Can Illegal Immigrants Get Welfare in California?

Undocumented immigrants in California cannot get the major federal welfare programs, but they can get full state-funded health coverage through Medi-Cal, county General Relief cash aid, and a handful of federal services that are open to everyone regardless of immigration status. The question of whether undocumented immigrants can get welfare in California does not have a single yes or no answer; it depends almost entirely on who is paying for the program. Federal dollars come with citizenship restrictions. State and county dollars often don’t.

Federal Welfare Programs That Are Off-Limits

Federal law prohibits anyone who is not a “qualified alien” from receiving federal public benefits.1Office of the Law Revision Counsel. 8 USC Ch. 14 – Restricting Welfare and Public Benefits for Aliens That category covers lawful permanent residents, refugees, asylees, and a few other protected groups. It does not cover undocumented residents, DACA recipients, or most people on temporary visas.

In practical terms, three of the biggest safety-net programs are closed:

  • CalFresh, California’s version of SNAP or food stamps, is federally funded and limited to citizens and qualified immigrants.1Office of the Law Revision Counsel. 8 USC Ch. 14 – Restricting Welfare and Public Benefits for Aliens
  • CalWORKs, the state’s main welfare-to-work cash program, follows the same federal rules because it runs on TANF money.
  • Supplemental Security Income (SSI), the federal monthly cash program for people who are aged, blind, or disabled, requires applicants to be U.S. citizens or noncitizens in specific immigration categories recognized by the Department of Homeland Security.2Social Security Administration. SSI Eligibility

The companion state program for SSI is called the Cash Assistance Program for Immigrants (CAPI). Its name causes confusion, so it is worth being direct: CAPI is for lawfully present immigrants who were cut off from SSI by the 1996 welfare reform law. It does not serve undocumented residents.3Department of Social Services. Cash Assistance Program for Immigrants (CAPI)

Full-Scope Medi-Cal, Paid for With State Money

California’s biggest departure from federal law is Medi-Cal. The state uses its own funds to offer full-scope coverage to all income-eligible residents, regardless of immigration status. This is not emergency-only care. Full-scope Medi-Cal covers doctor visits, prescriptions, mental health care, dental, and vision, along with essentially all medically necessary services.

The expansion rolled out in stages. Children under 19 became eligible in May 2016, then young adults 19 through 25 in January 2020.4Governor of California. California Expands Medi-Cal to All Eligible Adults 50 Years of Age and Older Adults 50 and older were added in May 2022, and the last group, adults 26 through 49, became eligible on January 1, 2024.5Medi-Cal. Ages 26 Through 49 Adult Full Scope Medi-Cal Expansion Any California resident who meets the income rules can now enroll.

Pregnancy adds another layer. Pregnant residents receive full-scope Medi-Cal during pregnancy and for one year after the birth outcome, including miscarriage or termination, regardless of status.6Department of Health Care Services. Medi-Cal Immigrant Eligibility FAQs

Do Not Miss Your Renewal

If you lose coverage by missing your annual Medi-Cal renewal, you may not be able to re-enroll in full-scope benefits. According to the Department of Health Care Services, the only coverage available after that point would be emergency and pregnancy-related care.7Department of Health Care Services. Coverage for All Treat the renewal deadline as non-negotiable. One missed form can convert comprehensive coverage into emergency-only coverage, and there is no obvious path back.

Changes Coming in 2027

Because the expansion runs on state dollars, it is sensitive to budget pressure. The Department of Health Care Services has indicated that changes to coverage for undocumented adults ages 19 through 59 may take effect as early as July 1, 2027. The state has cited federal actions, including provisions of legislation signed in July 2025, as part of the budget environment driving those changes. The specifics are not final. Stay enrolled, stay current on renewals, and watch for DHCS announcements.

