California Gun Laws for Out-of-State Visitors: Transport, Carry, Ammo

California gun laws for out-of-state visitors are strict, and nothing about your home state’s rules carries over at the border. If you’re visiting or driving through with a firearm, you need to transport it unloaded, keep handguns locked in the trunk or a locked container, leave any magazine holding more than 10 rounds at home, leave any assault weapon or .50 BMG rifle at home, and understand that your concealed carry permit from another state has no legal effect here.

How to Transport a Firearm in Your Vehicle

Every firearm in a vehicle in California must be unloaded. State law treats a gun as “loaded” when a live round is in the chamber, in an attached magazine, or physically connected to the firearm in any way.1California Legislative Information. California Penal Code 16840 A handgun with an empty chamber but a loaded magazine inserted still counts as loaded. The clean approach is to remove the magazine entirely and keep it detached.

Handguns have one more requirement. They must be stored in the vehicle’s trunk or in a locked container, meaning a fully enclosed case secured by a padlock, key lock, combination lock, or similar device. A glove compartment or center console does not qualify, even if it locks.2State of California – Department of Justice – Office of the Attorney General. Transporting Firearms in California

Rifles and shotguns must also be unloaded during transport, but under most circumstances they do not need to be in a locked container.2State of California – Department of Justice – Office of the Attorney General. Transporting Firearms in California

One common misunderstanding: California does not require ammunition to be stored in a separate location from the firearm. The actual rule is only that no ammunition can be in or attached to the gun. Ammunition can ride in the same vehicle, and even the same case, as long as none of it is loaded into or connected to the firearm.

Just Passing Through

If you’re driving through California without stopping for an extended stay, the federal Peaceable Journey statute offers some protection. You can transport a firearm through any state as long as you can legally possess it at both your origin and your destination, the gun is unloaded, and neither the firearm nor the ammunition is readily accessible from the passenger compartment. If your vehicle has no separate trunk, both must be in a locked container other than the glove compartment or console.3Office of the Law Revision Counsel. 18 USC 926A – Interstate Transportation of Firearms

California law enforcement has historically taken a narrow view of this federal protection. Stop for anything beyond a brief fuel or food break and you risk being treated as present in the state rather than passing through. The safest approach for anyone transiting California is to comply with both federal and California rules at once: handguns unloaded and locked in the trunk, all firearms unloaded, no ammunition attached.

Firearms You Cannot Bring Into California

California bans entire categories of firearms that are legal in most other states, and bringing one across the state line is a felony with a sentence of four to eight years in prison.4California Legislative Information. California Penal Code 30600

Assault Weapons

California defines assault weapons by features, not brand names. A semiautomatic centerfire rifle without a fixed magazine qualifies if it has any one of the following: a pistol grip protruding below the action, a thumbhole stock, a folding or telescoping stock, a grenade or flare launcher, a flash suppressor, or a forward pistol grip. A semiautomatic centerfire rifle with a fixed magazine holding more than 10 rounds, or one with an overall length under 30 inches, also qualifies.5California Legislative Information. California Penal Code 30515 Similar feature-based tests apply to semiautomatic pistols and shotguns. If your firearm meets any of these tests, it cannot legally enter California. Registration periods for assault weapons closed years ago, and there is no current path for a new owner to register one.6State of California Department of Justice. .50 BMG Rifles

California separately prohibits .50 BMG rifles, defined as centerfire rifles capable of firing a .50 BMG cartridge. Importing one without a prior permit from the Department of Justice is a felony.4California Legislative Information. California Penal Code 30600

Magazines Over 10 Rounds

Any ammunition feeding device that holds more than 10 rounds is illegal to possess, import, or buy in California. This applies to both handgun and rifle magazines. Importing one can carry up to a year in county jail or a state prison sentence.7California Legislative Information. California Penal Code 32310 There is no exception for visitors. Leave anything over 10 rounds at home or in another state before entering California.

Your Out-of-State Concealed Carry Permit Does Not Work Here

California does not honor concealed carry permits from any other state. A CCW license from Texas, Arizona, Florida, or anywhere else has zero legal effect in California.8State of California – Department of Justice – Office of the Attorney General. Regulations – Uniform Carry Concealed Weapons Licenses

Carrying a concealed handgun without a valid California-issued CCW is a criminal offense. For a first-time offender with no aggravating factors it is a misdemeanor punishable by up to one year in county jail, a fine of up to $1,000, or both. The charge escalates to a felony if the gun is loaded and unregistered, if the person has prior felony convictions, or if other aggravating circumstances exist.9California Legislative Information. California Penal Code 25400

Open carry is not a workaround. California prohibits open carry of firearms, loaded or unloaded, in most public places. Visitors who assume they can wear a holstered handgun because they lack a concealed permit are making a serious legal mistake.

Getting a California CCW as a non-resident is extremely difficult. The statute directs applicants to the sheriff of the county where they live, or the county where they maintain a principal place of employment or business and spend substantial time. A visitor with no California residence or employment ties has no clear path to apply.

Ammunition Rules for Visitors

Non-residents cannot buy ammunition inside California. The state’s point-of-sale background check requires a valid California driver’s license or ID card. Non-residents can, however, bring their own ammunition into the state for personal use without going through a vendor or a background check.

The rules change the moment you become a resident. California residents who buy ammunition out of state cannot simply bring it back; it has to be shipped to a licensed ammunition vendor in California, who processes the transfer after a background check.10California Legislative Information. If You’re Moving Here, the Rules Are Different

Everything above assumes you are a visitor. If you’re relocating to California, you become a “personal firearm importer” and must report every firearm you bring with you to the California Department of Justice within 60 days of establishing residency.11State of California – Department of Justice – Office of the Attorney General. Firearms Information for New California Residents Residency can be triggered by actions like renting an apartment, starting a job, or enrolling children in school.12California Legislative Information. California Penal Code 17000 Missing that deadline for a handgun or a centerfire semiautomatic rifle can carry up to a year in county jail, a state prison sentence, a fine of up to $1,000, or both.13California Legislative Information. California Penal Code 27590 Residency obligations are a separate subject from visitor rules, but if your trip is turning into a move, the 60-day clock matters.
