California Form 290 Sex Offender Registration: Filing, Updates, and Penalties

There is no single document called “Form 290” in California. California sex offender registration under Penal Code Section 290 is done in person at a police or sheriff’s department, where the registering officer gives you the Department of Justice forms to sign, takes your fingerprints and a current photograph, and collects the information the statute requires. Section 290 is the Penal Code statute that creates the duty, not a form number. The forms themselves are DOJ documents handed to you at the counter, plus a few specialized forms (campus, internet identifier changes, exclusion requests) available through the Attorney General’s website.

Where and When to Register

You register with the chief of police in the city where you live. If you live in an unincorporated area or a city without its own police department, you register with the county sheriff instead.¹

The deadline is tight. You must complete your initial registration within five working days of being released from custody, placed on probation, or arriving in a new jurisdiction. Many agencies require an appointment, so call ahead. Missing the window is itself a crime.

What to Bring

Penal Code Section 290.015 sets out exactly what the registering agency collects. Walking in with the documents in hand keeps the visit to a single trip.

Proof of residence. A California driver’s license or ID card, a recent rent or utility receipt, banking documents showing your name and address, or any other documentation the registering official considers reliable. If you claim a residence but cannot prove it that day, you can still register, but you have 30 days to bring in the proof. If you have no residence and no reasonable expectation of getting one, you sign a statement to that effect.²
A written statement with your employer’s name and address, plus the workplace address if it differs from the employer’s main office.²
License plate numbers for any vehicle you own, regularly drive, or that is registered in your name.²
Internet identifiers, if a court ordered them at sentencing. This applies to felony convictions on or after January 1, 2017, where the internet was used to identify a victim, traffic a person, or distribute child sexual abuse material. You must disclose the email addresses and social media or messaging usernames you actually use. Later changes are reported using DOJ Form CJIS-8041, downloadable from the Attorney General’s website.³⁴

What Happens at the Counter

The registering officer walks you through the DOJ forms, fills in the biographical fields, and collects your fingerprints and a current photograph. You review the completed forms for accuracy before signing. Two signatures matter here. The first attests that everything on the forms is true, under penalty of perjury. The second is a written acknowledgment that you understand the ongoing registration duty, including the fact that you may have to register in other states if you move.²

Before you leave, the agency gives you documentation confirming you registered. Keep it. That paper is your proof of compliance if a stop, a background check, or a later dispute puts your status in question.

Providing false information on any DOJ registration form is a separate crime punishable by up to one year in county jail, on top of any other consequences that flow from the underlying violation.⁵

Annual Birthday Update

Registration is not a one-time filing. Starting with the first birthday after your initial registration, you must appear in person at your registering agency within five working days of your birthday every year to update the file. At that visit you provide current residence, employer, vehicle, and (if applicable) internet identifier information using the DOJ annual update form.⁶ The consequences for missing the window are the same as those for failing to register in the first place.

Change of Address

When you move, you must appear in person at the agency where you last registered within five working days of the move. You report the fact of the move, your new address if you know it, and any plans to return to California if you are leaving the state.⁷

If you do not yet have the new address on the day you move, you still owe the in-person visit within five working days. Once you settle in, you then have another five working days to notify the old agency in writing, by certified or registered mail, of the new location. The old agency forwards the information to the Department of Justice, which routes it to the new local jurisdiction. You then register with that new agency as well.

Transient and Campus Registration

Registrants without a fixed residence are classified as transient and must reregister at least once every 30 days with the police or sheriff where they are physically present. The annual birthday update still applies on top of the 30-day cycle. Sexually violent predators verify their registration every 90 days.⁸⁹

Anyone who enrolls as a student, works (paid or unpaid), or carries on a vocation at a California university, college, or community college for more than 14 days, or for a combined total of more than 30 days in a calendar year, must register separately with campus police within five working days of starting. If the school has no campus police, that registration goes to the city police or county sheriff covering the campus. You must also notify the agency within five working days of leaving the school.¹⁰⁴

Students taking only online courses who never physically appear on campus can register by mail using DOJ Form CJIS-8040C from the Attorney General’s website.⁴

Penalties for Failing to Register

The consequences depend on the underlying conviction.

For misdemeanor registrants, any willful violation is a misdemeanor punishable by up to one year in county jail.⁵
For felony registrants, any willful violation is a felony punishable by 16 months, two years, or three years in state prison. Even where probation is granted, the person must serve at least 90 days in county jail.⁵
For transient registrants, failing to reregister within the 30-day cycle is a misdemeanor carrying 30 days to six months in county jail.⁵
For sexually violent predators, failing to verify registration every 90 days is punishable by state prison or up to one year in county jail.⁵

Petitioning to End Registration

The duty to register does not end on its own. Under Senate Bill 384, Tier 1 registrants (10-year minimum) and Tier 2 registrants (20-year minimum) can petition a court to terminate the obligation once their minimum period has run. Tier 3 (lifetime) registrants generally cannot petition unless their lifetime placement was based solely on a risk-assessment score rather than the offense itself.¹¹

The petition is filed at no cost using Judicial Council Form CR-415 in the county where you register. After filing, someone 18 or older (not you) delivers copies to the district attorney and the law enforcement agency where you register. If your conviction was in a different county, copies also go to the DA and law enforcement there. Law enforcement then has 60 days to verify eligibility and report to the court. The DA has another 60 days to request a hearing.¹²

If no hearing is requested, the judge must grant the petition as long as you have proof of current registration, law enforcement has confirmed you meet the requirements, no pending charges could change your tier, and you are not in custody or on supervision. A denial locks out further petitions for at least one year. Keep registering until a judge actually signs the order — the minimum period running out does not end the duty on its own.¹²
