You can keep driving in Georgia with an out-of-state license as long as you remain a non-resident and the license from your home state or country is valid.1Justia. Georgia Code 40-5-21 – Exemptions Generally The moment you become a Georgia resident, that privilege ends and you have 30 days to get a Georgia license before you’re driving illegally.2Justia. Georgia Code 40-5-20 – License Required; Surrender of Prior Licenses; Local Licenses Prohibited
Visitors, Students, and Foreign License Holders
If you’re vacationing, passing through, or in Georgia for a short stay, your valid home-state license is all you need. Keep the physical card on you whenever you drive. A photo on your phone won’t do.
The same non-resident exemption covers out-of-state college students. If your legal residence stays in another state and your license remains current, you don’t have to switch to a Georgia license while you’re enrolled.1Justia. Georgia Code 40-5-21 – Exemptions Generally
Foreign license holders can drive here too. A law enforcement officer may ask to see your passport or visa to confirm the license is valid, so keep those documents with you.3Georgia Department of Driver Services. Information for Non-US Citizens Georgia’s statute doesn’t require an International Driving Permit, but one gives an officer an easy way to read a license that isn’t in English.
When Georgia Considers You a Resident
Georgia law presumes you’re a resident, and triggers the 30-day deadline, if any of the following is true:
- You have a home in Georgia that you intend to return to when away.
- You accept a job or start a business in Georgia, or enroll your children in a Georgia school, within 10 days of starting that work or education.
- You’ve been in the state for 30 or more consecutive days, not counting brief absences.
These are rebuttable presumptions, so a genuinely temporary situation can be challenged. In practice, if you’ve signed a lease, started a job, and been in Georgia a month, the Department of Driver Services considers you a resident.4FindLaw. Georgia Code Title 40 – 40-5-1
What Happens If You Miss the 30-Day Window
Driving without a required Georgia license falls under the same penalty structure as driving on a suspended license. A first conviction is a misdemeanor punishable by two days to 12 months in jail and a fine of $500 to $1,000. A second or third conviction within five years becomes a high and aggravated misdemeanor with 10 days to 12 months in jail and fines of $1,000 to $2,500. A fourth conviction is a felony carrying one to five years in prison.5Justia. Georgia Code 40-5-121 – Driving While License Suspended or Revoked
Whether a judge actually imposes jail time on a first offender is another question. But the statutory exposure is real, and relying on judicial leniency is a thin plan.
How to Transfer Your License
You handle the transfer in person at a DDS Customer Service Center. Appointments are only required for behind-the-wheel road tests, so you can walk in for a standard transfer.6Georgia Department of Driver Services. Appointments
What to Bring
DDS wants originals, not photocopies. You’ll need:
- One identity document: certified birth certificate, valid U.S. passport, Certificate of Naturalization, or similar government-issued proof.
- One Social Security document: Social Security card, W-2 showing the full number, or SSA-1099.
- Two documents proving Georgia residency: utility bills, bank statements, lease, or mortgage papers. Utility and bank records must be dated within the last six months.
- Documentation of lawful presence if you’re not a U.S. citizen.
- Your out-of-state license, which you must surrender.
Surrendering the physical card matters. If it’s lost or stolen and you can’t hand it over, you’ll have to take the written knowledge exam and the road test instead of getting a waiver.7Georgia.gov. Transfer an Out-of-State License to Georgia
Testing
If your out-of-state license is valid or has been expired for no more than two years, DDS waives both the knowledge exam and the road test. You take a vision screening only, which requires at least 20/60 acuity in one eye and a 140-degree field of vision.8Georgia Department of Driver Services. If your license has been expired more than two years, expect the full knowledge exam (two parts, road rules and road signs, passing score of 15 out of 20 on each) and a road test.9Georgia Department of Driver Services. Test and Exams Information Free online practice tests are available through DDS.
Cost
A standard Georgia driver’s license costs $32 and is valid for eight years. DDS accepts cash and most major cards, plus Apple Pay and Google Pay.10Georgia Department of Driver Services. Fees and Terms You’ll walk out with a temporary paper license, and the permanent card arrives by mail.
If you want a REAL ID-compliant license (the one marked with a gold star, needed for domestic flights since federal enforcement began May 7, 2025), the documents required are the same as a standard transfer, so there’s no extra step if you bring the right paperwork.11Georgia Department of Driver Services. Military Members and Their Families
Active-duty service members stationed in Georgia who keep legal residency in another state don’t have to switch licenses, and that exemption extends to spouses and dependent children as long as everyone holds a valid home-state license.1Justia. Georgia Code 40-5-21 – Exemptions Generally
Georgia license holders deployed out of state get a six-month grace period if their license expires during deployment. The clock starts at discharge or reassignment back to Georgia, and you’ll want a copy of your orders or a letter from your commanding officer in case you’re stopped on an expired license.12Justia. Georgia Code 40-5-37 – Expiration of Active Duty Service Members Licenses
Commercial Drivers
CDL holders face the same 30-day deadline but have additional requirements. You must surrender your out-of-state CDL (or produce a certified driving record dated within the last 30 days if it was lost or stolen), pass the vision exam, and provide medical certification if your category requires it.13Georgia Department of Driver Services. A hazardous materials endorsement requires retaking the hazmat knowledge test in Georgia. Other endorsements transfer without more testing.
