Can Undocumented Immigrants Get a Driver’s License in Illinois?

Yes. Since July 1, 2024, an undocumented immigrant can get a driver’s license in Illinois. House Bill 3882 replaced the old Temporary Visitor Driver’s License with a standard license available to anyone who cannot obtain a Social Security number, as long as you can show at least one year of Illinois residency and present a valid passport or consular card.¹ The card looks like any other Illinois license and carries the same driving privileges.

Documents You Need

First-time applicants bring four things to the appointment:

A passport or consular card proving your name, date of birth, and signature. It can be current or expired within the past two years. Consular cards are accepted from Mexico, Guatemala, Colombia, Ecuador, and Brazil.²
Proof that you have lived in Illinois for at least 12 consecutive months. Utility bills, bank statements, rental agreements, and government mail addressed to your Illinois home all work.
Proof of your current Illinois address, separate from the one-year residency proof.
Proof of valid automobile liability insurance at the time you apply.²

Any document not in English needs a certified translation. The translator has to certify both that the translation is accurate and that they are competent to translate from the original language into English.

How the Application Works

First-time applicants must apply in person at a Secretary of State facility. Not every location handles these applications, so confirm the facility offers this service when you book. Appointments are mandatory. Show up without one and you will be turned away.

At your appointment, staff review your documents first. Anything missing or inconsistent stops the process, so check twice before you go. If the documents pass, you take three tests:

A vision screening.
A written knowledge test on Illinois traffic laws and road signs, offered in multiple languages.
A behind-the-wheel driving test. You need to bring a properly insured vehicle for this portion.

The fee is $30 and is nonrefundable whether you pass or not.² Pass all three and you leave with a temporary paper license the same day. The permanent card is mailed to your Illinois address, usually within about 15 business days.

Privacy Protections

This is the part most applicants want to understand before handing over documents. Illinois law prohibits the Secretary of State from sharing your personal information, photos, application documents, or facial recognition data with any immigration agent. The only exceptions are a federal judicial warrant signed by a judge, a lawful court order, or a subpoena from a federal or state court that specifically names your records.³

Even when one of those exceptions applies, the Secretary of State must notify you within three business days that your records were requested and tell you which agency asked for them. The Secretary is also barred from entering into any data-sharing agreement unless every other party certifies the information will not be used for civil immigration enforcement.³ Your application documents are classified as confidential and are accessible only to Secretary of State employees who need them for processing, or to law enforcement conducting a legitimate criminal investigation unrelated to immigration.

What the License Can and Can’t Do

The card is a standard Illinois driver’s license and works as everyday identification. You can use it to pick up prescriptions, enroll children in school, access medical services, and open a bank account.

It is marked “Federal Limits Apply,” which means it is not a REAL ID. Since REAL ID enforcement began on May 7, 2025, you cannot use this license to board a domestic flight or enter a federal building.⁴ A valid passport from your home country is accepted at TSA checkpoints, so you are not locked out of flying.

Insurance Is Required

Every vehicle on Illinois roads has to be covered by liability insurance, regardless of the driver’s immigration status.⁵ The Illinois minimums are $25,000 per person for bodily injury, $50,000 per accident when more than one person is hurt, and $20,000 per accident for property damage.⁶ Those are floors. Serious crashes routinely cost more, and many drivers carry higher limits.

Driving uninsured brings a fine of $500 to $1,000 for a first offense, plus a three-month license suspension and a $100 reinstatement fee. A first-time offender who brings proof of current insurance to the court date can receive court supervision and pay a reduced $100 fine.⁷ If you are stopped without a valid license and without insurance, your vehicle can be impounded on the spot, and it will only be released to a licensed driver who shows proof of insurance and has the owner’s notarized written consent.⁸

Renewal

The license is valid for four years. Illinois lets you renew up to one year before it expires. Renewal means going back to a Secretary of State facility with current documentation and paying the renewal fee. Keep your address on file current, because your renewal notice and any replacement card get mailed there.

If You Already Hold a TVDL

Switching from an existing Temporary Visitor Driver’s License is much simpler than a first-time application. You need your current TVDL number and your TVDL card. No testing is required. You can apply online at ilsos.gov/TVDL or in person at a facility. The fee is $5.²
