Any construction project in California that disturbs one or more acres of soil must obtain coverage under the state’s Construction General Permit and prepare a Stormwater Pollution Prevention Plan before ground is broken. California SWPPP requirements are set by the State Water Resources Control Board and nine Regional Water Quality Control Boards under the federal Clean Water Act and the state’s Porter-Cologne Water Quality Control Act.1California State Water Resources Control Board. When a SWPPP Is Required
The threshold is one acre of soil disturbance. Hit that and you need coverage under the Construction General Permit (Order 2022-0057-DWQ) and a SWPPP in hand before work starts.3State Water Resources Control Board. Order WQ 2022-0057-DWQ
Smaller sites get pulled in when they sit inside a larger common plan of development or sale. A common plan is a contiguous area where separate construction activities happen on different schedules under one overall project. Half an acre inside a 20-acre subdivision counts as part of the 20 acres. Phasing a large project into smaller pieces does not drop you below the threshold.
Industrial operations are a separate track. Facilities in certain Standard Industrial Classification categories — including transportation with vehicle maintenance shops, recycling operations, landfills, some power-generating plants, and wastewater treatment works above a set capacity — need coverage under California’s Industrial General Permit instead.4California State Water Resources Control Board. Risk Levels and What They Demand
Your project’s risk level sets how much monitoring and reporting you owe. The state calculates it from two inputs: sediment risk (soil type, slope, rainfall erosivity) and receiving water risk (sensitivity of nearby waters). Together they produce a Risk Level of 1, 2, or 3.5State Water Resources Control Board. Attachment D.1 – Risk Determination Worksheet
Risk Level 1 is the lightest tier. You run visual inspections before and after qualifying rain events plus quarterly non-stormwater inspections, and you do not need routine water sampling or a Rain Event Action Plan.6California State Water Resources Control Board. Risk Level 2 adds stormwater grab sampling and testing for pH and turbidity, with numeric action levels of pH 6.5 to 8.5 and turbidity 250 NTU.7California State Water Resources Control Board. Attachment D – Risk Level 2 Requirements
Risk Level 3 layers on stricter numeric effluent limitations. Exceeding those limits (pH outside 6.0 to 9.0 or turbidity above 500 NTU) can trigger immediate corrective action and suspended sediment testing, and larger Level 3 projects may face bioassessment monitoring.7California State Water Resources Control Board. The calculation runs automatically when you enter site data into the state’s online permitting system. A site with modest soil and slope can still land in Risk Level 2 because it drains toward a listed impaired water body, so do not assume the tier before the system tells you.
What Goes Into the Plan
The SWPPP has two parts: a detailed site map and a written narrative. The map shows existing topography, drainage paths, nearby water bodies, stormwater entry and exit points, and locations for material storage and vehicle fueling. The narrative describes the construction activities and catalogs every potential pollutant source, from fuel and paint to exposed soil.
From that inventory you select Best Management Practices to control runoff. Common BMPs include silt fences, fiber rolls, stabilized construction entrances, and covered material storage. Risk Level 1 sites focus on housekeeping, erosion controls, and perimeter sediment barriers.6California State Water Resources Control Board. Every plan must be site-specific. Soil, slope, and receiving water sensitivity vary between neighboring parcels, and a plan copied from another project with light edits is one of the fastest ways to draw enforcement attention.
Who Can Prepare and Run the Plan
A Qualified SWPPP Developer, or QSD, must prepare the plan and handle later amendments. California-registered Professional Engineers (Civil) and Professional Geologists or Engineering Geologists can self-register as a QSD through the state’s online system without additional coursework.8California State Water Resources Control Board. The Qualified SWPPP Practitioner, or QSP, handles day-to-day site management: installing BMPs, running inspections, and collecting samples. A QSP does not need a PE license but does need an approved prerequisite, completion of a Trainer of Record course, and at least 70 percent on the QSP exam.9California Stormwater Quality Association. Filing Through SMARTS
All California construction stormwater permits move through SMARTS, the Stormwater Multiple Application and Report Tracking System.10State Water Resources Control Board. California Storm Water Multiple Applications and Report Tracking System The Legally Responsible Person creates an account and uploads the Permit Registration Documents, which include the SWPPP, site map, risk level determination, and a post-construction plan where applicable. Traditional construction sites and linear underground or overhead projects have separate document checklists.8California State Water Resources Control Board. NPDES 2022 Construction Stormwater General Permit The LRP or an authorized representative then electronically certifies a Notice of Intent, and coverage activates only after the annual fee processes.
