A California red light ticket typically costs between $490 and $550 once state and county assessments are added to the roughly $100 base fine, and it puts one point on your driving record for 36 months. You can usually keep that point hidden from your insurer by completing traffic school, and depending on the facts, you may have grounds to contest the ticket entirely.1Judicial Branch of California. What You’ll Actually Pay
The base fine is about $100, but that figure is almost meaningless on its own. California stacks a long list of penalty assessments on top: a state penalty assessment of $10 for every $10 of base fine, a state court construction penalty, a DNA identification fund penalty, a county penalty, a 20-percent state surcharge, a court operations assessment, and a criminal conviction assessment. Added together, the total you owe generally falls between $490 and $550.1Judicial Branch of California. Uniform Bail and Penalty Schedules The exact figure varies by county because some add their own local assessments.
If you qualify for traffic school and choose it, add another $20 to $50 for the course plus a court administrative fee in many jurisdictions. Traffic school doesn’t reduce the fine. It only addresses the point.
The Point on Your Record
A red light conviction adds one point to your California driving record, and that point remains visible for three years.2State of California Department of Motor Vehicles. Section 7: Laws and Rules of the Road (Continued) – Section: Points on Your Driver’s Record Two things happen because of it.
Insurance carriers pull your record at renewal and can raise your premium based on violations within the past three to five years. One ticket won’t wreck your rates, but it won’t help, and it stacks with anything else on the record.
The DMV also runs a negligent-operator system that counts points over rolling windows. Four points in 12 months, six in 24 months, or eight in 36 months results in a one-year probation period that includes a six-month license suspension.3State of California Department of Motor Vehicles. Negligent Operator Actions A single red light ticket won’t take you there alone, but combined with a prior speeding ticket or at-fault accident, it can.
Traffic School Keeps the Point Hidden
Completing a state-approved traffic school course keeps the point from appearing on the record insurers see. That’s the real benefit. The violation is still on file at the court, but your insurer won’t be able to use it against you.4Judicial Branch of California. Traffic School
You need a valid driver’s license, the ticket must be for a non-commercial vehicle, and you can’t have attended traffic school for another violation in the past 18 months.4Judicial Branch of California. Traffic School The judge has discretion to grant or deny the option, but most first-time offenders with a clean recent history are approved. DMV-approved online courses generally run $20 to $50 depending on the provider and how quickly you want your completion certificate processed.
You still owe the full fine. Traffic school is an added cost, not a substitute.
When Running a Red Is Actually a Violation
California Vehicle Code 21453 governs red signals. On a solid circular red, you must stop at the limit line. If there’s no limit line, stop before the crosswalk on your side. If there’s no crosswalk either, stop before entering the intersection, and stay stopped until the light turns green.5California Legislative Information. California Vehicle Code VEH 21453
A solid red arrow is different. You cannot enter the intersection to make the movement the arrow controls. There is no right-turn exception for a red arrow.
Right turns on a steady circular red are legal after a complete stop, provided no sign at the intersection prohibits it and you yield to pedestrians and to any vehicle close enough to be an immediate hazard.5California Legislative Information. California Vehicle Code VEH 21453 Left turns on red are legal only when you’re turning from a one-way street onto another one-way street. If either street carries traffic in both directions, a left on red is a violation.
Red Light Camera Tickets
Several California cities use automated enforcement cameras that pair high-speed digital cameras with radar or video detection. When a violation is captured, the system records photographs of the vehicle and license plate along with a short video.6SFMTA. Red Light Camera and Other Automated Enforcement
Camera citations go to the registered owner, who may or may not be the driver. The ticket must be mailed within 15 days of the violation. If someone else was driving your vehicle, contact the issuing law enforcement agency before the due date on the ticket so the citation can be transferred to the actual driver. Paying it yourself when you weren’t driving puts the point on your record instead of theirs.7Sacramento Superior Court. Red Light Camera Citations – Section: About Red Light Camera Citations
The citation must explain how to view the photo and video evidence, by phone and in person, through the issuing agency.8California Legislative Information. California Vehicle Code VEH 40518 Review it before deciding what to do. Camera angle, timestamp, and image clarity all matter if you contest.
Fighting the Ticket
You have two routes.
Trial by Written Declaration
You post the full bail amount, then submit a written statement laying out your defense. The citing officer submits a written statement in response, and a judicial officer reviews both along with any evidence.9Los Angeles Superior Court. What Is a Trial by Written Declaration If you lose, you can request a new trial in person, so you effectively get two chances at the case. If you win, the bail is refunded. You never set foot in court.
In-Court Trial
You plead not guilty and get a trial date. The citing officer must appear and testify. For camera tickets, a representative who can authenticate the camera system typically appears. If the prosecution can’t produce sufficient evidence, the case is dismissed. This takes more time but lets you cross-examine directly.
Defenses That Can Work
Success depends on the facts and the evidence you can bring.
The Signal Malfunctioned
If the signal was dark, flashing, or displaying conflicting indications, California treats the intersection as an all-way stop. Running through without stopping is still a violation, but stopping and proceeding cautiously is not. You’ll need proof: dashcam footage, witnesses, or a city maintenance log showing the signal was reported out of service.
You Were Avoiding Imminent Harm
If you had to proceed to avoid an immediate danger, such as a vehicle behind you that couldn’t stop, the necessity defense can apply. Courts weigh whether the danger was genuinely imminent and whether a safer alternative existed. Judges set a high bar for this one.
You Were Yielding to an Emergency Vehicle
California law requires you to pull right and stop when an emergency vehicle approaches with lights and siren.10California Legislative Information. California Vehicle Code VEH 21806 If that duty pushed you into an intersection against a red, courts generally recognize that complying with one law shouldn’t trigger punishment under another. Document the time, location, which emergency vehicle was involved, and any dashcam footage you have.
Short Yellow Interval
Federal guidelines call for yellow change intervals between three and six seconds, longer at higher-speed approaches. If the yellow at your intersection was unusually short for the posted speed, that can anchor a defense, but you’ll need engineering data or expert testimony. Some attorneys request signal timing records from the local traffic engineering department as part of their preparation.
Don’t Ignore the Ticket
This is where a manageable fine turns into real trouble. Failing to appear or pay by the due date is a separate misdemeanor under California Vehicle Code 40508, independent of the red light charge itself.11California Legislative Information. California Vehicle Code VEH 40508 An infraction can become a criminal charge on your record.
On top of that, the court can add a $300 civil assessment, and your license can be suspended once the DMV receives notice of the failure to appear. A roughly $500 fine can become an $800-plus debt with a suspended license and a misdemeanor attached. If you can’t pay by the due date, contact the court before that date to ask about a payment plan or extension.
If You Hold a CDL
A standard red light ticket by itself is not on the federal list of serious traffic violations for commercial drivers. It becomes a serious violation if it arises in connection with a fatal accident. A second serious violation within three years results in a 60-day CDL disqualification; a third triggers 120 days.12eCFR. 49 CFR 383.51 – Disqualification of Drivers The DMV point still counts under California’s negligent-operator system, and employers who pull your record will see it. For a professional driver, traffic school is almost always worth the cost when eligible.
If You’re Licensed Out of State
California participates in the Driver License Compact, under which member states share conviction information. Your home state will typically treat the California violation as if it happened locally and apply its own point system.13National Center for Interstate Compacts. Driver License Compact Ignoring a California ticket because you live elsewhere is a particularly bad move; a failure-to-appear notice can block your home-state license renewal.
