California Proof of Insurance Requirements and Penalties

In California, you must carry evidence of financial responsibility in your vehicle whenever you drive, and California’s proof of insurance requirements are satisfied by a current insurance identification card (paper or on your phone), a policy declarations page, an insurance binder, a DMV-issued letter confirming an approved alternative, or an SR-22 certificate. The underlying coverage has to meet the state’s 30/60/15 liability minimums for any policy issued or renewed on or after January 1, 2025.1California Legislative Information. What Counts as Valid Proof

Vehicle Code section 16020 requires you to carry evidence of financial responsibility at all times while operating a vehicle.2California Legislative Information. California Code Vehicle Code 16020 – Financial Responsibility The most common form is the insurance identification card your carrier issues. It can be a physical card in your glove box or a digital version on your phone. Section 16028 specifically authorizes using a mobile electronic device to display proof.3California Legislative Information. California Code Vehicle Code 16028 If you hand over your phone, the officer is only authorized to view the proof, not the rest of your device.

Other acceptable documents include:

  • A copy of your policy’s declarations page
  • An insurance binder or covering note from your insurer
  • A DMV-authorized letter confirming your cash deposit, self-insurance certificate, or surety bond
  • An SR-22 certificate filed by your insurer with the DMV

Whatever form you carry should show the insurer’s name, your policy number, the effective and expiration dates, and the covered vehicle. An SR-22 is not a separate policy. It’s a form your insurer files with the DMV guaranteeing you carry at least the state minimum coverage, and California typically requires it for three years after a suspension for a DUI or driving uninsured.

When You Have to Show Proof

The most common trigger is a traffic stop. Once an officer has pulled you over for any other violation, asking for proof of insurance alongside your license and registration is standard. An officer cannot stop you solely to check whether you’re insured, but once the stop is underway for a different reason the request is routine.3California Legislative Information. California Code Vehicle Code 16028

You also have to show proof after any traffic accident and exchange insurance information with the other drivers involved. A peace officer or traffic collision investigator at the scene can request your proof, and failing to produce it can bring a separate citation on top of anything else arising from the crash.3California Legislative Information. California Code Vehicle Code 16028

Beyond traffic encounters, you’ll need current proof whenever you register a vehicle or renew the registration with the DMV. New residents have 20 days to register a vehicle after moving to California, and registration requires proof of insurance from a company licensed in California.4California DMV. New to California An out-of-state policy won’t do it.

The Coverage Behind the Proof

For a policy to actually satisfy the law, it has to meet California’s current minimum limits under Vehicle Code section 16056:

  • $30,000 for bodily injury or death to one person per accident
  • $60,000 for bodily injury or death to all people per accident
  • $15,000 for property damage per accident

These 30/60/15 minimums took effect for policies issued or renewed on or after January 1, 2025, replacing the old 15/30/5 limits. The California Department of Insurance has confirmed the higher limits phase in as policies come up for renewal, so by 2026 virtually every active policy reflects the new floor.5California Department of Insurance. New Year Means New Changes for Insurance, Make Sure You are Protected These are liability-only minimums that cover other people’s injuries and property. They don’t pay for your own vehicle or medical bills.

The Low Cost Auto Insurance Program

Income-eligible drivers can satisfy the law with a policy from the California Low Cost Automobile Insurance Program. Policies issued under the program carry thinner minimums of $10,000 per person and $20,000 per accident for bodily injury, plus $3,000 for property damage.6California Legislative Information. California Code Vehicle Code 16056.1 The coverage is light, but it meets the state’s financial responsibility requirement and costs far less than driving uninsured.

Alternatives to a Standard Policy

You don’t technically need a traditional policy to meet California’s financial responsibility law. Section 16054.2 lets you deposit cash with the DMV in the amount specified by section 16056, which under current limits works out to $75,000.7California Legislative Information. California Code VEH 16054.2 – Evidence of Financial Responsibility You can also post a surety bond for the same amount through a company licensed in California. Self-insurance is a third option, but it’s limited to anyone with more than 25 motor vehicles registered in their name, which effectively restricts it to fleet operators.8California Legislative Information. California Code Vehicle Code 16052

If you drive regularly but don’t own a car, a non-owner policy provides liability coverage that follows you as a driver rather than a specific vehicle. It covers borrowed or rented cars but typically pays nothing toward damage to the vehicle you’re driving or your own injuries. Non-owner coverage also keeps your insurance history continuous during periods without a car and can satisfy an SR-22 filing requirement when you don’t own a vehicle.

