Can You Buy Vapes Online in Oregon? The Ban and Alternatives

No, you cannot legally buy vapes online in Oregon and have them shipped to your home. Since January 1, 2022, state law has prohibited any seller from shipping vaping products to Oregon consumers, whether the order was placed over the internet, by phone, or through the mail. The only lawful way to buy a vape in Oregon is in person at a licensed retail store.

The Oregon Law That Bans It

ORS 180.441 is the statute doing the work. It bars anyone in the business of selling vaping products from shipping them to any Oregon consumer and requires that a retailer or employee physically hand the product to the buyer in a face-to-face exchange.1Oregon State Legislature. Oregon Code 180.441 – Prohibited Shipping; In-person Sale Required The only shipments the law allows are those between licensed distributors and retailers. Consumers are not on that list.

The ban originally covered only cigarettes and smokeless tobacco when it was enacted in 2017. A 2021 amendment extended it to “inhalant delivery systems,” and that change took effect January 1, 2022.2Oregon Department of Justice. Notification Regarding Oregon’s Delivery Sales Prohibition – ORS 180.441 Oregon defines inhalant delivery systems broadly: any device that delivers nicotine or cannabinoids as a vapor or aerosol, plus every component, liquid, and substance sold for use with such a device, whether packaged together or sold separately.3Oregon Public Law. Oregon Code 431A.175 – Definitions; Unlawful Activities; Notice; Rules If it vapes, the ban reaches it.

The statute also makes it illegal to knowingly provide “substantial assistance” to a violation, which pulls in websites and middlemen that help route shipments to Oregon addresses.1Oregon State Legislature. Oregon Code 180.441 – Prohibited Shipping; In-person Sale Required Oregon’s Attorney General can seek an injunction, disgorgement of profits, civil penalties of up to $5,000 per violation, and recovery of investigation costs and attorney fees.4Oregon Department of Justice. No Legitimate Carrier Will Deliver a Vape Anyway

Federal shipping rules would block most of these deliveries even without Oregon’s ban. The Prevent All Cigarette Trafficking (PACT) Act, expanded in 2021 to cover electronic nicotine delivery systems, generally prohibits the U.S. Postal Service from mailing vaping products. Sellers who ship through private carriers must register with the ATF, file monthly reports with state tax administrators, verify the buyer’s age at the point of sale and again at delivery, and comply with every state and local law on taxes, licensing, and delivery sales.5ATF. Prevent All Cigarette Trafficking PACT Act Because Oregon bans consumer delivery outright, “complying with state law” means not shipping to Oregon consumers at all.

The two major private carriers have gone further than federal law requires. UPS refuses all domestic shipments of vaping products, including devices, e-liquids, and any component or accessory, regardless of nicotine content and regardless of the shipper’s licenses.6UPS. Shipping Tobacco FedEx has a similar blanket ban on electronic nicotine delivery systems. Between the Postal Service’s statutory prohibition and the private carriers’ policies, there is essentially no legitimate way for a vape to arrive at an Oregon doorstep.

What Happens if You Order From a Site That Will Ship

Some out-of-state and overseas websites still accept Oregon shipping addresses. Accepting the order does not make the transaction legal, and several things can go wrong for the buyer.

The package can be intercepted and destroyed by Customs or the carrier, with no refund. The FDA and U.S. Customs and Border Protection have been actively seizing unauthorized vaping products at the border; across 2025, the agencies stopped more than 6 million unauthorized vaping products worth over $120 million from entering the country.7FDA. HHS, CBP Seize $86.5 Million Worth of Illegal E-Cigarettes in Largest-Ever Operation If your order is in a seized shipment, the money is gone.

Even if the product arrives, it is probably not legal to sell in the United States in the first place. Every e-cigarette needs a premarket authorization order from the FDA before it can lawfully be sold here. As of March 2026, only 41 e-cigarette products have received that authorization.8FDA. E-Cigarettes, Vapes and Other Electronic Nicotine Delivery Systems ENDS Authorized by the FDA The vast majority of products on gray-market websites fall outside that short list.

And the seller is exposed to Oregon’s $5,000-per-violation civil penalty, which is one reason reputable retailers refuse Oregon addresses in the first place.4Oregon Department of Justice. Tobacco Legislation

How to Buy a Vape Legally in Oregon

Walk into a licensed retail store, show a valid government-issued photo ID, and buy in person. Oregon’s minimum purchase age for any tobacco or vaping product is 21, and ORS 167.755 makes it a violation to knowingly sell an inhalant delivery system to anyone younger.9Oregon Public Law. Oregon Code 167.755 – Selling Tobacco Products or Inhalant Delivery Systems to Person Under 21 Years of Age; Penalties Retailers are required to check ID.

Any store selling vapes in Oregon needs a statewide tobacco retail license (or, in certain counties and cities including parts of Multnomah, Benton, Clatsop, and Klamath counties, an equivalent local license).10Oregon Department of Revenue. Statewide Tobacco Retail License A current license on display is the clearest sign that a shop is operating within the law. If a store cannot show one, treat that as a reason to go elsewhere.

A Note on Flavored Vapes

Oregon has no statewide ban on flavored vaping products. Senate Bill 702 in the 2025 legislative session would have prohibited them, but it died in committee when the legislature adjourned in June 2025.11Oregon State Legislature. SB 702 – Relating to Public Health Washington County and Multnomah County each passed flavored tobacco bans in 2021 that voters confirmed in 2022, but those bans are currently on hold pending a ruling from the Oregon Supreme Court. For now, flavored products remain available at licensed retailers in most of the state, though this is an area that could shift quickly.