Once the application clears, the state assigns a Waste Discharger Identification, or WDID, number. Do not begin grading or other land-disturbing work before you receive it.
Annual Fees
Fees are annual and scale with total disturbed acreage. For fiscal year 2025–26, coverage starts at $511 for sites under one acre covered as part of a common plan, and rises by roughly $54 per additional acre. A 10-acre project costs $1,051, a 50-acre project $3,211, and a 100-acre site $5,911.11California State Water Resources Control Board. Inspection Schedule During Construction
The 2022 Construction General Permit sets a demanding inspection cadence. The QSP or a trained delegate must conduct:
- A weekly inspection regardless of weather.
- A pre-storm inspection within 72 hours before a forecasted qualifying precipitation event (one expected to produce at least half an inch in 24 hours), or within 120 hours where extended forecast data is available.
- An inspection at least once every 24 hours during a qualifying precipitation event.
- A post-storm inspection within 96 hours after a qualifying event that produced half an inch or more.
The QSD must inspect the site within 30 days of construction starting and perform twice-annual inspections throughout the project.12Stanford University. 2022 Construction General Permit – FAQ and References When a numeric action level is exceeded, the QSD and QSP must conduct an additional inspection within 14 days. Records are retained for at least three years.6California State Water Resources Control Board. Attachment C – Risk Level 1 Requirements Repairs to a failed or deficient BMP must begin within 72 hours.
A complete copy of the SWPPP must remain on-site and available for immediate review during unannounced inspections. Not having it accessible is itself a citable violation.
Post-Construction Obligations
SWPPP obligations do not stop when the last building goes up. The Construction General Permit requires all dischargers, except linear underground and overhead projects, to implement BMPs that control runoff and pollutants after construction ends.13California State Water Resources Control Board. Projects inside an NPDES Phase I or Phase II municipal stormwater permit area follow that local permit’s post-construction standards instead, and still upload the applicable local requirements and post-construction plans to SMARTS with the Permit Registration Documents.13California State Water Resources Control Board. Closing the Permit
Coverage continues until the Regional Water Quality Control Board approves a Notice of Termination. You can file an NOT when construction is complete and final stabilization is achieved, when the property is transferred, or when site conditions change so the project is no longer subject to the Construction General Permit.14California State Water Resources Control Board. 2022 CGP Notice of Termination Help Guide
The NOT filing requires photographs of the stabilized site, a final site map, documentation of the QSP’s final inspection, and a long-term maintenance plan for any post-construction BMPs. If the Regional Board does not act on the NOT within 30 days of submission, it is automatically approved.14California State Water Resources Control Board. 2022 CGP Notice of Termination Help Guide Until approval, you remain fully subject to the CGP and continue accruing annual fees. Submit the NOT within 90 days of your most recent invoice date and that invoice is canceled upon approval; miss the window and the invoice is due in full.
Penalties for Noncompliance
California Water Code Section 13385 sets mandatory minimum penalties of $3,000 for each serious violation of a waste discharge requirement.2California Legislative Information. California Code, Water Code WAT 13385 A violation is serious when it exceeds an effluent limitation by a specified percentage. The same $3,000 mandatory minimum applies when a person commits four or more of certain violations within any six consecutive months, including violating an effluent limitation, failing to file a required report, or filing an incomplete report. The first three violations in that category do not trigger the mandatory penalty; the fourth and each one after does.
Regional Boards and the State Board can also impose discretionary administrative civil liability that runs well higher. Under the Porter-Cologne Act, a person who discharges waste in violation of a permit can be ordered to clean up the contamination and abate its effects, and failure to comply with a cleanup order can lead the Attorney General to seek a court injunction.15California State Water Resources Control Board.
