You can legally carry a gun on a motorcycle in California, but the margin for error is thinner than it is in a car. Without a concealed carry permit, every handgun has to travel unloaded inside a locked case, because a motorcycle has no trunk and the trunk exception is the easy path most car drivers rely on. With a valid CCW permit, you can carry a loaded handgun concealed on your person while riding. Long guns follow looser rules. Everything below assumes you can legally possess the firearm in the first place.
Transporting a Handgun Without a CCW Permit
Penal Code 25610 lets you transport a handgun in any motor vehicle if it is unloaded and stored in the trunk or in a locked container inside the vehicle.1California Legislative Information. California Penal Code 25610 – Transporting Handguns A motorcycle has no trunk, so the locked container is your only option.
California defines a locked container as a fully enclosed, secure container fastened with a padlock, key lock, combination lock, or similar device. A motorcycle’s built-in utility compartment or glove box does not qualify, even if it latches shut.2State of California – Department of Justice – Office of the Attorney General. Transporting Firearms in California The usual setup is a hard-sided or soft-sided gun case with its own lock, placed inside a saddlebag, top case, or backpack. The saddlebag itself does not need to lock; the case inside it does.
Unloaded has a specific meaning. Under Penal Code 16840, a firearm is loaded when an unexpended cartridge or shell is in or attached to the firearm in any way, including the firing chamber, magazine, or clip.3California Legislative Information. California Penal Code 16840 – Definition of Loaded Remove the magazine and clear the chamber before the gun goes in the case. Ammunition can travel with you, but keeping it in a separate pouch or compartment removes any argument about whether the gun was loaded.
Rifles and Shotguns
Long guns are not “firearms capable of being concealed upon the person” under Penal Code 25400, so the locked-container rule does not apply to them.4California Legislative Information. California Penal Code 25400 – Carrying a Concealed Firearm A rifle or shotgun must still be unloaded in transit, but it does not have to be inside a locked case. A barrel of 16 inches or more generally puts the firearm outside the concealable category.
Strapping an uncased rifle to a bike in open view is legal if unloaded, but it invites attention you probably don’t want. A padded soft case secured to the bike protects the firearm and avoids confusion with other violations.
Why Open Carry Doesn’t Work on a Bike
Penal Code 26350 makes it a misdemeanor to carry an exposed, unloaded handgun on your person or inside or on a vehicle in any incorporated city, or in prohibited areas of unincorporated counties. If you’re carrying both an exposed handgun and ammunition on your person and you’re not the registered owner, the ceiling rises to one year in county jail, a fine up to $1,000, or both.5California Legislative Information. California Penal Code 26350 – Openly Carrying an Unloaded Handgun
On a bike there is nowhere to hide a holstered firearm from view. Without a CCW, the gun belongs in the locked case, not in a holster and not mounted to the bike.
Riding With a CCW Permit
A valid California CCW permit lets you carry a loaded, concealed handgun on your person while riding. A loaded handgun in a holster under your jacket is legal, and you don’t need to go through the unloaded-and-locked routine.2State of California – Department of Justice – Office of the Attorney General. Transporting Firearms in California The permit only covers the specific handguns listed on it, and only the permit holder can carry them.
Senate Bill 2, effective January 1, 2024, replaced the old “good cause” and “good moral character” standards with objective disqualification criteria, set a minimum age of 21, and added training requirements for safe handling and storage.6State of California – Department of Justice – Office of the Attorney General. Regulations: Carry Concealed Weapons Licenses Your local sheriff or police chief issues the license once you pass the background screening and finish the training.
Disclosing During a Traffic Stop
No California statute requires you to tell an officer you’re armed during a stop. Many county sheriffs include a notification requirement as a condition of the CCW itself, and breaking that condition can cost you the permit even though it isn’t a criminal offense. On a motorcycle, where the officer is right beside you and a holstered firearm can show itself the moment you move, disclosing early avoids a tense misunderstanding. Keep your hands visible, say you have a permit and are carrying, and follow instructions.
Where You Still Can’t Carry
SB 2 created 26 categories of “sensitive places” under Penal Code 26230 where a CCW holder cannot carry. Courts have blocked some through a preliminary injunction, but as of a March 2025 California Department of Justice bulletin, 20 of the 26 remain enforceable.7State of California – Department of Justice – Office of the Attorney General. 2025-DLE-06 Additional Restrictions on CCW License Holders The enforceable list includes:
- K-12 school zones, preschools, and childcare centers
- Courthouses, state and local government offices, polling places, and police stations
- Public parks, playgrounds, youth centers, athletic facilities, zoos, museums, amusement parks, and adjacent streets and sidewalks
- Colleges and universities
- Bars and restaurants that serve alcohol, including their parking areas
- Casinos and gambling establishments
- Stadiums, arenas, and public libraries
- Airports and passenger vessel terminals
- Detention facilities and nuclear-regulated property
Six categories, including hospitals and medical facilities, public transit, and places of worship, are currently blocked by the courts and are not enforceable.7State of California – Department of Justice – Office of the Attorney General. 2025-DLE-06 Additional Restrictions on CCW License Holders The litigation is active, and any blocked category could become enforceable if the injunction is lifted. Check the California DOJ site before relying on the current list.
Federal rules apply on top of California’s. Under 18 U.S.C. 930, firearms are banned in any federal building, and separate federal law bars them from the sterile areas of airports. Your state permit does not override either. Private property owners can also prohibit firearms on their premises, and entering armed after seeing a posted no-firearms policy can expose you to trespassing charges.
Crossing State Lines
Federal law offers a safe-passage rule for interstate travel. Under 18 U.S.C. 926A, you can transport a firearm through states with restrictive laws if you can legally possess it at both your origin and destination, the firearm is unloaded during transport, and neither the gun nor ammunition is readily accessible from the passenger compartment. For vehicles without a separate trunk, the statute requires the firearm and ammunition to be stored in a locked container other than a glove compartment or console.8Office of the Law Revision Counsel. 18 USC 926A – Interstate Transportation of Firearms A motorcycle is exactly that kind of vehicle, so the federal rule mirrors California’s. Keep the firearm unloaded in a locked case, store ammunition separately, and the protection applies while you are genuinely traveling through, not during extended stops.
Your California CCW carries no weight across state lines. California has no reciprocity agreements with any other state. Once you cross, you’re subject to the destination state’s laws.
Penalties
Penal Code 25850 makes it a misdemeanor to carry a loaded firearm on your person or in a vehicle in a public place without a valid CCW, punishable by up to one year in county jail, a fine up to $1,000, or both. The charge becomes a felony if you have a prior felony conviction, the firearm is stolen and you knew it, you’re a prohibited person, or you’re not the registered owner of the handgun. Felony exposure runs from 16 months to three years of incarceration.9California Legislative Information. California Penal Code 25850 – Carrying a Loaded Firearm
Penal Code 25400 covers carrying a concealed firearm on your person or in a vehicle without complying with the locked-container rules. In the base case it’s a misdemeanor with the same one-year and $1,000 ceiling, and it becomes a felony under the same aggravating circumstances. A loaded concealed firearm carried by someone who isn’t its registered owner triggers felony exposure on its own.4California Legislative Information. Charges can also stack. A handgun stuffed loose in a saddlebag, partially visible, with a loaded magazine inside can draw a concealed-carry charge, an open-carry charge, and a loaded-firearm charge off a single stop. The locked case and the separate ammunition pouch are what prevent that.