Penalties for Not Showing Proof

Driving without proof of financial responsibility is an infraction under Vehicle Code section 16029. The base fines are:

  • First offense: $100 to $200, plus penalty assessments
  • Repeat offense within three years: $200 to $500, plus penalty assessments

The base fine is only part of what you actually pay. California stacks surcharges, court operation assessments, and conviction assessments on top of every traffic fine under the 2026 Uniform Bail and Penalty Schedule.9Judicial Branch of California. Uniform Bail and Penalty Schedules 2026 A $100 base fine can reach roughly $490 after assessments, and a $500 base fine can exceed $1,500.10California Legislative Information. California Code Vehicle Code 16029

The court also has discretion to order your vehicle impounded on conviction. It isn’t automatic, but a judge can impose it for good cause, and you only get the vehicle back by showing valid proof of financial responsibility and paying all towing and storage fees.10California Legislative Information. California Code Vehicle Code 16029

If You Had Insurance but Not the Card

If you were actually insured at the time of the stop but didn’t have proof on hand, the citation can be dismissed. Under Vehicle Code section 16028(e), you present proof to the court clerk showing coverage was in force on the date of the citation and pay a $25 processing fee. The case is dropped, and it can be handled by mail or in person.11Judicial Branch of California. On the Implementation of the Mandatory Automobile Insurance Law This only works if coverage was genuinely active. It won’t help with a lapsed policy.

License and Registration Suspension

If you’re involved in a reportable accident and can’t show proof of financial responsibility, Vehicle Code section 16070 requires the DMV to suspend your driving privilege. You get a notice of intent to suspend and have 30 days to produce evidence you were covered at the time of the crash. If you can’t, the suspension takes effect automatically, regardless of who caused the accident.12California Legislative Information. California Code Vehicle Code 16070

Reinstatement requires filing proof of financial responsibility with the DMV and paying a $14 reinstatement fee.13California DMV. Suspensions In most cases, your insurer will also have to file an SR-22, which carriers typically charge $15 to $50 to process. The SR-22 requirement then stays in place for three years, and any lapse during that period triggers a new suspension.

How the DMV Spots a Gap

The DMV doesn’t wait for a traffic stop. Vehicle Code section 16058 requires every insurer writing private passenger auto policies in California to electronically report coverage data: new policies within 30 days of the effective date and cancellations within 45 days.14California Legislative Information. California Code VEH 16058 – Evidence of Financial Responsibility When the system sees a cancellation without a replacement policy, the DMV sends a warning letter asking for proof of current coverage. If you don’t respond, the vehicle’s registration is suspended, which makes it illegal to drive or even park the vehicle on a public street. Reinstating a suspended registration requires valid insurance and payment of applicable DMV fees.

Rideshare and Delivery Drivers

If you drive for Uber, Lyft, or a similar platform, your personal policy alone generally won’t satisfy the law while you’re logged in. The California Public Utilities Commission splits rideshare driving into three periods with different coverage requirements:15California Public Utilities Commission. Insurance Requirements for TNCs

  • Period 1 (app on, waiting for a request): primary coverage of at least $50,000 per person and $100,000 per accident for bodily injury, $30,000 for property damage, plus $200,000 excess per occurrence
  • Period 2 (ride accepted, en route to pick up): $1,000,000 primary commercial coverage
  • Period 3 (passenger in the vehicle): $1,000,000 primary commercial coverage, plus $1,000,000 uninsured and underinsured motorist coverage

Rideshare companies’ commercial policies usually handle Periods 2 and 3. Period 1 is the gap where drivers get caught, because many personal policies exclude rideshare activity entirely. Ask your personal insurer whether a rideshare endorsement is available to bridge Period 1. Delivery drivers face a parallel issue: most personal policies exclude commercial use, so verify what the delivery platform covers during active runs and whether your personal policy needs a commercial endorsement.
