There is no California real estate license reciprocity with any other state. An active license from Texas, Florida, New York, or anywhere else gives you no shortcut, no waiver, and no credit when you apply in California. The Department of Real Estate treats a twenty-year veteran from another state the same as someone who has never held a license.1Department of Real Estate. Department of Real Estate – Out-of-State Applicants If you want to sell California property, you complete the full California process from the beginning.
You do not have to live in California to get licensed here. But you do have to meet every requirement a California resident meets.
What You Actually Have to Do to Get Licensed in California
The salesperson path has four parts, and none of them can be skipped on the strength of a license from somewhere else.
Three Pre-License Courses
You must complete three college-level courses from a DRE-approved school before you can sit for the exam. Each course runs a minimum of 45 hours, so plan on at least 135 hours of instruction. The required courses are Real Estate Principles, Real Estate Practice (which must include components on implicit bias and fair housing), and one elective from a DRE-approved list that includes Real Estate Finance, Property Management, Real Estate Appraisal, Legal Aspects of Real Estate, and Business Law.2California Department of Real Estate. If you have equivalent college coursework, you can submit transcripts and ask the DRE to evaluate them. It decides case by case.
The California Exam
Once the DRE approves your exam application, you take a computer-based multiple-choice test on California-specific law, practice, and principles. The exam is known for being difficult; pass rates generally hover around 50%.2California Department of Real Estate. Fingerprints and Background Check
Every applicant is fingerprinted for a background check run through the California Department of Justice and the FBI. The DRE will not issue a license until both reports come back clear. Applicants inside California use a Live Scan provider. If you are out of state, you get fingerprinted at a local law enforcement agency on FBI Applicant Fingerprint Cards (FD-258) and mail them to the DRE with a $49 processing fee.3Department of Real Estate. Consent to Service of Process
Non-residents must file a Consent to Service of Process (Form RE 234) with the DRE. The form authorizes the DRE to accept legal service on your behalf in California. It has to be completed, signed, and notarized before you send it in.1Department of Real Estate. Department of Real Estate – Out-of-State Applicants
Fees and How Long It Takes
Budget the following for a salesperson license:
- Examination application: $100
- Original license fee: $350
- Fingerprint processing: $49
- Re-examination (if needed): $100 per attempt
A combined exam-and-license application runs $450 to the DRE plus the fingerprint fee.4California Department of Real Estate. Fees Pre-license courses add a few hundred dollars through online providers. After you mail your application, expect roughly six to eight weeks before you receive an exam date; busy periods push that longer.5California Department of Real Estate. Steps to Becoming a Licensed Real Estate Salesperson or Broker
If You Are Already a Broker in Another State
Being a broker elsewhere does not shorten the California broker path. It lengthens it. You must complete eight college-level courses, each at least 45 hours, covering Real Estate Practice, Legal Aspects of Real Estate, Real Estate Finance, Real Estate Appraisal, and Real Estate Economics, plus three electives from a DRE-approved list.6California Department of Real Estate. Requirements to Apply for a Real Estate Broker License
You also need at least two years of full-time licensed salesperson experience within the last five years, or equivalent experience the DRE accepts as qualifying. A four-year degree with a major or minor in real estate can satisfy the experience requirement. California State Bar members are exempt from the education requirements but still take the broker exam. The broker exam fee is $150 and the original broker license is $450.4California Department of Real Estate. Fees
Non-resident brokers who actively do business in California must maintain a California business address. If you hold the license but are not conducting business in the state, you are exempt from that requirement but must file an Out-of-State Broker Acknowledgment (Form RE 235).1Department of Real Estate. States That Will Give a California Agent a Shortcut
Reciprocity runs one way. California gives you nothing for an outside license, but several states do give California licensees some form of recognition when they apply there. The specifics vary, and the typical pattern is a waiver of pre-license education, the national exam portion, or both, while you still take a state-specific law exam.
- Georgia lets agents licensed in other states apply for a comparable Georgia license by submitting a certified license history, a criminal background report, and a $170 fee. Florida residents face an additional state law exam, but California agents follow the standard reciprocal process.7Georgia Real Estate Commission. Reciprocity for Real Estate Licensees
- Colorado offers partial recognition to agents licensed in any U.S. state or territory, with reduced examination or pre-license education requirements.8Division of Real Estate. Broker License Partial Recognition Agreement and Reciprocity
- Alabama has reciprocity agreements with most states and requires a six-hour reciprocal salesperson pre-license course on Alabama license law.
Maine, Mississippi, and Virginia are also commonly listed as offering some form of recognition, but requirements change often. Check directly with the destination state’s real estate commission before you assume your California license counts for anything. Some reciprocity agreements apply only if your original license was obtained by examination rather than through another state’s reciprocity process.
Doing California Deals Without a California License
Performing real estate activities in California without a valid DRE license is a criminal offense. An individual can face a fine of up to $20,000, up to six months in county jail, or both. For corporations, the maximum fine is $60,000.9California Legislative Information. California Business and Professions Code 10139 If a transaction touches California property, your home-state license does not cover you. You either refer the deal to a California-licensed agent or you get licensed here first.
California Income Tax on Your Commissions
Once licensed, if you earn commissions from transactions involving California property or California clients, you owe California income tax on that income no matter where you live. Non-residents file using Form 540NR, the California Nonresident or Part-Year Resident Income Tax Return.10Franchise Tax Board. Part-Year Resident and Nonresident Brokerages and other entities paying California-sourced income to non-residents are generally required to withhold 7% once total payments exceed $1,500 in a calendar year.11Franchise Tax Board.
