California Import Tax: $800 Exemption, Reporting, and Penalties

California does not have a tax called an “import tax,” but it collects one in substance. The California import tax most people are asking about is use tax, and it applies to goods you buy abroad and bring into or use in the state. The rate matches California’s sales tax: a 7.25% statewide base plus local district taxes, which pushes the combined rate above 10% in some metro areas.1California Department of Tax and Fee Administration. California City and County Sales and Use Tax Rate Information Federal customs duties are separate. They are assessed by U.S. Customs and Border Protection and stack on top of California’s use tax rather than replacing it.2U.S. Customs and Border Protection. Why California Charges Use Tax on Foreign Purchases

Use tax exists to close a loophole. Buy something at a California store and the retailer collects sales tax at the register. Buy the same thing from a foreign seller that doesn’t collect California tax, and the state still wants its share. Use tax fills that gap. It applies to any tangible personal property purchased outside California and then stored, used, or consumed inside the state.3California Legislative Information. California Revenue and Taxation Code 6201

The rate is the combined state-and-local rate for the location where you use the item, so a buyer in Los Angeles may owe a different amount than a buyer in Sacramento on the same purchase. The California Department of Tax and Fee Administration (CDTFA) administers the tax, and the obligation falls on the buyer rather than the foreign seller. That is why many Californians don’t learn they owe it until they file a return, register an imported vehicle, or face an audit.

What Amount Gets Taxed

The taxable figure is the purchase price you paid for the goods. Federal import duties, customs fees, and other border charges are generally not included in that calculation. The CDTFA states that amounts paid as import fees, duty, or other miscellaneous charges at entry are not part of the measure of tax.4California Department of Tax and Fee Administration. California Use Tax for Foreign Purchases One exception: if the foreign seller is the importer of record and builds customs duties into the selling price, those duties become part of the purchase price and are taxed with it.

Handling charges are taxable. Shipping charges depend on how delivery is handled. If the seller ships through a common carrier or the postal service and lists the shipping charge separately, it is generally not taxable. If the seller delivers in its own vehicle, bundles shipping and handling into one line, or marks the delivery charge above the actual cost, some or all of that charge becomes taxable.

The $800 Traveler Exemption

If you travel abroad and bring purchases home in your luggage, the first $800 worth of goods within any 30-day period is exempt from California use tax. Two conditions apply: you must buy the goods from a retailer, and you must personally hand-carry them into the state.5California Franchise Tax Board. Use Tax Anything shipped or mailed to you does not qualify, even if you bought it in person while traveling. For hand-carried goods above $800, use tax applies to the amount over the exemption, measured by the purchase price on your U.S. Customs Declaration.

This California exemption is not the same as the federal de minimis threshold for customs duties. Federal law historically allowed goods valued under $800 to enter duty-free under 19 U.S.C. ยง 1321.6Office of the Law Revision Counsel. 19 US Code 1321 – Administrative Exemptions A 2026 executive action suspended that duty-free de minimis treatment for shipments from all countries.7The White House. Continuing the Suspension of Duty-Free De Minimis Treatment for All Countries Small-value packages ordered from overseas now face federal duties they previously avoided, on top of the California use tax that was always owed regardless of the federal threshold.

Federal Duties Are a Separate Bill

Federal duties and California use tax come from different governments for different reasons, and paying one does not reduce the other. CBP does not collect state taxes, and the CDTFA does not collect federal duties.2U.S. Customs and Border Protection. Duty, Taxes and Other Fees Required to Import Goods Into the United States On a single foreign purchase you can owe both a federal tariff on the goods and California use tax on the purchase price.

CBP also charges a Merchandise Processing Fee (MPF) on most imports. For formal entries, generally goods valued at $2,500 or more, the MPF is 0.3464% of the goods’ value, with a floor of $33.58 and a ceiling of $651.50 for fiscal year 2026. For informal entries under $2,500, the fee is a flat charge ranging from $2.69 to $12.09 per shipment.8U.S. Customs and Border Protection. Customs User Fee – Merchandise Processing Fees

When the Marketplace Collects the Tax for You

If you buy from a foreign seller through a major platform such as Amazon, eBay, or Etsy, the marketplace has likely already collected California use tax on your behalf. Since October 2019, California law treats marketplace facilitators as the retailer for tax purposes, which makes the platform responsible for collecting and remitting the tax on sales it facilitates.9California Legislative Information. California Revenue and Taxation Code 6041 It applies whether the actual seller sits in China, Germany, or anywhere else.

