California Pregnancy Disability Leave, known as PDL, gives you up to four months of job-protected time off whenever you’re physically unable to work because of pregnancy, childbirth, or a related medical condition. The law sits inside the Fair Employment and Housing Act and is enforced by the California Civil Rights Department. It applies from your first day on the job, requires your employer to keep your group health insurance going while you’re out, and obligates your employer to consider reasonable accommodations and temporary transfers so you can keep working when that’s what you need.
Who Qualifies
PDL covers every employee, full-time or part-time, who works for a private or public employer with five or more workers.1California Legislative Information. California Code, Government Code – GOV 12926 That five-employee threshold comes from the Fair Employment and Housing Act’s definition of “employer,” and it sweeps in most businesses operating in California.
There’s no tenure requirement and no hours-worked requirement. Federal FMLA, by contrast, demands 12 months of employment and at least 1,250 hours of service before you’re eligible.2U.S. Department of Labor. Family and Medical Leave Act PDL has nothing like that. Someone hired last week has the same right to leave as someone who’s been with the company for a decade, as long as the employer meets the five-employee minimum.
How Much Leave You Get
The maximum is four months per pregnancy, which works out to 17⅓ weeks on a full-time schedule.3CalHR. 2120 – Pregnancy Disability Leave “Four months” means the number of working days you’d normally work in one-third of a year, so a part-time employee receives a proportionally smaller block of total days.4California Civil Rights Department. “Disabled by pregnancy” covers a lot of ground. It includes severe morning sickness, gestational diabetes, pregnancy-induced hypertension, preeclampsia, doctor-ordered bed rest, childbirth itself, recovery from childbirth, loss or end of pregnancy, postpartum depression, prenatal and postnatal care, and lactation-related medical conditions.3CalHR. 2120 – Pregnancy Disability Leave
You don’t have to take the leave in one block. Intermittent leave is allowed, so hours or days taken on your health care provider’s recommendation draw down from your total allotment rather than requiring a continuous absence. Reduced schedules and occasional prenatal appointments both qualify.4California Civil Rights Department. Leave for Pregnancy Disability and Child Bonding – Quick Reference Guide
Accommodations and Transfer Rights
Leave isn’t your only option. If your health care provider recommends it, your employer must provide reasonable accommodations for conditions related to pregnancy, childbirth, or recovery.5California Legislative Information. California Code, Government Code – GOV 12945 That can mean modified duties, a stool or chair, more frequent breaks, or a schedule adjustment.6California Civil Rights Department. Your Rights and Obligations as a Pregnant Employee
If your role involves strenuous or hazardous tasks, you can request a temporary transfer to a less demanding position, and the employer must grant it if a suitable opening exists. Using accommodations and transfers where you can lets you preserve your leave balance for when you actually can’t work.
Pay During Leave
PDL itself is unpaid. Your employer has no obligation to pay your salary while you’re out, but a few income sources are usually available.4California Civil Rights Department. Leave for Pregnancy Disability and Child Bonding – Quick Reference Guide
- Accrued vacation. The statute specifically gives you the right to use any accrued vacation during PDL.5California Legislative Information. California Code, Government Code – GOV 12945
- Sick leave. Your employer can require you to use accrued sick time unless you’re already receiving State Disability Insurance.
- State Disability Insurance. California’s SDI program, administered by the Employment Development Department, replaces 70 to 90 percent of your wages depending on your income, with weekly benefits ranging from $50 to $1,765. The program is funded by a 1.3 percent payroll deduction with no wage ceiling.7Employment Development Department. Disability Insurance Benefits8Employment Development Department. SDI is the main income source for most employees on PDL. You apply through EDD, and benefits begin after a short waiting period. Once your pregnancy-related disability ends and you move into bonding time under CFRA, you can apply separately for Paid Family Leave benefits through the same agency at the same replacement rate.9Employment Development Department. Health Insurance While You’re Out
Your employer must continue paying for your group health insurance during PDL at the same level and under the same terms as if you were still working, for up to four months within a 12-month period.5California Legislative Information. California Code, Government Code – GOV 12945 You remain responsible for your share of the premium, but the employer can’t drop your coverage or change its terms because you’re on leave.4California Civil Rights Department. One caveat: if you don’t return to work after your leave expires and the reason isn’t a continuing medical condition or a transition to CFRA leave, your employer may recover the premiums it paid on your behalf during the leave.5California Legislative Information. Notice and Medical Certification
When your need for leave is foreseeable, such as an expected delivery date or planned procedure, give your employer at least 30 days’ advance notice.10New York Codes, Rules and Regulations. 2 California Code of Regulations 11051 – Employer Notice When something comes up suddenly, notify your employer as soon as you can, even if it’s just a phone call.
