California Vehicle Code 21113 governs who may drive, stop, or park on the grounds, driveways, paths, and parking lots of publicly owned and certain tax-exempt properties, including school and college campuses, hospitals, state and county parks, airports, transit facilities, and housing authority property. The default rule is a prohibition: you cannot drive or leave a vehicle on these properties unless the governing body in charge has given permission. Once that body opens the property to public traffic, every provision of the Vehicle Code that applies on a highway applies there too, subject to whatever local rules the governing body has adopted.1California Legislative Information. Where the Law Applies
Section 21113 covers a wider range of property than most drivers realize. The statute reaches public schools, state universities and colleges, and any educational institution that is wholly or partially exempt from taxation, which pulls private tax-exempt colleges in alongside public ones. It also covers units of the state park system and county parks, municipal airports, rapid transit districts, transit development boards, public transportation agencies, county transportation commissions, and joint powers agencies operating commuter rail. State, county, and hospital district institutions and buildings fall under it, as does property under the direct control of a municipal legislative body. Harbor improvement districts, harbor districts, highway districts organized under Part 3 of Division 16 of the Streets and Highways Code, housing authority property, and state grounds served by the California Highway Patrol are all included.1California Legislative Information. The practical consequence is that a parking ticket from a private college with tax-exempt status carries the same legal weight as one from a state university. A citation at a transit station parking lot is enforced the same way as one issued on a public street.
What the Governing Body Can Require, and What It Must Post
When a governing body opens its property to public traffic, it can attach whatever conditions it considers appropriate: lower speed limits, parking time restrictions, permit-only zones, loading areas, bans on through traffic, and so on. Those local rules sit on top of the Vehicle Code, not in place of it. If a campus posts a 15 mph limit, that number controls, but stop signs, fire-lane rules, disabled parking requirements, and standard right-of-way laws still apply automatically.1California Legislative Information. Two notice requirements are mandatory, and both matter if you’re contesting a ticket. The governing body must erect appropriate signs giving notice of any special condition or regulation it has imposed. It must also prepare a written statement listing every special condition and regulation adopted and keep that statement available for public examination at its principal administrative office.1California Legislative Information. The statute uses “shall” for both. If you were cited for a restriction that was not actually signed where you parked, the missing sign is a legitimate basis for challenging the citation. If you ask to see the written statement of adopted rules and the agency cannot produce one, that undercuts enforceability as well. Make those requests early in the dispute process.
Penalties, Fines, and Towing
Parking violations on 21113 properties are handled as civil penalties through the same administrative system that processes street parking tickets. The registered owner and the driver are jointly liable, so the agency can collect from either.2California Legislative Information. California Code Vehicle Code 40200
Fine amounts are set by each governing body, so a university parking fine will not necessarily match a transit district fine or a county hospital fine. Routine parking violations commonly run from around $50 to $100, depending on the agency. Disabled parking violations are far steeper; one major California city sets the fine for parking in a disabled space without a valid placard at $451.
Moving violations committed on these properties are prosecuted as standard Vehicle Code infractions. The base fine runs up to $100 for a first offense, up to $200 for a second infraction within one year, and up to $250 for a third or subsequent infraction within a year, before state and county surcharges, which typically multiply the amount you actually pay.3California Legislative Information. Vehicles can also be towed. Peace officers and salaried parking enforcement employees have the same removal authority on 21113 properties that they have on public streets, so a vehicle blocking a fire hydrant, blocking a driveway, or creating a traffic hazard can be hauled off. A separate rule hits repeat offenders: a vehicle with five or more unpaid citations where the owner has not responded within 21 calendar days of issuance, or within 14 days after a delinquent notice was mailed, can be impounded. Recovering it requires proof of identity, a California address, and evidence that every outstanding parking penalty and traffic violation tied to you and your registered vehicles has been cleared.4California Legislative Information. How to Contest a Citation
California gives you a three-stage process, and each stage has to be completed before you can move to the next.
Initial Review
You have 21 calendar days from the date the citation was issued to request an initial review from the issuing agency. If you are responding to a delinquent notice instead, the window shrinks to 14 calendar days from the date that notice was mailed. The request can be made by phone, in writing, or in person, and the agency cannot charge a fee. If the agency finds the violation did not occur or that dismissal is otherwise appropriate, it cancels the citation.5California Legislative Information. California Code Vehicle Code 40215
Administrative Hearing
If the initial review goes against you, you have 21 calendar days from the mailing of the results to request an administrative hearing. You must deposit the full penalty amount with the processing agency before the hearing is held. Agencies are required to have a procedure that lets people who qualify as indigent request a hearing without paying first.5California Legislative Information. California Code Vehicle Code 40215
The hearing must be held within 90 calendar days of your request. You can take it by mail, in person, or by phone or electronic means if the agency offers those formats, and you are entitled to one continuance of up to 21 days. The officer who wrote the citation does not have to attend. If the examiner rules in your favor, the deposited penalty is refunded.5California Legislative Information. Court Appeal
If the administrative hearing goes against you, you have 30 calendar days from the mailing or personal delivery of the final decision to file an appeal in superior court. The court hears the case fresh, with the processing agency’s file admitted into evidence. You pay a filing fee, but if you win, the agency reimburses the fee along with any deposited penalty. If you let the 30 days pass without filing, the administrative decision is final.6California Legislative Information. California Code VEH 40230
What Happens If You Ignore the Ticket
Unpaid citations from 21113 properties move onto your DMV record. The agency can file your unpaid penalties with the Department of Motor Vehicles, which blocks registration renewal for any vehicle you own until every outstanding violation is paid or released.7California Department of Motor Vehicles. Vehicle Industry Registration Procedures Manual – Parking/Toll Violations on Record
If your unpaid penalties and fees top $400, the processing agency can file proof with the court and convert the amount into a civil judgment, collectible through the usual tools, including wage garnishment and bank levies. Before filing with the DMV, agencies must offer installment payment plans to people who qualify as indigent, with monthly payments capped at $25 for totals of $500 or less and late fees limited to $5.8California Legislative Information. Add in the impound exposure that kicks in at five unresolved citations, and the cost of ignoring a ticket climbs quickly past the cost of either paying it or using the review process to challenge it.
