California Tax Preparer Requirements: CTEC Course, Bond, and PTIN

To prepare tax returns for pay in California, you need to register with the California Tax Education Council (CTEC) unless you already hold a CPA license, an active California bar card, or an Enrolled Agent designation. Meeting the California tax preparer requirements means finishing a 60-hour qualifying education course, obtaining a $5,000 surety bond, getting a federal PTIN, passing a Live Scan background check, and paying a $102 application fee. After that, you renew every year by October 31 with 20 hours of continuing education.

Who Has To Register

California’s Tax Preparation Act covers anyone who prepares or assists in preparing state or federal returns for someone else in exchange for a fee. It also reaches people who advertise tax preparation services or who sign off on returns someone else drafted.1California Legislative Information. California Code BPC 22251 – Tax Preparers

Four groups don’t need CTEC registration because they answer to their own licensing authority:

  • Certified Public Accountants licensed by the California Board of Accountancy
  • Attorneys who are active members of the California State Bar
  • Enrolled Agents authorized to practice before the IRS
  • Certain banking and trust officials named in the statute

Employees of these professionals are also exempt while working within the scope of their jobs.2California Tax Education Council. Understanding CTEC Exemptions One trap worth flagging: an inactive Enrolled Agent who is physically working in California is not exempt and must register like any other non-credentialed preparer.

What CTEC Requires To Register

If you’re not in an exempt category, five things have to come together before CTEC will issue you a California Registered Tax Preparer (CRTP) number.

60-Hour Qualifying Education Course

You take the course from a CTEC-approved provider and have to finish it within the 18 months before you apply. The hours split into 45 hours of federal tax curriculum, which includes 2 hours of ethics, and 15 hours of California tax curriculum.3California Legislative Information. California Code BPC 22255 – Tax Preparers Finishing the hours isn’t enough on its own. You also pass a final exam with at least 225 federal questions and at least 75 California questions, scoring 70% or higher on each section separately. The provider administers the exam, not CTEC, and some providers allow take-home formats.4California Tax Education Council. CP13A – Qualifying Education Courses

Federal PTIN

Every paid preparer in the country needs a Preparer Tax Identification Number from the IRS, and CTEC will not register you without one. For the renewal cycle that began October 16, 2025, the IRS charges $10 plus an $8.75 third-party contractor fee, for a total of $18.75 per year.5Internal Revenue Service. A past conviction doesn’t automatically disqualify you, but being currently incarcerated generally does.6Taxpayer Advocate Service. Getting a PTIN

$5,000 Surety Bond

You must carry a surety bond with a minimum face value of $5,000, issued by a company authorized to do business in California. The bond gives clients a way to recover money if the preparer commits fraud or dishonesty, and you have to show proof of it both at initial registration and at every renewal.3California Legislative Information. California Code BPC 22255 – Tax Preparers The annual premium you actually pay a surety company is far smaller than the face value, typically around $25 to $100 for an applicant with a clean record. Credit problems or prior claims push the premium up. If the bond lapses, your registration goes out of compliance.

Live Scan Background Check

New applicants pass a background check through California’s Live Scan fingerprinting system. You schedule an appointment at a Live Scan location, and the forms you need are available through your CTEC online account once you start the application.7California Tax Education Council. $102 Application Fee

The initial CTEC application costs $100 plus a $2 processing fee. It’s nonrefundable.8Franchise Tax Board. Registered Tax Preparers Once CTEC verifies your education, bond, PTIN, and background check, you’re issued a CRTP number and can legally prepare returns for compensation.

Renewing Every Year

Your registration runs on a November 1 to October 31 cycle. To stay current you pay a $33 registration fee plus a $2 processing fee each year by October 31.8Franchise Tax Board. Registered Tax Preparers That $35 is separate from your PTIN renewal and your surety bond premium, both of which also have to stay active.

Renewal also requires 20 hours of continuing education from a CTEC-approved provider, split like this:3California Legislative Information. California Code BPC 22255 – Tax Preparers

  • 10 hours of federal tax law
  • 3 hours of federal tax law updates
  • 2 hours of ethics
  • 5 hours of California tax law

The deadline matters because the penalty structure is unusually harsh. From November 1 through January 15, you can still renew late, but CTEC adds a $55 late fee on top of the standard $35, making the total $90.9California Tax Education Council. Late Renewals Reminder Miss January 15 and your registration expires. CTEC then treats you as a brand-new applicant: full 60-hour qualifying course again, another background check, and the $102 new applicant fee.10California Tax Education Council. Penalties for Preparing Without Registration

Preparing returns for compensation in California without valid CTEC registration or an exempt credential is enforced by the Franchise Tax Board. The first failure to register carries a $2,500 penalty. Each subsequent violation is $5,000.11California Tax Education Council. Enforcement

There’s one safety valve. If you can show the FTB proof of a valid credential within 90 days of the penalty notice being mailed, the penalty may be waived. That path helps someone who actually holds a credential and simply failed to register, not someone who was never qualified in the first place.

Shortcut for Former CPAs, Attorneys, and Enrolled Agents

If you held a CPA license, bar membership, or EA credential that lapsed within the past two years, you can petition CTEC to count your experience in lieu of the 60-hour course, provided you prepared at least 100 tax returns during the two years before you apply.3California Legislative Information. California Code BPC 22255 – Tax Preparers The same pathway is open to professionals who were licensed in another state and have moved to California. If you qualify under this route, you still have to complete a 15-hour California-specific qualifying course, because your prior experience wouldn’t have covered California tax law.12California Tax Education Council. TP04 – Experience In Lieu Of Education The bond, PTIN, background check, and fee all still apply.

Federal Rules That Apply on Top

CTEC registration isn’t the whole picture. Federal law treats tax preparation firms as financial institutions under the FTC’s Safeguards Rule, which requires every preparer to maintain a written information security plan. The plan has to cover a designated security coordinator, a written risk assessment, encryption of client data in storage and in transit, multi-factor authentication, staff training, oversight of service providers, and a written incident response plan for breaches.13Federal Trade Commission. FTC Safeguards Rule – What Your Business Needs to Know A solo preparer working from a home office is subject to the same rule as a large firm, though the plan can be scaled to the size of the practice. The IRS reinforces these obligations in Publication 4557.

The IRS also imposes its own penalties on paid preparers whose returns contain unreasonable positions or willful understatements of tax, and those penalties apply regardless of whether you’re CTEC-registered.14Internal Revenue Service. Tax Preparer Penalties

One Thing To Watch: The 2028 Sunset

California’s Tax Preparation Act has a built-in expiration date. The current version is scheduled to be repealed on January 1, 2028, unless the legislature extends it.15California Legislative Information. California Code BPC 22250 – Tax Preparation Act The legislature has renewed the Act multiple times before, so an extension is likely, but anyone building a long-term tax preparation practice should keep an eye on the renewal legislation as 2028 gets closer.