Federal Services Open to Everyone

Even inside federal law, Congress carved out specific exceptions that apply to all residents because the services protect public health and safety broadly enough to override immigration restrictions.8Office of the Law Revision Counsel. 8 USC 1611 – Aliens Who Are Not Qualified Aliens Ineligible for Federal Public Benefits

  • Emergency Medicaid, called Emergency Medi-Cal in California, covers treatment for emergency medical conditions and emergency dental services such as treatment for severe infections and extractions.6Department of Health Care Services. Medi-Cal Immigrant Eligibility FAQs
  • Immunizations and testing or treatment for communicable diseases are available regardless of status.
  • Short-term, non-cash, in-kind emergency disaster relief is open to everyone.
  • Soup kitchens, crisis counseling, domestic violence shelters, and similar services that don’t condition aid on income serve everyone.8Office of the Law Revision Counsel. 8 USC 1611 – Aliens Who Are Not Qualified Aliens Ineligible for Federal Public Benefits
  • WIC, the nutrition program for Women, Infants, and Children, is not restricted by citizenship. Agencies generally do not ask about immigration status.
  • Children can receive free or reduced-price meals through the National School Lunch Program regardless of their own or their parents’ status.

General Relief: The One Cash Program Without Status Restrictions

General Relief (also called General Assistance) is the only cash welfare program in California that does not exclude people based on immigration status. Each county funds and designs its own program through its Board of Supervisors, with no state or federal money involved.9California Department of Social Services. General Assistance or General Relief It is meant for indigent adults who do not qualify for anything else.

Expect modest payments and wide variation. Monthly benefits typically run from roughly $200 to $400, and many counties add work requirements, time limits, or other conditions. All 58 counties set their own rules, so what Los Angeles offers can look very different from what a smaller rural county offers. The place to start is your county’s social services or human services department.

Benefits for U.S. Citizen Children in Mixed-Status Households

Children born in the United States are U.S. citizens and fully eligible for every federal and state benefit program. An undocumented parent can apply for CalFresh, CalWORKs, and Medi-Cal on behalf of a citizen child without the parent becoming a beneficiary.

Household income is where it gets technical. The parent’s income is still partially counted when the agency figures out the child’s eligibility and benefit amount, prorated across household members so that only the share attributable to eligible members counts. The usual result is a smaller benefit than a fully citizen household with the same income would receive, but the child remains eligible. Families who assume the parent’s status disqualifies the child often leave real money on the table.

Will Applying Create a Public Charge Problem?

This fear keeps many eligible families away from programs they lawfully qualify for. Under the public charge rule, immigration officials can consider whether someone is likely to become primarily dependent on government assistance when deciding admission to the U.S. or an application for lawful permanent residence.

The rule is narrower than most people think. Only four categories of benefits count: SSI, TANF (CalWORKs), state or local cash assistance for income maintenance, and long-term institutionalization at government expense.10Federal Register. Public Charge Ground of Inadmissibility

Explicitly excluded from the public charge test:

Routine Medi-Cal care, enrolling a citizen child in CalFresh, and receiving WIC do not count against anyone. The programs undocumented residents in California can actually access, full-scope Medi-Cal and General Relief, are not the ones that trigger public charge concerns.

Confidentiality When You Apply

California law treats benefit applications and records as confidential. Under the Welfare and Institutions Code, records maintained by public agencies in connection with social services programs cannot be disclosed for purposes unrelated to program administration, publishing lists of recipients is prohibited, and sharing between agencies is restricted to eligibility verification and program administration.11Justia. California Welfare and Institutions Code 10850-10853 – Chapter 5 Records

The California Values Act separately restricts state and local law enforcement from using resources for federal immigration enforcement, with limited exceptions involving serious violent felony convictions. County social services workers are not immigration agents. These rules exist so that an application does not become a pathway to deportation.

No state law can override a federal judicial warrant, and immigration policy shifts quickly. If your situation is sensitive, talk to an immigration attorney before you decide to apply for or walk away from a benefit your household qualifies for.
