Yes. Since July 1, 2023, you can carry a concealed firearm in Florida without a permit, as long as you meet the same eligibility rules that previously applied to concealed weapon license applicants.1Jacksonville Sheriff’s Office. Permitless Carry in Florida Florida’s Concealed Weapon or Firearm License (CWFL) still exists and is still issued by the Florida Department of Agriculture; the law simply removed the requirement to hold one before carrying concealed. That said, carrying without the license leaves you exposed to a federal school-zone problem, blocks you from carrying in any other state, and keeps you subject to Florida’s firearm purchase waiting period.
Who Can Legally Carry Without a License
The baseline is simple: you must be at least 21 years old and a U.S. citizen or lawful permanent resident.1Jacksonville Sheriff’s Office. Permitless Carry in Florida From there, several categories of people are prohibited:
- Anyone with a felony conviction under state or federal law.
- Anyone convicted of a misdemeanor crime of domestic violence, which is also a federal disqualifier.2Florida Department of Law Enforcement. Requirements to Purchase a Firearm
- Anyone who received a withheld adjudication or suspended sentence on a violent misdemeanor, until three years after completing probation and all court-ordered conditions.1Jacksonville Sheriff’s Office. Permitless Carry in Florida
- Anyone committed for controlled substance abuse under Florida law, or who chronically uses alcohol or other substances to the point of impairment.
- Anyone adjudicated mentally incapacitated or involuntarily committed to a mental institution.1Jacksonville Sheriff’s Office. Permitless Carry in Florida
Federal law adds a few more disqualifiers that apply in Florida regardless of state law: fugitives from justice, anyone dishonorably discharged from the military, anyone subject to a qualifying domestic violence restraining order, and anyone who has renounced U.S. citizenship.3Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts
Medical Marijuana Cardholders Cannot Legally Carry
This one catches people. Marijuana remains a Schedule I controlled substance under federal law, and federal law prohibits any unlawful user of a controlled substance from possessing firearms or ammunition. There is no exception for state-legal medical use. The ATF has stated that anyone who uses marijuana, including Florida medical cardholders, is a prohibited person who may not possess firearms.4Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Open Letter to All Federal Firearms Licensees A valid state card and permitless carry status will not protect you from federal prosecution.
Where You Still Cannot Carry
Eligibility to carry is not permission to carry anywhere. Florida designates specific locations as off-limits whether or not you hold a license. Knowingly carrying into any of them is a second-degree misdemeanor.1Jacksonville Sheriff’s Office. Permitless Carry in Florida The main categories:
- Any K-12 school, college, or university facility.
- Courthouses, courtrooms, and law enforcement administration buildings.
- Polling places on election day.
- The sterile areas past airport security checkpoints.
- Meetings of a county commission, school board, city council, or special district governing body.
- Any business primarily licensed to serve alcohol for on-premises consumption.
Federal buildings add another layer the state cannot override. Firearms are prohibited in any building owned or leased by the federal government where federal employees regularly work, including post offices, Social Security offices, VA hospitals, and federal courthouses. Carrying in those buildings is a federal crime, and state carry laws provide no defense.5Office of the Law Revision Counsel. 18 U.S. Code 930 – Possession of Firearms and Dangerous Weapons in Federal Facilities
The Federal School Zone Trap
This is the single largest legal risk for permitless carriers, and most people don’t know about it. The federal Gun-Free School Zones Act makes it a crime to possess a firearm within 1,000 feet of any K-12 school. The exception that lets concealed carriers move through those zones specifically requires a state-issued concealed carry license backed by a background check verification.6Office of the Law Revision Counsel. 18 U.S. Code 922 – Unlawful Acts
Carrying under Florida’s permitless carry rules does not qualify. In practical terms, driving through a residential neighborhood with a school nearby, which is nearly unavoidable in most Florida cities, could put you in violation of federal law. The penalty is up to five years in prison. This alone pushes many Floridians to get a CWFL anyway.
What the Law Requires While You’re Armed
You must carry a valid government-issued photo ID at all times while armed and present it if a law enforcement officer asks.1Jacksonville Sheriff’s Office. Permitless Carry in Florida You are not required to volunteer that you’re carrying during a traffic stop or other encounter; you only need to disclose if the officer specifically asks.
The firearm has to stay concealed. Florida did not legalize open carry, and intentionally displaying the weapon in public, outside of self-defense, violates the open carry prohibition. Brief accidental exposure, like a shirt riding up, is not a violation as long as you are not displaying the weapon in a threatening way.7The Florida Legislature. Florida Statutes 790.053 – Open Carrying of Weapons
Penalties If You Get It Wrong
Carrying a concealed firearm when you don’t meet the eligibility criteria is a third-degree felony, punishable by up to five years in prison. Carrying a concealed weapon other than a firearm, such as a knife, under the same circumstances is a first-degree misdemeanor, punishable by up to one year in jail.8The Florida Legislature. Florida Statutes 790.01 – Unlawful Carrying of Concealed Weapons or Concealed Firearms
Carrying into a restricted location is a second-degree misdemeanor, punishable by up to 60 days in jail. Failing to produce ID when an officer asks is a noncriminal violation with a $25 fine.1Jacksonville Sheriff’s Office. Permitless Carry in Florida
Why Many Floridians Still Get the License
The CWFL program is still active, and there are concrete reasons to apply even though the law no longer requires it:
- A valid CWFL triggers the federal Gun-Free School Zones Act exception. Permitless carry alone does not.6Office of the Law Revision Counsel. 18 U.S. Code 922 – Unlawful Acts
- Florida’s CWFL is recognized by many other states through reciprocity. Permitless status under Florida law gives you no authority to carry anywhere else.
- CWFL holders are exempt from Florida’s mandatory firearm purchase waiting period of at least three days.9The Florida Legislature. Florida Statutes 790.0655 – Purchase and Delivery of Firearms; Mandatory Waiting Period; Exceptions; Penalties
- During a law enforcement encounter, a CWFL immediately shows that you’ve cleared a background check, which tends to shorten the interaction.
Traveling Out of State
Florida’s permitless carry law stops at the state line. Every state sets its own concealed carry rules, and the states that honor Florida’s CWFL generally do not extend the same recognition to someone carrying without one. Relying on permitless status after you cross a border can put you in violation of that state’s law the moment you arrive.
Federal law offers limited protection when you need to move a firearm through a restrictive state. Under the Firearm Owners Protection Act, you can transport a firearm through any state as long as you could legally possess it at both your starting point and your destination. The firearm must be unloaded and stored in a locked container separate from the passenger compartment, not in a glove box or center console.10Office of the Law Revision Counsel. 18 U.S. Code 926A – Interstate Transportation of Firearms That protection covers transport only. It does not let you carry during stops along the way.
