Can I Force My Husband Out of the Marital Home in Massachusetts?

In Massachusetts, you can ask a judge to order your husband to leave the marital home, and the court can enforce that order even if he owns the property or is the only name on the lease. There are two routes to force a husband out of the marital home in Massachusetts: a Section 34B vacate order inside a divorce or separate support case, or a Chapter 209A abuse prevention order if his behavior involves abuse or coercive control. Which one fits depends on what has been happening in the house.

Which Route Fits Your Situation

If there is abuse, go the 209A route. It is faster, costs nothing to file, does not require you to have filed for divorce, and a violation is a crime rather than a contempt matter. Massachusetts defines abuse under Chapter 209A to include attempting or actually causing physical harm, placing you in fear of imminent serious physical harm, forcing sexual contact, and coercive control, which covers patterns of intimidation, isolation, financial manipulation, threats to harm children or pets, and monitoring your communications or movements.1General Court of Massachusetts. Massachusetts General Laws Chapter 209A Section 1 – Definitions

If the home is high-conflict but his conduct does not reach abuse, Section 34B is the right tool. It lives inside a divorce or separate support action, so you need a case on file before the court can issue the order. The filing fee for a divorce complaint is $200 plus a $15 surcharge, and an Affidavit of Indigency can waive it if you qualify.2Mass.gov. Probate and Family Court Filing Fees

A 209A order can also be issued on an emergency, same-day basis without your husband present. A Section 34B motion can be heard on an emergency basis too, but the 209A standard is written for domestic violence situations, and the enforcement is sharper: police act on a criminal violation, not a contempt complaint.

The 209A Path When Abuse Is Involved

You file a 209A complaint at the District Court, Boston Municipal Court, Probate and Family Court, or Superior Court. No divorce case has to exist. If the judge finds you have shown abuse under the statutory definition, the order can direct your husband to leave and stay away from the home immediately, among other protections.

Violating a 209A order is a criminal offense, which means a police response rather than a return trip to court to prove contempt. If any part of your situation plausibly fits the abuse definition, including the coercive control patterns the law now recognizes, this is the path to consider first.

The Section 34B Vacate Order Inside a Divorce Case

Section 34B lets a Probate and Family Court judge order a spouse out of the marital home for up to 90 days, with additional 90-day extensions as long as the court finds them necessary.3General Court of Massachusetts. Massachusetts General Laws Chapter 208 Section 34B – Order to Vacate Marital Home The standard is whether your health, safety, or welfare, or that of your minor children, would be endangered or substantially impaired if he stayed.

That standard is broader than most people assume. You do not need to prove physical violence. Persistent verbal abuse, substance abuse that destabilizes the household, or conduct causing severe emotional distress to the children can satisfy the standard, provided you present specific facts rather than a general account of a marriage falling apart.

Ownership does not block the order. The court can tell your husband to leave whether he holds the deed alone, both names are on the mortgage, or the family rents.3General Court of Massachusetts. Massachusetts General Laws Chapter 208 Section 34B – Order to Vacate Marital Home The vacate order is temporary possession, not a property division. Who ultimately keeps the house gets decided later in the divorce.

What to File and the Affidavit That Decides It

Section 34B requires an underlying case. If you have not filed yet, you need a Complaint for Divorce (Form CJD-101 for a fault-based divorce, or CJD-101A for a joint petition) or a Complaint for Separate Support.4Mass.gov. Probate and Family Court Complaint for Divorce CJD 101 The motion for exclusive use and possession is a temporary motion inside that case. There is no single preprinted form on the court’s website for it. You draft a written motion stating the relief you want, with a supporting affidavit.

The affidavit is where the case is won or lost. It must be sworn under the penalties of perjury and must describe specific facts: dates, what happened, the effect on the children, your own physical or emotional condition, and any police reports or medical records that back up your account. Judges see affidavits full of vague references to “arguments” and “tension.” Those rarely succeed. Specificity does.

Pull together the housing documents too: a copy of the deed or lease, recent mortgage or rent statements. The judge is not resolving ownership at this stage, but a clear picture of the housing arrangement helps the court shape a workable order.

What Happens at the Hearing

File the motion and affidavit at the Probate and Family Court in your county. If there is an immediate safety risk, you can ask for an emergency ex parte hearing, where the judge hears from you alone and can issue a temporary order without your husband present. Otherwise the court sets a noticed hearing, usually within a few weeks, with both sides appearing.

At the hearing the judge reviews your affidavit, takes testimony, and may ask questions. Your husband can oppose the motion, present evidence, and argue to stay. The judge then applies the statutory standard: would your health, safety, or welfare, or that of the children, be endangered or substantially impaired if he remains?5Mass.gov. 209A Guideline 12:11 – Issuance of Orders to Vacate Marital Residence: Divorce, Separate Support, or Maintenance Judges have wide discretion here, and documented specifics in the affidavit carry the day.

Enforcement if He Refuses to Leave

Once the judge signs the vacate order, the court register sends certified copies to the appropriate law enforcement agency, which serves your husband, typically by hand delivery.6General Court of Massachusetts. Massachusetts General Laws Chapter 208 Section 34C – Orders to Vacate Marital Home and Orders of Restraint You do not arrange service yourself. Officers are required to use every reasonable means to enforce the order, and police departments must keep procedures in place so responding officers can verify the order on the spot.

If he refuses to leave after being served, or comes back in violation of the order, call the police. A husband who defies a 34B vacate order faces contempt of court. You file a Complaint for Contempt (Form CJD-103) in Probate and Family Court. Civil contempt is used to compel compliance and can result in him being held until he obeys. Criminal contempt punishes the violation and can carry fines or jail time.7Mass.gov. 209A Guideline 8:02 – Criminal Contempt A violation also damages his credibility with the same judge who will decide custody and property division.

Ask for Temporary Support in the Same Motion

Getting him out of the house does not resolve who pays for it. Under Chapter 208, Section 17, the court can order temporary alimony during the divorce, and that order can cover the mortgage, utilities, and other household costs.8General Court of Massachusetts. Massachusetts General Laws Chapter 208 Section 17 – Temporary Alimony File a motion for temporary support alongside your motion for exclusive possession so custody, child support, spousal support, and household expenses can be addressed in a single hearing.

Pay particular attention to the mortgage. A vacate order does not remove anyone from the loan. If both names are on the mortgage and payments stop, both credit scores take the hit, regardless of what the judge ordered between the two of you. The bank is not bound by the divorce case. Ask the court to spell out who pays the mortgage in the temporary order, and monitor the account yourself even if that duty falls to your husband. The missed payment lands on you either way.
