Can I Rent a Room With a Florida Homestead Exemption?

You can rent a room in your Florida home and keep your homestead exemption on the part of the house you still live in, but the portion the tenant occupies exclusively loses its exempt status. That is the rule the Florida Supreme Court confirmed in 2023: a rented area is not the owner’s residence, so it falls outside the constitutional exemption even when the owner continues living in the rest of the home.1Justia Law. Furst v Rebholz

What You Lose on the Rented Portion

In Furst v. Rebholz, the owner lived on the bottom floor of a two-story Sarasota home and rented the upstairs. The county property appraiser determined that 15% of the property was used exclusively by the tenant, revoked the exemption on that 15%, and left the remaining 85% exempt. The Florida Supreme Court agreed, pointing to Article VII, Section 6 of the Florida Constitution, which conditions the exemption on the owner maintaining the permanent residence “thereon.”1Justia Law. Furst v Rebholz

Losing the exemption on the rented portion is only part of the cost. Homestead property also carries the Save Our Homes cap, which limits annual increases in assessed value to 3% or the change in the Consumer Price Index, whichever is lower.2Florida Department of Revenue. Save Our Homes Assessment Limitation and Portability Transfer The rented share instead gets reassessed under the 10% non-homestead cap. In the Sarasota case, that recalculation produced roughly $7,000 in back taxes, penalties, and interest reaching back nearly a decade.1Justia Law. Furst v Rebholz

So the exposure on a rented room is two-layered: the exemption dollars you lose each year on that square footage, and the loss of the compounding assessment cap on the same portion.

How the Appraiser Decides the Split

The property appraiser makes a factual determination about what share of the home the tenant occupies exclusively. A locked bedroom with its own bathroom used only by a long-term renter is the clearest example of exclusive use. Common areas you continue sharing generally stay on the homestead side of the line.

Separately, you must still qualify as a permanent resident of the home for any portion to remain exempt. The appraiser weighs objective evidence: your Florida driver’s license address, voter registration, vehicle registration, federal tax return mailing address, where your bank accounts are registered, a recorded declaration of domicile, where your children attend school, your place of employment, and utility payments at the address.3Florida Senate. Florida Code 196.015 – Permanent Residency; Factual Determination by Property Appraiser No single factor controls, but the pattern needs to point to this property as your true home. You can only claim one permanent residence.

Renting the Whole Home Is a Different Rule

Renting a room is partial. Renting the entire home is treated as abandoning your homestead, which ends the exemption completely. Florida law gives a narrow safe harbor: if you vacate and rent the property after January 1, the exemption survives for that tax year as long as the home is not rented for more than 30 days per calendar year for two consecutive years. Cross that threshold and the abandonment is retroactive, with taxes owed on the full value from the point of departure.4Justia Law. Florida Code 196.061 – Rental of Homestead to Constitute Abandonment

Active-duty military members transferred under orders are exempt from this rule. Valid transfer orders preserve permanent residency status for the service member and spouse even if the entire home is rented during the deployment.4Justia Law. Florida Code 196.061 – Rental of Homestead to Constitute Abandonment The Florida Department of Revenue confirms that renting your home can cost you the exemption, with the 30-day window protecting homeowners who rent briefly during a seasonal absence.5Florida Department of Revenue. When Rental Activity Starts to Look Commercial

Even if you keep living in the home, the scale of the rental matters. One long-term roommate is different from turning multiple rooms into short-stay listings on platforms like Airbnb. The statute requires homestead property to be “classified and assessed as owner-occupied residential property” to qualify.1Justia Law. Furst v Rebholz An appraiser who sees frequent guest turnover, posted room rates, and cleaning services may conclude the primary character of the property has shifted toward commercial use, which puts the exemption at risk on a larger portion or, at the extreme, the whole property.

Short-term rentals also come with state and local regulation. Local governments cannot outright ban them unless a local ordinance was in place before June 2011, but they can require registration, safety compliance, and tax collection. Frequent short-term rental activity may require registration with the Florida Department of Business and Professional Regulation and remittance of tourist development taxes. Those filings become part of the paper trail an appraiser can rely on.

Penalties If You Keep Claiming the Full Exemption

If the property appraiser later determines you received a homestead exemption you weren’t entitled to, Florida law allows a lookback of up to 10 years. You owe the back taxes, a 50% penalty on the unpaid taxes for each year, and 15% annual interest.6Justia Law. Florida Code 196.161 – Homestead Exemptions; Lien Imposed on Property of Person Claiming Exemption Although Not a Permanent Resident A tax lien is filed against property you own in the county, and you have 30 days to pay after receiving notice.

If the mistake was the appraiser’s clerical error rather than your misrepresentation, the penalty and interest are waived, though back taxes still apply. Knowingly providing false information to claim the exemption is a first-degree misdemeanor, with up to one year in jail, a fine of up to $5,000, or both.7Florida Senate. Handle Insurance and Income Tax Before the Tenant Moves In

A standard homeowners policy generally excludes claims tied to business activity, and renting a room counts. If a tenant or their guest is hurt in the rented space, your personal liability coverage may not respond, leaving you exposed to medical costs and any lawsuit. Call your insurer before the tenant arrives. Depending on the carrier, the fix is a landlord endorsement, a separate landlord policy, or a hybrid arrangement. Ask the tenant to carry renter’s insurance for their own belongings and liability.

Rental income is also reported on Schedule E of your federal return. You can deduct expenses tied to the rented portion, including a proportional share of mortgage interest, property taxes, insurance, utilities, and depreciation. The IRS allocates shared expenses by room count or square footage: a 180-square-foot room in an 1,800-square-foot home puts 10% of shared costs on the rental side. Expenses specific to the rented space, such as painting that room, are fully deductible as rental expenses.8IRS. Publication 527 (2025), Residential Rental Property If you rent the space for fewer than 15 days in the tax year, you don’t report the income, but you also can’t deduct related expenses.9Office of the Law Revision Counsel. 26 USC 280A – Disallowance of Certain Expenses in Connection With Business Use of Home

Reporting Changes and Challenging an Appraiser’s Decision

After your initial application is approved, the county property appraiser mails a renewal form each year by February 1. If your use of the property or residency status changes, you must say so. Some counties waive annual renewal after the initial filing, but refiling is still required when ownership changes or you stop using the property as a homestead.10Florida Senate. Florida Code 196.011 – Annual Application Required for Exemption Staying silent while collecting an exemption you know you’ve lost is exactly the conduct that produces the back-tax penalties and potential criminal liability above.

If the appraiser revokes or reduces your exemption and you disagree, you can petition the county’s Value Adjustment Board using Form DR-486. You can also request an informal conference with the appraiser’s office first; that meeting doesn’t change your filing deadline but can resolve the dispute without a hearing. Both sides must exchange evidence at least 15 days before the hearing, and if taxes come due while your petition is pending, you must still make the required partial payment or the VAB can deny the petition outright.11Florida Department of Revenue.
