California’s vape ban prohibits the retail sale of all flavored vaping products, including menthol and mint, under Health and Safety Code Section 104559.5.1California Department of Public Health. California Prohibits Retailers from Selling Flavored Tobacco Products Unflavored and tobacco-flavored e-cigarettes remain legal for adults 21 and over, and personal possession or use of a flavored product is not a crime. The ban hits the supply side: no retailer, wholesaler, distributor, or online seller operating in California can legally sell you a flavored vape.2California Department of Public Health. What the Ban Prohibits
The prohibition took effect December 21, 2022, after California voters upheld SB 793 at a November 2022 referendum. Two 2024 bills, AB 3218 and SB 1230, strengthened the law as of January 1, 2025. The amendments expanded “nicotine” to cover synthetic nicotine and nicotine analogs, closing a loophole some manufacturers had used by substituting lab-made nicotine for tobacco-derived nicotine.3California Legislative Information. California Health and Safety Code HSC 104559-5
The ban reaches retail sales, offers for sale, and possession with intent to sell. It binds brick-and-mortar stores, online sellers shipping into California, wholesalers, and distributors.1California Department of Public Health. California Prohibits Retailers from Selling Flavored Tobacco Products A shop cannot stock flavored vapes even if the sale is completed online.
How “Flavored” Is Defined
A “characterizing flavor” is any taste or smell other than tobacco that an ordinary consumer can notice before or during use. The statute lists fruit, chocolate, vanilla, honey, candy, cocoa, dessert, alcoholic beverage, menthol, mint, wintergreen, herb, and spice as examples, and the list is not exhaustive.3California Legislative Information. California Health and Safety Code HSC 104559-5 Any non-tobacco flavor a typical consumer can perceive triggers the ban.
Menthol and mint get specific treatment. The law also prohibits any product designed to create a cooling sensation, even one that does not contain menthol. An e-liquid engineered to feel cool in the throat still falls under the ban.2California Department of Public Health. Frequently Asked Questions: California’s Flavored Tobacco Products Retail Law
“Flavor enhancers” are banned too. Any product sold to add a flavor to an otherwise unflavored tobacco product (a drip, capsule, or additive) is just as illegal as a pre-flavored vape.3California Legislative Information. California Health and Safety Code HSC 104559-5
Nicotine content doesn’t change the analysis for vapes. Flavored e-cigarettes are prohibited whether or not they contain nicotine, so a flavored nicotine-free vape is banned from retail sale just the same.2California Department of Public Health. What You Can Still Legally Buy
Unflavored and tobacco-flavored vaping products remain legal for sale to customers 21 and older. Tobacco flavor is outside the ban because the statute reaches only tastes or smells other than tobacco.
The law carves out three narrow exemptions, none of which apply to vapes:
- Flavored loose-leaf pipe tobacco sold for pipe smoking, but not roll-your-own tobacco or anything packaged to suggest cigarette use.3California Legislative Information. California Health and Safety Code HSC 104559-5
- Flavored premium cigars that are handmade, wrapped entirely in whole tobacco leaf, hand-capped, free of any filter or non-tobacco mouthpiece, and priced at a wholesale minimum of $12. Every criterion must be met.3California Legislative Information. California Health and Safety Code HSC 104559-5
- Flavored shisha (hookah tobacco), sold only by a licensed hookah tobacco retailer that bars anyone under 21 from entering the premises at any time.2California Department of Public Health. Frequently Asked Questions: California’s Flavored Tobacco Products Retail Law
Personal Use and Possession
Buying, using, or possessing a flavored tobacco product for your own consumption is not a crime under state law. You may also give a flavored product to another consumer who is 21 or older.4California Department of Public Health. Frequently Asked Questions: California’s Flavored Tobacco Sales Law The penalty structure reaches sellers, employees, wholesalers, distributors, and online sellers, not personal consumers.2California Department of Public Health. The practical catch is sourcing. No California retailer can sell flavored products to you, and online sellers shipping into the state are bound by the same prohibition. Buying flavored vapes in another state for personal use and bringing them home is not restricted by Section 104559.5, which targets sales rather than possession. But the legal pipeline inside California is closed.
