California Form DE 2320: Filing an Unemployment Claim with EDD

California Form DE 2320, titled For Your Benefit: California’s Programs for the Unemployed, is an informational pamphlet your employer is legally required to hand you when your job ends or your hours are cut. You do not fill it out. It explains the state benefit programs you may qualify for and points you to the actual applications. Why You Received the Pamphlet

Getting a DE 2320 is not a decision about your eligibility. It’s a notice. Every separating worker in California is supposed to get one, whether they were laid off, had hours reduced, quit, or were fired. The pamphlet’s job is to make sure you know the state programs exist so you can decide whether to apply.

There is nothing to sign, mail back, or submit. Keep it for reference and move on to the program that applies to you.

Which Program Applies to You

The pamphlet covers several EDD programs. Most people who receive a DE 2320 need Unemployment Insurance, but the others matter if your situation is different.2Employment Development Department. For Your Benefit: California’s Programs for the Unemployed

  • Unemployment Insurance (UI): partial wage replacement if you lost work through no fault of your own and are able and available to work.
  • State Disability Insurance (SDI): partial wage replacement when you cannot work because of a non-work-related illness, injury, pregnancy, or childbirth.
  • Paid Family Leave (PFL): partial wage replacement for time off to care for a seriously ill family member, bond with a new child, or handle a qualifying military event.
  • California Training Benefits (CTB): lets you attend approved school or training while collecting UI without losing eligibility.
  • Workforce Services: job search help and resume assistance through America’s Job Center of California locations.
  • Work Sharing and Partial Claims: for workers whose employers reduced hours instead of laying them off.

The rest of this article focuses on Unemployment Insurance, which is what most DE 2320 recipients need.

What to Have Ready Before You Apply

California’s claim-filing regulation (22 CCR Section 1326-2) spells out exactly what information your application must contain. Gather it before you start.   • Social Security number and any other names or SSNs you have used.
  • Date of birth and driver’s license or state ID number.
  • Mailing address and a phone number where EDD can reach you.
  • Your last employer’s name and mailing address, the date you last worked, and the reason you are no longer working.
  • Names, approximate wages, and dates for every employer during your base period.
  • Your citizenship status, or your immigration status if you are authorized to work.

You also need to say whether you worked for a government agency, served in the military, or held a job in another state during the 19 months before filing. Have those employment details ready if any apply.

The Base Period

Your base period decides whether you qualify and how much you get each week. The standard base period is the first four of the last five completed calendar quarters before you file. File in April 2026 and EDD looks at wages from January through December 2025. To qualify, you need at least $1,300 in your highest quarter, or at least $900 in your highest quarter with total base-period earnings of at least 1.25 times that quarter’s wages.4Employment Development Department. If you fall short, EDD automatically checks the alternate base period, which uses the last four completed calendar quarters. That picks up more recent wages, which helps if you started your job within the past year.

Non-Citizen Applicants

If you are not a U.S. citizen or national, you can still qualify as long as you had valid work authorization during your base period, at the time you apply, and throughout the weeks you collect. Lawful permanent residents, refugees, asylees, DACA recipients, TPS holders, and other authorized workers are all potentially eligible.

How to File Your Unemployment Claim

There are three ways to apply. Filing is always free — if a site asks you to pay, you are not on the official EDD site.

Online Through myEDD

Go to the myEDD portal and select UI Online. Register for a myEDD account if you don’t have one, then complete the application. You get an immediate confirmation. You must be at least 18 to use UI Online.5Employment Development Department. Apply and Manage Your Claim with UI Online

By Fax or Mail

Download or request the Unemployment Insurance Application (Form DE 1101I). The form has different versions depending on whether you worked only in California, worked in other states, served in the military, or worked for the federal government. By Phone

Call EDD directly and a representative will take your information. Wait times can be long. This is the only option for applicants under 18.

The Waiting Week and Your Weekly Amount

Once EDD accepts your application, you serve a one-week unpaid waiting period before payments begin. You will not receive money for that first week, but you must still meet all eligibility conditions during it.7California Legislative Information. California Code Unemployment Insurance Code 1253

Certifying Every Two Weeks

Filing the initial application is only the first step. You have to certify every two weeks that you’re still unemployed and eligible, or the payments stop. Your first certification window opens about two weeks after EDD processes your application.10Employment Development Department. Step 5: Certify for Benefits

Certification asks whether you were able and available to work each week, whether you looked for work, and whether you earned any wages. Three ways to submit:

  • myEDD is fastest. Log in, select UI Online, and look for “Certify for Benefits” under Notifications.
  • Phone certification runs through the Unemployment Automated Self-Service Line at 1-866-333-4606, option 1, using your four-digit PIN. You cannot report wages or address changes by phone.
  • Mail uses the Continued Claim Form (DE 4581CTO) that EDD sends you. Your first paper form arrives within about 10 days of EDD processing your application.

Staying Eligible: Work Search and Wage Reporting

You must actively look for work while collecting benefits. California requires at least one qualifying activity, which can include:12Employment Development Department. Job Seekers: Returning to Work

  • Preparing to search: creating a CalJOBS account, uploading a resume, using an America’s Job Center of California, or completing job-search skill videos.
  • Networking with contacts, attending industry events, or using professional networking sites.
  • Applying for jobs, responding to ads, or taking civil service exams.
  • Enrolling in approved training, certificate programs, computer classes, or ESL classes.

Keep a record. EDD can ask you to document your search, and a weak record can cost you benefits.

When you certify, report all gross wages you earned during the week you worked, not the week you got paid. Include holiday pay, vacation pay, and severance.13Employment Development Department. Under Unemployment Insurance Code Section 2101, false statements or hidden facts to obtain benefits can bring a 30 percent penalty on the overpaid amount, disqualification from future weeks, and criminal prosecution.14California Legislative Information. Unemployment benefits are taxable on your federal return. EDD sends a Form 1099-G by January 31 each year. You can elect to have 10 percent withheld from each payment for federal income tax; the rate is fixed at 10 percent and the election is voluntary.15U.S. Department of Labor. If EDD Denies Your Claim

A denial arrives as a Notice of Determination. You have 30 calendar days from the mailing date on the notice to file a written appeal with the California Unemployment Insurance Appeals Board, sent to the office listed on the notice.16California Unemployment Insurance Appeals Board. The appeal doesn’t have to be formal. A signed letter works if it includes your name and mailing address, Social Security number, the employer’s name and account number, the date of the determination notice, and why you disagree. Add a phone number and email. If you’re filing late, explain why. EDD’s standard Appeal Form is preferred but not required. An Administrative Law Judge will hear the case and issue a decision, and further appeals are available if you disagree.

One thing to know about the flip side of your claim: EDD notifies your most recent employer that you filed, and the employer has 10 days to respond with their version of your separation.17Employment Development Department. Accurate, specific answers on your application reduce the odds of that dispute delaying your payments.
