Can You Buy a Gun at 18 in Georgia? Dealer vs. Private Sale

Yes, you can buy a gun at 18 in Georgia, but only certain kinds and only through certain channels. A licensed dealer can sell you a rifle or shotgun once you turn 18, but federal law blocks that same dealer from selling you a handgun until you turn 21. Georgia law lets an 18-year-old legally own a handgun acquired through a private sale, and lets you keep that handgun at home, in your car, or at your place of business. Carrying it in public is a separate question, and for most 18-to-20-year-olds the answer is no.

Rifles and Shotguns From a Dealer at 18

The Gun Control Act lets any federally licensed dealer transfer a rifle or shotgun to a buyer who is at least 18. The same statute bars that dealer from transferring a handgun or handgun ammunition to anyone under 21.1Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Walk into a Georgia gun store at 18 and you can leave with a long gun; you cannot leave with a pistol or revolver.

Every dealer sale requires you to complete ATF Form 4473, the federal firearms transaction record, and the dealer runs your information through the National Instant Criminal Background Check System before finishing the sale.2Bureau of Alcohol, Tobacco, Firearms and Explosives. Expect a Longer Background Check

Since the Bipartisan Safer Communities Act took effect in 2022, dealer background checks on buyers under 21 go beyond adult criminal records. The FBI also pulls juvenile criminal history and mental health adjudication records from state and local repositories in your home jurisdiction. If something potentially disqualifying surfaces, the transfer can be delayed for up to 10 business days while investigators look closer.3U.S. Congress. Gun Control: Juvenile Record Checks for 18- to 21-Year-Olds Most checks still clear quickly, but if you’re 18, 19, or 20, don’t assume you’ll walk out the same day.

Handguns at 18 Through a Private Sale

The federal 21-and-over rule for handguns applies only to licensed dealers. For an unlicensed private seller, federal law prohibits transferring a handgun to anyone the seller knows or has reasonable cause to believe is under 18.1Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Georgia state law uses the same threshold: handgun possession is only illegal for people under 18.4Justia. Georgia Code 16-11-132 – Possession of Handgun by Person Under the Age of 18 Years

So an 18-year-old in Georgia can legally buy a handgun from another Georgia resident in a private sale, or receive one as a gift. Georgia does not require a background check for private firearm transfers, so there is no dealer involved and no NICS run. The legal duty sits with the seller, who must not knowingly transfer a firearm to someone prohibited from possessing one.

Even without a required check, write down what happened. A simple bill of sale listing both parties’ names, the date, the firearm’s serial number and description, and the price gives both of you a record if the gun is later recovered somewhere it shouldn’t be.

Age Isn’t the Only Requirement

Hitting 18 doesn’t by itself make you eligible to own a firearm. Georgia law punishes any convicted felon who receives, possesses, or transports a firearm with one to ten years in prison, and a second offense carries a minimum of five.5Justia. Georgia Code 16-11-131 – Possession of Firearms by Convicted Felons and First Offender Probationers

Federal law bars firearm possession for several more categories of people. You cannot legally possess a firearm if you:1Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts

  • Have a conviction for any crime punishable by more than one year of imprisonment
  • Are a fugitive from justice
  • Use or are addicted to controlled substances
  • Have been involuntarily committed to a mental institution or adjudicated mentally unfit
  • Are subject to a qualifying domestic violence protective order
  • Have a misdemeanor domestic violence conviction
  • Received a dishonorable discharge from the Armed Forces

A dealer’s NICS check catches most of these. A private seller may not know, but the prohibition still applies to you. Possessing a firearm while falling into any of these categories is a federal crime no matter how the gun came into your hands.

Carrying a Handgun in Public Before 21

Georgia went to permitless carry in 2022, which lets a “lawful weapons carrier” carry a handgun openly or concealed in most public places without a license.6Georgia.gov. Apply for a Firearms License The definition is the trap for younger adults. A lawful weapons carrier is someone eligible for a Georgia weapons carry license under Code 16-11-129, and that statute sets the minimum age at 21.7Justia. Georgia Code 16-11-129 – Weapons Carry License Permitless carry, in practice, is closed to 18-to-20-year-olds. The Georgia Supreme Court upheld that age restriction in Stephens v. State of Georgia (2025).8Justia. Stephens v. State of Georgia

Georgia Code 16-11-126 still spells out what any non-prohibited person can do with a handgun regardless of age:9Justia. Georgia Code 16-11-126 – Having or Carrying Handguns, Long Guns, and Other Weapons

  • Carry it on your person at home or on your own property
  • Keep it in your vehicle
  • Carry it at your place of business

Long guns are separate. Anyone not otherwise prohibited can carry a rifle or shotgun on their person in public, regardless of age.

Military Service Opens Carry Early

Georgia carves out one route to public carry before 21. If you are at least 18, have completed basic training in the U.S. Armed Forces, and can show proof of active-duty status or an honorable discharge, you qualify for a weapons carry license and count as a lawful weapons carrier.7Justia. Georgia Code 16-11-129 – Weapons Carry License From there, your carry rights match any 21-year-old’s.

Penalties for Carrying Illegally

If you’re 18 and carry a handgun in public without qualifying as a lawful weapons carrier, you’ve committed unlawful carrying of a weapon:9Justia. Georgia Code 16-11-126 – Having or Carrying Handguns, Long Guns, and Other Weapons

  • First offense: misdemeanor
  • Second offense within five years: felony punishable by two to five years in prison

A felony conviction permanently strips your right to possess any firearm under both federal and Georgia law. A bad decision at 19 can cost you gun rights for life.

Places Firearms Are Off-Limits

Even people who qualify as lawful weapons carriers can’t bring firearms into certain places. Georgia law prohibits carrying in courthouses, jails and prisons, within 150 feet of an active polling place during elections, state mental health facilities that admit patients involuntarily, nuclear power facility premises, and places of worship unless the governing body permits it.10Justia. Georgia Code 16-11-127 – Carrying Weapons or Long Guns in Unauthorized Locations K-12 school property, school functions, and school buses fall under a separate school safety zone statute.11Justia. Georgia Code 16-11-127.1 – Carrying Weapons Within School Safety Zones, at School Functions, or on a Bus or Other Transportation Furnished by a School Government buildings are restricted for anyone who isn’t a lawful weapons carrier, which effectively closes them to most 18-to-20-year-olds.
