Can I Bring My Gun From PA to NY? Permits, Bans, Penalties

Bringing a gun from Pennsylvania to New York is not something you can legally do with a handgun unless you first obtain a New York handgun license. New York does not recognize any out-of-state firearm permits, so a Pennsylvania License to Carry Firearms gives you no legal protection the moment you cross the state line. Possessing a loaded handgun without a New York license is a violent felony carrying a mandatory minimum of three and a half years in state prison. Long guns face fewer licensing hurdles outside New York City, but New York bans many semi-automatic rifles that Pennsylvanians own legally, and the five boroughs require their own permit for rifles and shotguns too.

Your Pennsylvania Carry Permit Does Nothing in New York

New York requires a state-issued license to possess any pistol or revolver, with no exception for visitors, travelers passing through, or holders of permits from other states.1Gun Safety in New York State. Frequently Asked Questions – New Concealed Carry Law There is no reciprocity agreement with Pennsylvania, no temporary visitor exception, and no grace period for people driving across the border. If you are caught with a handgun in New York without a New York license, you face felony charges no matter how many other states honor your PA permit.

Non-residents can apply for a New York handgun license. State law does not require residency or in-state employment, and licensing officers may accept applications from non-residents under the same standards applied to everyone else.1Gun Safety in New York State. Frequently Asked Questions – New Concealed Carry Law The process is demanding. You must be at least 21, provide four character references, complete a state-approved firearms training course, sit for an in-person interview with the licensing officer, and pass an extensive background check.2New York State Senate. New York Penal Law 400.00 – Licenses to Carry, Possess, Repair and Dispose of Firearms Processing times routinely stretch to many months. New York City has a separate formal pathway for non-resident concealed carry applications through the NYPD.3NYC Rules. Emergency Rule – Concealed Carry License Rules for Non New York Residents

Rifles and Shotguns Follow Different Rules

Outside New York City, non-residents can generally possess rifles and shotguns without a New York license, because the state licensing requirement under Penal Law 400.00 applies specifically to pistols and revolvers.2New York State Senate. New York Penal Law 400.00 – Licenses to Carry, Possess, Repair and Dispose of Firearms That is not permission to bring anything you own. Every other state restriction still applies, including the assault weapon ban and magazine limits below. A rifle that is perfectly legal in Pennsylvania can be classified as an assault weapon in New York, turning lawful possession into a felony at the border.

New York City is its own situation. Within the five boroughs, it is unlawful to possess any firearm, including rifles and shotguns, without a permit issued by the NYPD.4NYC.gov. NYC Police Department Rifle/Shotgun Permit Application The application requires a valid NYC address, fingerprinting, and fees. A firearm license issued elsewhere in New York State is not valid in NYC unless the police commissioner validates it.

Firearms, Features, and Magazines That Are Illegal Regardless of License

New York’s SAFE Act bans firearms the state classifies as assault weapons. For semi-automatic rifles, the definition is broad enough to catch many popular models sold freely in Pennsylvania. A semi-automatic rifle qualifies as an assault weapon if it can accept a detachable magazine and has even one of the following features:5New York State Senate. New York Penal Law 265.00 – Definitions

  • A pistol grip that protrudes conspicuously beneath the action
  • A telescoping or folding stock
  • A thumbhole stock
  • A second handgrip or protruding grip for the non-trigger hand
  • A bayonet mount
  • A flash suppressor, muzzle brake, muzzle compensator, or a threaded barrel designed for any of these
  • A grenade launcher

One feature is enough. A standard AR-15-style rifle with a detachable magazine and a pistol grip, ordinary in Pennsylvania, meets New York’s assault weapon definition. Semi-automatic pistols and shotguns have their own separate feature tests under the same statute.5New York State Senate. New York Penal Law 265.00 – Definitions

Firearm silencers are completely prohibited. Possessing one is criminal possession of a weapon in the third degree, a Class D felony, even if the suppressor is registered with the ATF and legal under federal law and Pennsylvania law.6New York State Senate. New York also prohibits magazines capable of holding more than ten rounds, regardless of when or where you bought them.7Gun Safety in New York State. Resources for Gun Owners A standard 15- or 30-round magazine that came with your rifle or pistol in Pennsylvania is illegal to bring into New York. The state has a separate restriction on loading more than seven rounds into a magazine, which has faced legal challenges.8New York State Senate. Driving Through New York to Somewhere Else

If you are driving through New York on the way to another state, federal law offers limited protection. The Firearm Owners Protection Act contains a safe-passage provision that shields you from state prosecution while transporting firearms between two places where you can legally possess them.9Office of the Law Revision Counsel. 18 U.S. Code 926A – Interstate Transportation of Firearms Every condition has to be met:

  • The firearm is completely unloaded, with the magazine removed and chamber empty.
  • Neither the firearm nor the ammunition is readily accessible from the passenger compartment. In a car with a trunk, lock everything in the trunk.
  • If the vehicle has no separate trunk, the firearm and ammunition must be in a locked container other than the glove compartment or center console.9Office of the Law Revision Counsel. 18 U.S. Code 926A – Interstate Transportation of Firearms
  • You can legally possess the firearm at both your point of origin and your destination.

FOPA is an affirmative defense, not immunity from arrest. New York law enforcement can still arrest and charge you, and you would need to raise FOPA as a defense in court. Any deviation from a direct route weakens the claim. An overnight hotel stop, checking a firearm at a New York airport, or making the gun accessible at any point during the trip can void the protection. Travelers have been arrested at New York airports and during traffic stops despite believing they were covered. If your plans include any meaningful stop in New York, do not rely on FOPA.

Penalties If You Get Caught

New York treats gun possession offenses with a severity that surprises many Pennsylvania gun owners. The charges scale with whether the firearm is loaded and what type it is.

A felony conviction follows you permanently. Federal law prohibits anyone convicted of a crime punishable by more than one year of imprisonment from possessing any firearm or ammunition anywhere in the country.13Office of the Law Revision Counsel. 18 U.S. Code 922 – Unlawful Acts A single arrest with a loaded handgun in New York can end your gun rights in Pennsylvania for life, and a felony record also affects employment, housing, professional licensing, and voting rights.

If You Do Get a New York License, Where You Still Cannot Carry

Obtaining a New York handgun license does not open up carrying in public places the way a Pennsylvania LTCF does. New York’s Concealed Carry Improvement Act designates a long list of sensitive locations where firearm possession is a Class E felony even with a valid license.14New York State Senate. New York Penal Law 265.01-e – Sensitive Locations The list covers government buildings and courthouses, schools and daycares, houses of worship, public parks, playgrounds, libraries, zoos, public transportation, hospitals and clinics, theaters, stadiums, museums, casinos, bars and restaurants that serve alcohol, homeless and domestic violence shelters, and Times Square.

Private property defaults the opposite way from most states. A business or property owner has to affirmatively post signage allowing concealed carry, and if there is no sign permitting guns, carrying on that property is illegal.15Governor.ny.gov. Governor Hochul Signs Landmark Legislation to Strengthen Gun Laws and Bolster Restrictions Pennsylvania visitors with licenses often miss this and assume the standard rule is the Pennsylvania one.

The gap between Pennsylvania and New York gun law is one of the widest between any two neighboring states. A clean record, a valid PA permit, and good intentions do not change how New York treats unlicensed possession. Before you bring any firearm across the border, confirm that the specific gun, its features, and its magazines all comply with New York law, and that you have a New York license if a handgun is involved.
