE’s cross-complaints against water agencies and the county adding complexity. The federal civil suit against SCE seeking more than $40 million for National Forest damage is proceeding in parallel. The Palisades Fire civil cases are consolidated before Judge Jessner, with governmental immunity defenses still being litigated. The federal arson trial of Jonathan Rinderknecht is underway. The insurance antitrust cases and the State Farm enforcement action are in their early stages. About $7.6 billion in insurance claims had been paid as of November 2025, with 90% going to residential property.14CalMatters. Southern California Edison Eaton Fire Compensation