Your employer can require a written medical certification from your health care provider stating the nature of the condition, when the disability began, and how long it’s expected to last. The only exception is a genuine medical emergency where there’s no time to get the paperwork.10New York Codes, Rules and Regulations. 2 California Code of Regulations 11051 – Employer Notice If your condition lasts longer or shorter than first expected, send in updated documentation so your employer can adjust.
Getting Your Job Back
When your disability ends and you’re ready to return, your employer must give you back the same position you held before the leave started.11California Civil Rights Department. Pregnancy Disability Leave Fact Sheet You can request that guarantee in writing before leave begins, which is worth doing even though the law already provides it.
If your original position genuinely no longer exists for a reason unrelated to your leave, such as a company-wide layoff or office closure, the employer must offer a comparable position with the same tasks, skills, pay, and benefits.12New York Codes, Rules and Regulations. 2 California Code of Regulations 11043 – Right to Reinstatement from Pregnancy Disability Leave There’s a limit, though. You don’t gain more rights than you’d have had if you’d been working the whole time. If the company would have laid you off regardless of your leave, the reinstatement guarantee doesn’t override that.11California Civil Rights Department. Pregnancy Disability Leave Fact Sheet
Adding Bonding Time After PDL
PDL covers only the period you’re medically unable to work. Once your health care provider clears you, that leave ends. A separate law, the California Family Rights Act, provides up to 12 additional weeks of job-protected leave to bond with your new child.13Civil Rights Department. Family Care and Medical Leave and Pregnancy Disability Leave
Here’s the critical structural point: PDL and CFRA do not run at the same time. CFRA leave begins after PDL ends.4California Civil Rights Department. Leave for Pregnancy Disability and Child Bonding – Quick Reference Guide Stacking them, an employee can be away from work for roughly seven months: up to four months of pregnancy disability followed by 12 weeks of bonding time.
CFRA carries its own eligibility rules that PDL does not. You need at least 12 months of employment and 1,250 hours worked in the year before your leave starts. If you’re newer to the job, you’ll have full PDL rights but may not qualify for the CFRA bonding period. Talk to HR early so you know which protections apply to you.
How PDL Interacts With FMLA
Federal FMLA provides 12 weeks of leave for pregnancy-related incapacity, and it runs concurrently with PDL, meaning the clocks tick together.4California Civil Rights Department. Leave for Pregnancy Disability and Child Bonding – Quick Reference Guide FMLA doesn’t add any extra weeks on top of PDL. The California law is the more generous protection because PDL alone gives you up to 17⅓ weeks for the disability period, where FMLA offers 12 weeks for the disability and bonding combined.
The sequencing matters. Under federal law, an employee who uses 12 weeks of FMLA on pregnancy disability has no FMLA time left for bonding. California avoids that trap by keeping CFRA separate from PDL. CFRA bonding leave does run concurrently with FMLA, but by that point much of the FMLA entitlement has typically already been used during the disability period.
If Your Employer Violates Your Rights
If your employer denies you leave, refuses accommodations, retaliates against you for requesting PDL, or fails to reinstate you, you can file a complaint with the California Civil Rights Department. For employment cases, you have three years from the date of the last harmful action to submit an intake form.14California Civil Rights Department. Complaint Process
The process starts with that intake form, followed by an interview with a CRD representative who decides whether a formal investigation is warranted. Bring documentation: termination letters, written warnings, emails, text messages, and medical records supporting your disability. You don’t need a lawyer to file, but consulting one before the intake interview can help you organize your case.
You also have the option to skip the CRD investigation and file your own lawsuit in court. For employment claims, you must first obtain a Right-to-Sue notice from CRD before heading to court.14California Civil Rights Department. Complaint Process CRD can issue that notice promptly on request, letting you move to litigation on your own timeline.