Online Orders Shipped Into California
Even for tobacco products that are legal to sell, delivery into California requires a two-step age check under Business and Professions Code Section 22963. The seller must first verify the buyer’s name, address, and date of birth against a commercial database that confirms the buyer is 21 or older. If that fails, the seller must obtain a signed age statement plus a copy of a valid government-issued ID (driver’s license, passport, or military ID).5California Legislative Information. The package has to be clearly labeled as containing tobacco products. The carrier must get a signature from someone 21 or older at delivery and verify that person’s age with a photo ID. Payment must be by personal check or credit card; cash and money orders are not accepted.5California Legislative Information. California Business and Professions Code BPC 22963 These rules apply to all tobacco products shipped to California consumers, not just flavored ones.
Age Requirement
The minimum purchase age for any tobacco or vaping product in California is 21. California set that age in 2016, and federal law raised the nationwide minimum to 21 in December 2019, eliminating the earlier state-law exemption for active-duty military ages 18 through 20.6California Department of Public Health. California Tobacco 21 Law There is no military exception today.
Local Rules Can Go Further
State law sets a floor. Cities and counties can impose stricter tobacco rules, and many have.1California Department of Public Health. California Prohibits Retailers from Selling Flavored Tobacco Products At least 20 California jurisdictions, including Los Angeles County, San Francisco, Sacramento, and Santa Cruz, have adopted full flavor bans with no premium-cigar, pipe-tobacco, or hookah exemptions. Some ordinances restrict tobacco sales near schools or cap the number of retail licenses. When state and local rules differ, the stricter rule controls, so a retailer in a city that eliminated the hookah exemption cannot sell flavored shisha even though state law would allow it.
Federal Rules Stacked on Top
Two federal layers sit above the state ban and matter even for products California permits.
First, shipping. The Preventing Online Sales of E-Cigarettes to Children Act, signed in December 2020, added vaping products to the federal mailing ban that already covered cigarettes and smokeless tobacco. The U.S. Postal Service will not ship vapes, e-liquids, or any electronic nicotine delivery system, with narrow exceptions for business-to-business shipments between licensed entities.7Office of the Law Revision Counsel. 18 U.S. Code 1716E – Tobacco Products as Nonmailable UPS and FedEx adopted similar restrictions voluntarily. Online sellers using permitted carriers must register with the ATF and with every state they ship into under the federal PACT Act, label packages as containing tobacco, and verify customer age before shipping.8Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Vapes and E-Cigarettes
Second, FDA authorization. Every vaping product sold anywhere in the United States must receive FDA premarket authorization. As of March 2026, only 41 e-cigarette products have been authorized, all tobacco-flavored or menthol, from a handful of manufacturers including NJOY, Vuse, JUUL, and Logic.9U.S. Food and Drug Administration. E-Cigarettes, Vapes and Other Electronic Nicotine Delivery Systems (ENDS) Authorized by the FDA Most products on the market, including popular disposable brands, are being sold in violation of federal law regardless of how California treats them. The FDA has escalated enforcement against unauthorized products and can seek civil penalties up to $21,903 per violation.10U.S. Food and Drug Administration. What Retailers Face for Selling Flavored Products
California civil penalties for retailers caught selling flavored tobacco products scale with repeat violations under the STAKE Act: $1,000 to $1,500 for a first violation, $2,000 to $3,000 for a second within five years, $5,000 to $10,000 for a third, $10,000 to $20,000 for a fourth, and at least $20,000 for a fifth. A separate $50 penalty applies to each seized package of flavored product. A second offense at the same location can trigger license suspension, and a third can mean revocation.1California Department of Public Health.
