You cannot legally buy magic mushrooms in Colorado. Commercial sale of psilocybin is still a felony, and no store, dispensary, or website is authorized to sell it. What Proposition 122 did in November 2022 was decriminalize personal possession, home cultivation, and gift-sharing for adults 21 and older, and open the door to state-licensed healing centers where you pay for a supervised session rather than for the mushrooms themselves.1Colorado Secretary of State. 2022 Nov 8 – General – Proposition 122 (STATUTORY) – State of Colorado
Decriminalization is not legalization. Colorado removed criminal penalties for certain personal activities but never created a retail market. People confuse the two constantly, and the confusion leads to real charges.
What You Can Legally Do If You’re 21 or Older
Three activities are allowed under the Natural Medicine Health Act: possessing psilocybin, growing it at home, and sharing it with another adult for free.
There is no specific weight limit on personal possession.2Department of Natural Medicine. Natural Medicine Frequently Asked Questions “Personal use” still has a practical ceiling, though. Large quantities, especially alongside scales, packaging, or cash, can draw charges for intent to distribute.
Home cultivation is capped at a space of 12 feet by 12 feet, inside a private dwelling. If anyone under 21 lives there, the growing area has to be enclosed and locked. If a minor is only visiting, you have to restrict access for the duration of the visit. Going over the 12-by-12 limit or failing to keep minors out is a drug petty offense with a fine of up to $1,000.3Justia Law. Colorado Revised Statutes Title 18-18-434 – Offenses Relating to Natural Medicine and Natural Medicine Product – Definitions
Sharing is legal only when nothing of value changes hands. The statute uses the word “remuneration,” which covers money, goods, services, and anything else of value.3Justia Law. Colorado Revised Statutes Title 18-18-434 – Offenses Relating to Natural Medicine and Natural Medicine Product – Definitions Sharing in the context of counseling, spiritual guidance, or community healing is included in the law’s definition of personal use, provided no payment is involved.
Using or displaying psilocybin openly in public remains a drug petty offense: up to a $100 fine and up to 24 hours of community service.3Justia Law. Colorado Revised Statutes Title 18-18-434 – Offenses Relating to Natural Medicine and Natural Medicine Product – Definitions Keep it private.
Why “Gift with Purchase” Deals Are Still Illegal Sales
Some sellers advertise “free mushrooms with purchase” of a sticker, piece of art, or a consultation. Law enforcement treats these as disguised sales, and prosecutors use the listings themselves as evidence of intent to distribute. Attaching a separate item to the transaction does not legally separate the payment from the drug transfer. If anything of value changes hands in connection with the transfer of psilocybin, it counts as a sale under Colorado law, no matter how the deal is labeled. Buying from one of these operations is buying from a dealer.
Penalties for Selling Psilocybin
Psilocybin remains a Schedule I controlled substance under Colorado’s drug statutes, so unlawful distribution falls under the state’s general drug felony framework. The weight brackets:
- 14 grams or less: A Level 3 drug felony with 2 to 4 years in prison and fines of $2,000 to $500,000. Sales of 4 grams or less may be reduced to a Level 1 drug misdemeanor in some circumstances.4Justia Law. - More than 14 grams but not more than 225 grams: A Level 2 drug felony with 4 to 8 years in prison and fines of $3,000 to $750,000.4Justia Law. Licensed Healing Centers: The Only Legal Paid Access
Proposition 122 created a second legal pathway: state-licensed healing centers where you consume psilocybin under supervision of a trained facilitator. The Department of Revenue’s Natural Medicine Division began accepting applications on December 31, 2024. As of March 2026, Colorado has approved 9 standard and 32 micro healing center licenses.6Department of Natural Medicine. Home – Department of Natural Medicine
License approval does not mean a center is open. Each center still needs local government approvals, a licensed cultivation source, and access to a state-approved testing facility before serving clients.7Department of Natural Medicine. The DOR’s Natural Medicine Division Issues Colorado’s First Healing Center License Availability varies by location and the program is still early.
Pricing is not casual. Early estimates put a single supervised session at $1,000 to $3,500 or more. A typical dosing session runs five to eight hours, plus preparation and follow-up with the facilitator. You cannot take psilocybin home from a healing center; the legal transaction is the supervised session, not a purchase.
Boundaries Colorado’s Law Doesn’t Cross
Federal Law
Psilocybin is still a Schedule I substance under federal law, and Proposition 122 states it is not intended to exempt anyone from federal law or interfere with federal enforcement.8Colorado General Assembly. Proposition 122 – Access to Natural Psychedelic Substances Final LC Packet Three practical consequences catch people off guard:
Possessing psilocybin on federal land, including national parks, national forests, and Bureau of Land Management acreage, exposes you to federal criminal charges even if you grew the mushrooms legally at home.
Federal law bars any “unlawful user of or addicted to any controlled substance” from possessing firearms or ammunition.9Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Because psilocybin is still federally illegal, regular users risk federal firearms charges. State decriminalization does not change this.
Noncitizens face especially serious risk. Under the Immigration and Nationality Act, controlled substance violations can make a person inadmissible. Admitting to psilocybin use during a green card interview or at a border crossing can trigger immigration consequences, and there is no small-amount waiver for psilocybin equivalent to the one that exists for marijuana.
Driving
Driving while impaired by psilocybin is a DUI, and the statute specifies that being legally entitled to use a substance under state law is not a defense.10Justia Law. Colorado Revised Statutes Title 42-4-1301 – Driving Under the Influence – Definitions Impairing effects can last up to six hours. Drug Recognition Experts are trained to identify psilocybin impairment during traffic stops.11Colorado Department of Transportation. Natural Medicine Stakeholder Toolkit
Employment
The Natural Medicine Health Act does not protect your job. It explicitly says it should not be read to require employers to permit or accommodate psilocybin use in the workplace. Employers can maintain drug-free policies, test, and take action against employees who test positive, including for off-duty use at home. The statute does say lawful activity under the act cannot be the sole basis for denying a person “a right or privilege,”3Justia Law. Colorado Revised Statutes Title 18-18-434 – Offenses Relating to Natural Medicine and Natural Medicine Product – Definitions but how courts will apply that in employment disputes is untested. Assume your employer can fire you.