The catch is that this only covers sales made through the platform. Buy directly from a foreign retailer’s own website and the marketplace facilitator rules do not apply, so you are responsible for self-reporting the use tax. The same goes for purchases from foreign brick-and-mortar stores, online auctions outside the major platforms, and sellers you find through social media.

How to Report and Pay

For personal purchases you have two reporting options. The simpler one is adding the use tax to your California state income tax return on Form 540 or Form 540 2EZ. You enter the amount on the designated line, and it is collected with your state tax payment. For purchases under $1,000 each, you can use the CDTFA’s Use Tax Lookup Table instead of tracking every receipt, which estimates liability based on adjusted gross income.10California Department of Tax and Fee Administration. California Use Tax for Personal Use

The second option is paying the CDTFA directly, and it is required for certain purchases. Vehicles, vessels, aircraft, mobile homes, and cigarettes and tobacco products cannot be reported on your income tax return and must go through other channels.10California Department of Tax and Fee Administration. California Use Tax for Personal Use Use tax on personal purchases is due by April 15 of the year after the purchase. If you hold a CDTFA consumer use tax account, you must report all use tax directly to the CDTFA and cannot use the income tax return method.

Businesses importing goods for their own use owe use tax the same way individuals do, and businesses with a seller’s permit report it on their periodic sales and use tax returns. Goods brought in as inventory for resale are exempt when the buyer provides the foreign supplier with a valid California resale certificate; the moment resale inventory is pulled for personal or internal use, use tax becomes due on that item.11Legal Information Institute. California Code of Regulations Title 18 Section 1668 – Sales for Resale

Vehicles, Vessels, and Aircraft

Bringing a foreign vehicle into California triggers both federal compliance requirements and state use tax. At the federal level, any motor vehicle entering the U.S. must meet safety standards under the Imported Vehicle Safety Compliance Act and air pollution standards under the Clean Air Act. Nonconforming vehicles must be brought into compliance, exported, or destroyed.12U.S. Customs and Border Protection. Importing a Motor Vehicle

Once a vehicle clears federal inspection, California’s DMV collects the use tax during registration and will not register the vehicle without either payment of use tax or a CDTFA clearance form.13California Department of Motor Vehicles. Vehicle Industry Registration Procedures Manual – 4.040 Transactions Subject to Use Tax The same rule applies to vessels and aircraft. Registering any of these outside California specifically to avoid use tax carries a 50% penalty on top of the tax owed.14California Department of Tax and Fee Administration. Interest, Penalties, and Collection Cost Recovery Fee

Alcohol and Tobacco

Alcohol and tobacco imports face use tax, state excise tax, and personal volume limits set by California’s Alcoholic Beverage Control board. Adults arriving by plane or ship from a foreign country can bring up to 60 liters (roughly five cases) of alcohol for personal use. California residents crossing the Mexican border by car or on foot are limited to one liter every 31 days, the amount exempt from federal duty.15California Department of Alcoholic Beverage Control. Importing Alcoholic Beverages for Personal or Household Use

California’s excise tax on alcoholic beverages is based on volume: $0.20 per gallon on beer and wine, $0.30 per gallon on champagne and sparkling wine, and $3.30 per gallon on distilled spirits at 100 proof or less. The state excise tax on cigarettes is $0.1435 per cigarette, or $2.87 per pack of 20, and other tobacco products are taxed at 54.27% of wholesale cost as of July 2025.16California Department of Tax and Fee Administration. Tax Rates – Special Taxes and Fees Use tax on cigarettes and tobacco cannot be reported on your income tax return and must be paid directly to the CDTFA.

Penalties for Skipping Use Tax

Ignoring use tax gets expensive fast. The CDTFA stacks several penalties on top of the original tax:

  • Late payment: 10% of the unpaid tax.
  • Failure to file a return: an additional 10%.
  • Negligence: 10% if the underpayment resulted from carelessness or intentional disregard.
  • Fraud or evasion: 25% of the amount owed, plus potential criminal prosecution.
  • Vehicle, vessel, or aircraft registration evasion: 50%.

Interest accrues on top of these penalties at a rate tied to the IRS underpayment rate plus three percentage points, calculated monthly from the original due date.14California Department of Tax and Fee Administration. Interest, Penalties, and Collection Cost Recovery Fee The total penalty for a single return is capped at 10% of the tax owed, excluding the fraud and vehicle evasion penalties, which have no such cap. On a $20,000 foreign purchase caught years later in an audit, the combined penalties and interest can push the final bill well past double the tax itself.
