Carrying a loaded firearm in public is a crime under California Penal Code 25850. The base offense is a misdemeanor punishable by up to one year in county jail and a fine of up to $1,000, but a prior felony, gang involvement, a stolen weapon, or prohibited-person status turns it into a straight felony, and two other scenarios make it a wobbler the prosecutor can file either way. Where your case falls in that tiered structure drives everything else.1California Legislative Information. California Penal Code 25850 – Carrying a Loaded Firearm
What the Prosecution Has to Prove
Three elements, each beyond a reasonable doubt: you carried a firearm on your body or in a vehicle; the firearm was loaded; and you were in a public place, on a public street in an incorporated city, or in a prohibited area of unincorporated territory.1California Legislative Information. California Penal Code 25850 – Carrying a Loaded Firearm
The knowledge rule catches people off guard. Prosecutors must prove you knew you were carrying a firearm. They do not have to prove you knew it was loaded. If a friend hands you a bag and you know a gun is inside, you can be convicted even if you were sure it was empty. The flip side is also true: if you genuinely had no idea a firearm was present, that lack of awareness is a defense.
Concealed or openly carried makes no difference under this section. California prohibits both.
What Counts as Loaded
California defines “loaded” more broadly than most people assume. Under Penal Code 16840, a firearm is loaded when an unexpended cartridge or shell is in the firing chamber or in any attached magazine or clip.2California Legislative Information. California Code PEN 16840 – Definition of Loaded
So a magazine with live rounds inserted into the gun means the gun is loaded, even if nothing has been chambered. Detaching the ammunition source from the firearm is what separates loaded from unloaded for purposes of this statute.
Where the Law Applies, and Where It Doesn’t
“Public place” is read broadly. Sidewalks, streets, parks, and shopping center parking lots all qualify. If members of the public can walk through or enter the area, it almost certainly counts.1California Legislative Information. California Penal Code 25850 – Carrying a Loaded Firearm
The statute does not reach your own private property or your place of business. Under Penal Code 26035, anyone in lawful possession of private property may have a loaded firearm there, and anyone engaged in a lawful business may keep a loaded firearm at that business. The exemption extends to employees and agents authorized by the owner for lawful business purposes.3California Legislative Information. California Code PEN 26035 – Business and Private Property Exemption One boundary worth naming: being on your own property does not override a separate prohibition based on felony status or a restraining order. Other firearm restrictions still apply.
How the Penalties Break Down
PC 25850(c) sorts cases into three tiers. The tier is set by your background and by facts about the weapon, not by the carrying conduct itself.
Misdemeanor Base Offense
With no aggravating factors, the offense is a misdemeanor under PC 25850(c)(7). Maximum penalty: one year in county jail, a fine of up to $1,000, or both.4California Legislative Information. California Code PEN 25850 – Carrying a Loaded Firearm
Wobbler Scenarios
Two scenarios give the prosecutor discretion to file as a misdemeanor or a felony:
- A prior conviction for a crime against a person or property, or a narcotics offense (PC 25850(c)(5)).
- The handgun is not registered to you with the Department of Justice (PC 25850(c)(6)).
Filed as a felony, sentencing runs through Penal Code 1170(h). The default triad where no specific term is stated is 16 months, two years, or three years. Felonies under 1170(h) are generally served in county jail rather than state prison, unless you have prior serious or violent felony convictions, are a registered sex offender, or fall into another category listed in PC 1170(h)(3).5California Legislative Information. California Code PEN 1170 – Sentencing The maximum felony fine is $10,000 under PC 672, California’s general fine provision for felonies whose underlying statute does not set a higher amount.
Straight Felony Scenarios
Four situations make the charge an automatic felony. The prosecutor cannot reduce it:
- A prior felony conviction, or a prior conviction for an offense listed in PC 16580.
- You knew or had reason to believe the firearm was stolen.
- You are an active participant in a criminal street gang.
- You are legally barred from possessing firearms under state or federal law.
These categories are PC 25850(c)(1) through (c)(4).4California Legislative Information. California Code PEN 25850 – Carrying a Loaded Firearm The same triad applies, and defendants in these categories more often have the kind of criminal history that routes them to state prison under the 1170(h)(3) exceptions.
What a Conviction Does to Your Firearm Rights
A felony conviction under PC 25850 triggers a lifetime ban on owning, purchasing, receiving, or possessing any firearm under California Penal Code 29800.6California Legislative Information. California Code PEN 29800 – Felon Firearm Possession Prohibition Federal law independently imposes its own lifetime ban on anyone convicted of a crime punishable by more than one year of imprisonment, so a California felony bars you under both systems at once.7Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts
A misdemeanor conviction under PC 25850(c)(5), (6), or (7) triggers a 10-year prohibition on firearm ownership for convictions on or after January 1, 2024. During those 10 years, possessing any firearm is itself a crime.8California Legislative Information. California Penal Code 29805 – Misdemeanor Firearm Prohibition
Exemptions and Defenses
The clearest defense is lack of knowledge. If you genuinely did not know a firearm was in your car or your bag, the prosecution cannot satisfy the knowledge element. This often arises with borrowed vehicles or shared bags.
Statutory exemptions also function as defenses, and the burden sits with the prosecutor. You do not have to prove you were exempt. The prosecutor has to prove you weren’t.3California Legislative Information. California Code PEN 26035 – Business and Private Property Exemption The main categories:
- Holders of a valid California Concealed Carry Weapon (CCW) permit, which authorizes carrying a loaded, concealed handgun in public places where it would otherwise be illegal.
- Members of the U.S. or California military forces performing their duties.
- Active peace officers, and honorably retired federal law enforcement officers who meet specified training requirements and have sheriff approval.
- People using a firing range for practice.
- Members of shooting clubs while hunting on club premises.
These are spread across Penal Code sections 26000 through 26060.9Justia. California Code Penal Code 26000-26060 – Other Exemptions to the Crime of Carrying a Loaded Firearm in Public
A narrower exemption under Penal Code 26045 covers people who reasonably believe that they or someone else face immediate, grave danger and that carrying the weapon is necessary to preserve life or property. “Immediate” is read tightly: the brief window before and after you contact local law enforcement (when reasonably possible) and before help arrives. A parallel provision in the same section applies where the danger comes from someone subject to a current restraining order. In either case, the jury decides whether the belief was reasonable, not just sincere.10California Legislative Information. California Penal Code 26045 – Grave Danger Exemption
Federal Exposure for Prohibited Persons
Federal law under 18 U.S.C. ยง 922(g) separately bars certain categories from possessing any firearm or ammunition, regardless of what California allows. The prohibited categories include people convicted of a crime punishable by more than a year in prison, fugitives, people subject to certain domestic-violence restraining orders, people convicted of misdemeanor domestic violence, unlawful users of controlled substances, and people involuntarily committed to a mental institution.11Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons
If any of those apply to you and you are caught carrying a loaded firearm, you face state charges under PC 25850 and potential federal prosecution for the same conduct. The federal charge carries up to 10 years in federal prison, well beyond any penalty California attaches to the carrying offense itself.7Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts
