The California stair railing code requires a guard at least 42 inches high along any walking surface more than 30 inches above the floor or ground below, a graspable handrail between 34 and 38 inches on any stairway with four or more risers, and infill spacing tight enough to block a 4-inch sphere. Those numbers come from the California Building Code (CBC) and California Residential Code (CRC), which together form Title 24 of the California Code of Regulations. California amends the model codes it borrows from, and several of its railing rules are stricter than what you will find quoted on national websites.
Before starting work, check with your local building department. Cities and counties can adopt amendments tougher than the statewide baseline, and the permit reviewer is applying the local version.
When a Guard Is Required
Guards are the vertical barriers that keep people from falling off an open edge. Under both the CBC and CRC, a guard is required along any open-sided walking surface, stair, ramp, landing, mezzanine, or equipment platform that sits more than 30 inches above the floor or grade below at any point within 36 inches horizontally of the edge.1UpCodes. California Building Code 2025 Chapter 10 Means of Egress2UpCodes. California Residential Code 2022 Chapter 3 Building Planning
If the drop is 30 inches or less, a guard is generally not required, though some local jurisdictions set a lower trigger. The 30-inch measurement is taken from the walking surface to the ground or floor below at the worst-case point, not just straight down from the edge. Decks, balconies, porches, and loft edges all fall under this rule.
Guard Height: The 42-Inch Rule
This is where California diverges from most other states. The International Residential Code calls for 36-inch guards in one- and two-family dwellings. California requires 42 inches for all occupancy types, including single-family homes.1UpCodes. California Building Code 2025 Chapter 10 Means of Egress The height is measured vertically from the adjacent walking surface, or from the line connecting the stair nosings on a stairway.
Two exceptions apply on the open side of stairs in Group R-3 occupancies (single-family homes) and individual dwelling units in Group R-2 occupancies (apartments and condos):
- The guard along an open-sided stair can be reduced to no less than 34 inches, measured vertically from the nosing line.
- Where the top of that stair guard also serves as the handrail, it must fall between 34 and 38 inches from the nosing line.
The exception applies only on stairs. If you are replacing a railing on a deck, balcony, or landing, the full 42-inch height applies. Homeowners upgrading older railings often expect the 36-inch figure they see cited on national sites. That figure does not apply in California.
Baluster Spacing and the 4-Inch Sphere Rule
Guard openings are sized to prevent small children from slipping through. From the walking surface up to the required guard height, no opening in a guard can allow a 4-inch-diameter sphere to pass through.3UpCodes. California Building Code 2025 Chapter 10 Means of Egress – Section 1015.4 That covers the space between balusters, the gap under the bottom rail, and any infill panels.
Two narrow exceptions apply on stairways:
- The triangular gap formed by the tread, riser, and bottom rail on the open side of a stair may allow passage of a sphere up to 6 inches in diameter. The wedge shape makes the wider dimension hard for a child to fit through.3UpCodes. California Building Code 2025 Chapter 10 Means of Egress – Section 1015.4
- In the portion of a stair guard between 36 and 42 inches above the nosing line, openings can be slightly larger, up to 4-3/8 inches for a sphere.
Cable railings need extra attention. A tensioned cable still flexes when someone pushes against it, temporarily widening the gap between cables. Industry practice is to space horizontal cables about 3 inches apart, center to center, so the gap stays under 4 inches when a cable deflects. Intermediate posts or vertical spacers every 3 to 4 feet help keep the cables from sagging between anchor points. Building departments often ask for manufacturer specifications or a structural engineer’s letter confirming the system passes the deflection test.
Handrails: Height, Continuity, and Grip
A handrail does a different job than a guard. It gives you something to hold while climbing or descending. The CRC requires a handrail on at least one side of any stairway with four or more risers. The top of the handrail must sit between 34 and 38 inches above the stair nosings, measured vertically from the sloped plane connecting the nosing edges.4UpCodes. California Residential Code 2022 Chapter 3 Building Planning – Section R311.7.8.1
Residential handrails must be continuous for the full length of the flight, from directly above the top riser to directly above the lowest riser. The ends have to return to a wall, guard, walking surface, or terminate into a post.5UpCodes. California Residential Code 2022 Chapter 3 Building Planning – Section R311.7.8.4 The return prevents clothing and bag straps from snagging on an exposed end. When mounted against a wall, the rail needs at least 1-1/2 inches of clearance between the wall surface and the rail.
Graspability: Type I and Type II
The shape of the handrail cross-section decides whether it actually works as a grip. The CRC recognizes two types:6UpCodes. California Residential Code 2022 Chapter 3 Building Planning – Section R311.7.8.5
- Type I is the common shape. A circular handrail must have an outside diameter between 1-1/4 and 2 inches. A non-circular handrail qualifies as Type I if its perimeter measures between 4 and 6-1/4 inches, with a maximum cross-section dimension of 2-1/4 inches.
- Type II covers larger decorative profiles. A handrail with a perimeter greater than 6-1/4 inches is permitted only if it has a graspable finger-recess area on both sides of the profile.
Flat-top railings and 2×6 lumber caps fail the graspability test. If you cannot wrap your fingers around the profile or hook them into a recess, the rail does not comply. This is one of the most common residential violations inspectors flag.
Load Requirements Guards and Handrails Must Withstand
A guard that looks solid but flexes under weight is worse than no guard, because people lean on it with confidence. The CBC sets three load thresholds:
- The top rail of any guard or handrail must resist a 200-pound concentrated force applied at any point.7UpCodes. California Building Code 2022 Chapter 16 Structural Design – Section 1607.9.1.1
- Guards and handrails must also resist a distributed load of 50 pounds per linear foot along the top rail. One- and two-family homes are exempt from this distributed-load test and only need to pass the 200-pound concentrated load.8UpCodes. California Building Code 2022 Chapter 16 Structural Design – Section 1607.9.1
- Balusters, panel fillers, and other infill components must resist a 50-pound concentrated load applied to any single element.9UpCodes. California Building Code 2022 Chapter 16 Structural Design – Section 1607.9.1.2
Workplaces sit under a separate standard. Cal/OSHA’s Title 8, Section 1620 requires railings and their connections to withstand at least 200 pounds applied at the top edge in any outward or downward direction, with mid-rails handling at least 150 pounds.10Department of Industrial Relations. California Code of Regulations Title 8 Section 1620 – Design and Construction of Railings Those workplace numbers can overlay the CBC requirements on employee work sites.
Stair Dimensions That Affect Your Railing
Where the handrail lands, and whether the guard height works, both depend on the stair itself.
Under the CRC, the maximum riser height for residential stairs is 7-3/4 inches, and the minimum tread depth is 10 inches.11UpCodes. California Residential Code 2022 Chapter 3 Building Planning – Section R311.7.5 Uniformity matters as much as the individual numbers. The largest riser in a flight cannot exceed the smallest by more than 3/8 inch, and the same 3/8-inch tolerance applies to tread depth. Inspectors measure every riser and every tread, not a sample.
Residential stairways need at least 36 inches of clear width above the handrail height. Below handrail height, the clear width narrows to 31-1/2 inches with a handrail on one side, or 27 inches with handrails on both sides. A landing at least 36 inches deep in the direction of travel is required at the top and bottom of every straight-run residential stair.12UpCodes. California Residential Code 2022 Chapter 3 Building Planning – Section R311.7.6
Glass Guards
Glass used in any guard or handrail must be laminated glass made from fully tempered or heat-strengthened panes, complying with CPSC 16 CFR Part 1201 Category II or ANSI Z97.1 Class A safety standards, with a minimum thickness of 1/4 inch.13UpCodes. California Building Code 2022 Chapter 24 Glass and Glazing – Section 2407 The lamination keeps the pieces bonded to an interlayer if the glass breaks. One exception permits single fully tempered glass, without lamination, where no walking surface exists below the guard or where the area below is permanently protected from falling glass.
Glass guards still have to satisfy the 200-pound concentrated load and 50-pound infill component load requirements.14UpCodes. California Building Code 2022 Chapter 24 Glass and Glazing – Section 2407.1.1 Larger panels, high-wind locations, and crowd-loaded areas often need thicker glass to reach those numbers, and engineering calculations or manufacturer test data are usually needed for permit approval.
Residential vs. Commercial: Where the Rules Diverge
The CRC and CBC share the same safety philosophy but diverge in several practical places:
- Both require 42-inch guards, but residential stair guards on the open side can drop to 34 inches from the nosing line. Commercial guards stay at 42 inches everywhere.
- Residential stairs need a handrail on only one side for flights with four or more risers. Commercial stairs and ADA-accessible routes require handrails on both sides.15U.S. Access Board. Guide to the ADA Accessibility Standards – Chapter 5 Stairways
- The CRC does not require handrails to extend beyond the top and bottom risers. ADA-accessible commercial stairways require a horizontal extension of at least 12 inches beyond the top riser, and at the bottom the handrail must continue at the slope of the stair for a distance equal to one tread depth.15U.S. Access Board. - One- and two-family homes only need to meet the 200-pound concentrated load on the top rail. Commercial guards must also resist the 50-pounds-per-linear-foot distributed load.8UpCodes. California Building Code 2022 Chapter 16 Structural Design – Section 1607.9.1
The 4-inch sphere rule, graspability dimensions, and tread-and-riser tolerances hold across both occupancy types. Where the two codes overlap, the commercial standard is almost always the stricter one.
Why a Non-Compliant Railing Is a Legal Problem
A code violation in California is more than a failed inspection. Under California Evidence Code Section 669, violating a statute or regulation creates a rebuttable presumption that the violator failed to exercise due care.16California Legislative Information. California Evidence Code EVID Section 669 If someone falls from a stairway with a non-compliant guard and sues, the property owner is presumed negligent unless they can prove they acted reasonably. That is a hard argument to make when the violation is a measurable dimension like guard height or baluster spacing.
The presumption applies when the violation caused the injury, the injury is the type the code was designed to prevent, and the injured person belongs to the class the code was meant to protect. Stair railing codes exist to prevent fall injuries to building occupants, so all three elements usually line up. Owners sometimes assume that meeting code at the time of original construction is a complete defense, but California courts have held that meeting code minimums does not automatically establish due care. The code sets a floor, not a ceiling.
Permits and Inspections
Most California jurisdictions require a building permit for new stair and railing construction, and many require permits for full railing replacements. A straightforward repair, such as tightening loose balusters or swapping a damaged section for identical material, typically does not trigger a permit. Replacing an entire guardrail system or switching railing types, from wood balusters to cable, for example, almost always does.
Once a permit is issued, expect a framing or rough inspection before finishes go on, and a final inspection when the work is done. Inspectors measure guard height, baluster spacing, and handrail graspability, and sometimes physically test the top rail for load capacity. If the installation fails, you correct the deficiency and schedule a re-inspection. Skipping the permit does not exempt the work from the code. It just means the violation stays hidden until a future sale, remodel, or injury brings it to light.
