California vape laws treat electronic cigarettes the same as traditional tobacco: you have to be 21 to buy them, flavored products are banned at retail, vaping is prohibited in most indoor and many outdoor spaces, and the state adds a 54.27% wholesale excise tax on top of regular sales tax. Federal rules from the FDA and the PACT Act layer on top of all of that, which is why online shipping has become nearly impossible and many popular disposable brands are technically illegal to sell even when a store has a California license.
How Old You Have to Be
You must be at least 21 to buy, receive, or possess any tobacco or vapor product in California. The state age matches the federal minimum Congress set in December 2019.1U.S. Food and Drug Administration. Expect to show ID even if you look well over 21. California requires retailers to check anyone who reasonably appears to be under 21, and since September 2024 the FDA has required a photo ID check for anyone who appears under 30.1U.S. Food and Drug Administration. Tobacco 21 Retailers follow the stricter federal threshold in practice.
The Flavor Ban
California prohibits the retail sale of any tobacco product with a flavor other than tobacco itself. That includes e-liquids, cartridges, and disposable vapes in any mint, menthol, fruit, candy, dessert, chocolate, vanilla, honey, wintergreen, herb, spice, or alcoholic-beverage flavor. A product counts as flavored if it has any distinguishable taste or aroma beyond tobacco, nicotine or not.3California Legislative Information. California Senate Bill 793 – Flavored Tobacco Products
As of January 2025, Assembly Bill 3218 tightened the system further. The Attorney General now maintains an Unflavored Tobacco List, and only products on that list can legally be sold in California. Retailers caught selling anything off-list face seizure of the product and civil penalties.4State of California – Department of Justice – Office of the Attorney General. Unflavored Tobacco List Regulations
Important for buyers: the ban targets the seller, not you. Personal possession or use of a flavored vape is not a crime in California. The practical effect is that flavored products have disappeared from licensed stores, not that you can be ticketed for carrying one.
What’s Exempt
Three narrow categories escape the flavor ban, and none of them are vapes:5California State Assembly. Senate Bill 793 Chapter 34
- Loose-leaf pipe tobacco, as long as it isn’t packaged for rolling cigarettes.
- Premium handmade cigars with a whole-leaf tobacco wrapper and a wholesale price of at least $12, with no filter or non-tobacco mouthpiece.
- Shisha sold by licensed hookah retailers that restrict entry to people 21 and older.
Where You Can and Can’t Vape
California’s definition of “smoking” includes using any electronic device that creates an aerosol or vapor, which pulls vaping into every existing smoke-free law.6California Legislative Information. SBX2-5 Electronic Cigarettes That matters in several specific places.
Workplaces. No employer may allow vaping in any enclosed place of employment, including lobbies, stairwells, elevators, restrooms, and covered parking structures.7California Legislative Information. California Code LAB 6404.5 Private residences are generally exempt, with an exception for licensed family day care homes during operating hours when children are present.8Department of Industrial Relations. California Workplace Smoking Restrictions
Public buildings. Vaping is prohibited inside, and within 20 feet of any main exit, entrance, or operable window. State-owned passenger vehicles are also off limits.9California Legislative Information. California Code GOV 7597
Parks and youth areas. Vaping is banned within 25 feet of any playground or tot lot sandbox, and within 250 feet of a youth sports event in the same park or facility. The fine is $250 per violation.10California Legislative Information. California Code Health and Safety Code HSC 104495 State beaches, state parks, and public transportation are also covered.
Cars with minors. It’s illegal to vape in any motor vehicle, moving or parked, if a minor is in the vehicle. The infraction carries a fine of up to $100.11California Legislative Information. California Code Health and Safety Code HSC 118948
Local rules. State law explicitly allows cities and counties to go further, and many have. Local ordinances often ban vaping in outdoor dining areas, multi-unit housing common areas, or near building entrances beyond the state’s 20-foot setback.9California Legislative Information. Buying Online or by Mail
Online purchasing has become extremely difficult for California consumers. In 2020, Congress amended the PACT Act so that “cigarette” includes electronic nicotine delivery systems, which covers e-cigarettes, vape pens, e-hookahs, refillable vaporizers, and their components, liquids, and accessories.12Office of the Law Revision Counsel. 15 U.S. Code 375 – Definitions The amendment made vapor products nonmailable through the United States Postal Service.13Office of the Law Revision Counsel. 18 U.S. Code 1716E – Tobacco Products as Nonmailable UPS and FedEx have also adopted policies refusing to carry them.
A seller using any remaining shipping method still has to comply with PACT Act delivery requirements: verify the buyer’s age before the sale, label the package properly, and get an adult signature on delivery.14Bureau of Alcohol, Tobacco, Firearms and Explosives. Prevent All Cigarette Trafficking (PACT) Act Most legitimate retailers have simply stopped offering direct-to-consumer shipping.
What Vapes Cost in Tax
California classifies vapes as “other tobacco products” and taxes them based on the distributor’s wholesale cost. The rate adjusts each year. From July 1, 2025 through June 30, 2026, the rate is 54.27% of wholesale cost.15California Department of Tax and Fee Administration. New Tobacco Products Tax Rate Effective July 1, 2025 Distributors pay the tax at the first point of distribution.16California Department of Tax and Fee Administration. You won’t see it broken out on your receipt because it’s baked into the price before the product reaches the shelf, but it meaningfully raises the final cost. Standard state and local sales taxes still apply on top at checkout.
If You Sell Vapes: Licensing and Federal Authorization
Any business selling tobacco or vapor products in California needs a Cigarette and Tobacco Products Retailer’s License from the California Department of Tax and Fee Administration, renewed annually. The license covers cigarettes, vape devices, e-liquids, and any component or accessory. Selling without one can bring civil or criminal citations, fines, and seizure.17California Department of Tax and Fee Administration. California Cigarette and Tobacco Products Licensing Act of 2003
Penalties for selling flavored products not on the Unflavored Tobacco List escalate quickly: $50 per seized package for a first violation, the same per-package fine plus license suspension for a second, and the fine plus revocation for a third.
Underage sale penalties under the STAKE Act start at $1,000 to $1,500 for a first offense and climb to at least $20,000 for a fifth violation within five years. A third violation at the same location within five years brings a 45-day license suspension; a fourth, 90 days; a fifth, revocation.18California Department of Tax and Fee Administration. Cigarette and Tobacco Products Licensing Act – Section 22958
A California license is not the whole story. Every new tobacco product, including every e-cigarette and vape device, needs a marketing granted order from the FDA before it can be legally marketed in the United States. The usual pathway is a Premarket Tobacco Product Application.19U.S. Food and Drug Administration. Premarket Tobacco Product Marketing Granted Orders Most products on shelves today don’t have one. Products sold without authorization are considered adulterated and misbranded under federal law, and a pending application is not a safe harbor.20U.S. Food and Drug Administration. Advisory and Enforcement Actions Against Industry for Unauthorized Tobacco Products FDA enforcement usually starts with a warning letter and a 15-working-day response window, and can escalate to civil money penalties, seizure, or injunctive relief.
Throwing Away Used Devices
Used vapes don’t belong in household trash. E-liquids containing nicotine are classified as acute hazardous waste under the federal Resource Conservation and Recovery Act, and the lithium-ion batteries inside most devices qualify as characteristic hazardous waste because of their toxicity and flammability. That applies whether the product has been used or is still sealed.
Most California counties operate household hazardous waste collection programs that accept vape products at no charge. Contact your local Certified Unified Program Agency to find the drop-off nearest you.
