You can legally carry a gun on a college campus in Texas, but only a concealed handgun, only if you hold a Texas License to Carry (LTC), and only in areas the school hasn’t designated as off-limits. Public universities and community colleges have to allow licensed concealed carry. Private universities can ban it, and most have. Getting any of these distinctions wrong can turn a lawful carry anywhere else in Texas into a felony on campus.
The Core Rules
Texas Senate Bill 11, codified at Government Code Section 411.2031, lets a Texas LTC holder bring a concealed handgun onto the campus of any public institution of higher education.1State of Texas. Texas Government Code Section 411.2031 – Carrying of Handguns by License Holders on Certain Campuses Three limits are built into that permission:
- The handgun must stay concealed at all times. Open carry is not covered by the campus carry law and remains a separate criminal offense on college grounds, even for a valid LTC holder.2Texas Legislature Online. Texas Senate Bill 11 – 84th Legislature
- Only handguns are authorized. Rifles, shotguns, and other weapons are not.
- The license has to be a Texas LTC. No other credential satisfies the campus exception.
Permitless Carry Does Not Work on Campus
This is where people get caught. Texas enacted permitless carry in 2021, allowing most adults who can legally possess a handgun to carry one without any license in most public places. College campuses are explicitly excluded.3Dallas College. Concealed Carry
Penal Code Section 46.03 prohibits firearms on the premises of any educational institution unless the person holds a concealed handgun license issued under Texas law.4State of Texas. Texas Penal Code Section 46.03 – Places Weapons Prohibited Permitless carry did not change that. If you walk onto campus with a handgun and no LTC, you’ve committed a third-degree felony, even if that same carry would be perfectly legal on the sidewalk one block away.
Getting a Texas License to Carry
The standard minimum age is 21. Two statutory exceptions lower it to 18: active-duty or honorably discharged military members and veterans, and individuals protected by an active protective order.5State of Texas. Texas Government Code 411.172 – Eligibility A 2022 federal court decision in Firearms Policy Coalition v. McCraw also opened LTC eligibility to otherwise qualified 18-to-20-year-olds; Texas dropped its appeal and the Department of Public Safety began processing those applications.6The Texas Tribune. Applicants pass state and federal background checks and complete a handgun proficiency course with classroom instruction, a written exam, and a live-fire demonstration.7State of Texas. Texas Government Code 411.188 – Handgun Proficiency Required
Out-of-State Permits
Texas recognizes concealed carry permits from many other states for general carry. The campus exception in Penal Code 46.03 is narrower: it applies specifically to a license issued under Subchapter H, Chapter 411 of the Government Code, which is the Texas LTC.4State of Texas. Texas Penal Code Section 46.03 – Places Weapons Prohibited An out-of-state permit does not qualify you to carry on a Texas college campus. Non-residents can apply for a Texas LTC, but must complete the shooting proficiency test in Texas.
Public Campuses Allow It, Most Private Campuses Don’t
Public universities, community colleges, and state technical institutes must allow licensed concealed carry. They can designate specific exclusion zones and regulate dormitory storage, but those restrictions cannot amount to a general ban.1State of Texas. Texas Government Code Section 411.2031 – Carrying of Handguns by License Holders on Certain Campuses
Private universities can opt out entirely. After consulting with students, staff, and faculty, a private institution can prohibit all license holders from carrying on its campus, at institution-sponsored activities, or in institution-owned vehicles.2Texas Legislature Online. Texas Senate Bill 11 – 84th Legislature The large majority of Texas private universities have taken that step. Baylor, Rice, SMU, TCU, and Trinity, among many others, all prohibit campus carry. Before you carry on any private campus, read the school’s published policy. Carrying on a private campus that has opted out is a criminal offense.
Dorm and Residence Hall Storage
Even at public universities, the law gives institutions authority to regulate how handguns are stored in residential facilities they own or operate.1State of Texas. Texas Government Code Section 411.2031 – Carrying of Handguns by License Holders on Certain Campuses Each school writes its own rules, but a common standard is that the handgun must stay on your person or locked in a personal safe or secure container. Universities are not required to provide storage, so plan on bringing your own lockbox if you live on campus.
Where Carry Is Off-Limits on Public Campuses
Public university presidents must establish rules about where concealed carry is allowed after consulting with students, staff, and faculty. Those rules cannot amount to a general ban, but they can carve out specific areas. Each restricted area has to be marked with legally compliant signage under Penal Code Section 30.06.8State of Texas. Texas Penal Code Section 30.06 – Trespass by License Holder With a Concealed Handgun
Exclusion zones vary by campus, but typical designations include:
- Patient care areas such as campus health centers, counseling centers, and clinical mental health facilities
- Laboratories with hazardous materials, open flame setups, or compressed gas cylinders subject to fire protection codes
- Stadiums, arenas, and athletic complexes during games or interscholastic competitions
- On-campus early learning centers, daycare facilities, and locations hosting pre-K through 12th-grade activities
- Vivaria and animal research facilities where handling protocols create a risk of accidental discharge or separation from the firearm
Boundaries differ from one campus to the next. Check the exclusion zone map or policy published by the specific institution you’re visiting. Assuming one university’s zones match another’s is a reliable way to end up in handcuffs.
Federal Buildings on Campus
Some campuses contain federal buildings, such as Veterans Affairs offices, federal research facilities, or post offices. Federal law bans firearms in any building or space owned or leased by the federal government where federal employees regularly work, regardless of state law. Penalties run up to one year in prison, or up to five years if prosecutors show intent to use the weapon in a crime.9Office of the Law Revision Counsel. 18 U.S. Code 930 – Possession of Firearms and Dangerous Weapons in Federal Facilities A Texas LTC does not override federal law.
What a Violation Costs
LTC Holder in a Restricted Zone
An LTC holder who carries a concealed handgun into a designated exclusion zone on a public campus, or onto an opted-out private campus, commits a Class A misdemeanor under Penal Code 46.03.4State of Texas. Texas Penal Code Section 46.03 – Places Weapons Prohibited That carries up to one year in county jail and a fine of up to $4,000.10State of Texas. Texas Penal Code 12.21 – Class A Misdemeanor A conviction can also trigger LTC revocation.
Carry Without a Texas LTC
Carrying any firearm on a college campus without a Texas LTC is a third-degree felony under Penal Code 46.03.4State of Texas. Texas Penal Code Section 46.03 – Places Weapons Prohibited The punishment range is two to ten years in state prison and a fine of up to $10,000.11State of Texas. Texas Penal Code 12.34 – Third Degree Felony Punishment A felony conviction also triggers a lifetime federal ban on possessing firearms under 18 U.S.C. ยง 922(g). This applies whether you forgot your license, never had one, or assumed permitless carry covered you.
School Discipline
Criminal charges are not the only exposure. Universities can suspend or expel students and terminate employees independently of the criminal case. Those proceedings move faster than courts, and the standard of proof is lower.
