Can You Conceal Carry in NYC? Licenses, Restricted Places, Penalties

Concealed carry in NYC is legal only if you hold a Carry Business License issued by the New York City Police Department. No other permit works inside the five boroughs: out-of-state licenses are not recognized, and even a handgun license issued by another New York county does not authorize carrying in the city. The NYPD also issues a premises license, but that one only lets you keep a handgun at a specific home or business address and does not permit carrying in public.1Government Portal. Who Qualifies for a Carry License

New York Penal Law Section 400.00 sets the floor. You must be at least 21, though honorably discharged veterans are exempt from the age minimum, and you must either live in New York City or maintain a principal place of business there.2New York State Senate. New York Penal Law 400.00 – Licenses to Carry, Possess, Repair and Dispose of Firearms

The statute also requires “good moral character,” which the NYPD defines as having the temperament and judgment to be trusted with a weapon. That gets tested two ways. First, you submit four notarized character reference letters: two for the base application and two more specific to the carry license. References have to be lawful U.S. residents and cannot be relatives.3Government Portal. NYPD License Division – Required Documents Second, the License Division runs a background investigation that reaches well past a criminal record check, pulling arrests, summonses, domestic violence history, orders of protection, and mental health history.1Government Portal. Certain findings disqualify you automatically: a felony or “serious offense” conviction, fugitive status, addiction to a controlled substance, or involuntary commitment to a mental health facility.2New York State Senate. The Required Training Course

Before you apply, you have to complete an 18-hour firearm safety course taught by a state-authorized instructor: 16 hours of classroom instruction and 2 hours of live-fire range training. The course ends with a written exam, and you need an 80 percent to pass.5New York State Police. Minimum Standards for New York State Concealed Carry Firearm Safety Training

Course prices usually run between $100 and $350. Confirm the instructor’s state authorization before you pay. A certificate from an unauthorized provider will not be accepted with your application.

How to Apply

Applications start on the NYPD licensing portal. You upload supporting documents, including proof of city residency or business address, a birth certificate, and your training completion certificate.1Government Portal. New Application Instructions

Two fees are due upfront: a $340 non-refundable application fee and an $88.25 fingerprinting fee, both payable by credit card or money order.1Government Portal. New Application Instructions Add notary costs for your four reference letters and the training course itself, and the total before approval generally lands between $550 and $800.

Once your materials are in, the License Division schedules a fingerprinting appointment and later an in-person interview. The NYPD estimates about six months from receipt of a complete application to a decision, though many applicants wait longer.1Government Portal. New Application Instructions

Where You Still Cannot Carry

A valid license does not let you carry everywhere. New York’s Concealed Carry Improvement Act created a long list of “sensitive locations” where firearms are banned regardless of license status, and carrying in any of them is a criminal offense.6New York State Senate. New York Penal Law 265.01-E – Criminal Possession of a Firearm, Rifle or Shotgun in a Sensitive Location The list includes:

  • Government buildings used for administrative purposes, courthouses, and polling places
  • Subways, buses, trains, ferries, airports, and their stations and platforms
  • Nursery schools, preschools, K-12 schools, colleges, summer camps, and state-licensed or state-funded childcare facilities
  • Public parks, playgrounds, zoos, and the designated Times Square area
  • Hospitals, clinics, mental health facilities, and addiction services locations
  • Churches, mosques, synagogues, and other houses of worship, unless you are specifically responsible for security there
  • Any establishment licensed to serve alcohol or cannabis for on-site consumption
  • Theaters, stadiums, museums, conference centers, and banquet halls
  • Homeless shelters, domestic violence shelters, and youth shelters
  • Libraries

The density of these locations in Manhattan in particular makes a normal day of errands difficult to navigate without crossing into prohibited territory.

The Private Property Default

Outside the sensitive-location list, New York flips the usual rule for private property. The law presumes firearms are not welcome on private property unless the owner has given express permission, either through conspicuous signage saying firearms are allowed or through direct consent.7Governor.ny.gov. Governor Hochul Signs Landmark Legislation to Strengthen Gun Laws and Bolster Restrictions Most states presume the opposite: carry is fine unless a “no guns” sign is posted. In New York, silence from the property owner means no.

So if a grocery store, restaurant, or shop has not posted a sign welcoming concealed carry, you are technically violating the law by carrying inside. The burden sits on the license holder to confirm permission.

Magazine and Ammunition Limits

State law separately caps what you load into a handgun. New York prohibits any ammunition feeding device that holds more than ten rounds.8New York State Senate. New York Penal Law 265-36 – Unlawful Possession of a Large Capacity Ammunition Feeding Device If your handgun shipped with a 15-round magazine, swap it for a 10-round version before carrying in the city.

Ammunition purchases also require a background check at every point of sale under the Concealed Carry Improvement Act, not just the first time you buy.9Office of the New York State Attorney General. If You Are Just Passing Through

Federal law offers a narrow “safe passage” protection under 18 U.S.C. ยง 926A. If you can legally possess the firearm at both your origin and your destination, you may transport it through a restrictive jurisdiction as long as the gun is unloaded, locked in a container, and stored separately from ammunition outside the passenger compartment. If the vehicle has no trunk, the firearm and ammunition must sit in a locked container other than the glove compartment or center console.10Office of the Law Revision Counsel. 18 US Code 926A – Interstate Transportation of Firearms

On paper, a Pennsylvania resident driving through NYC to Connecticut with a locked, unloaded handgun in the trunk is covered. In practice, NYC law enforcement has taken a narrow view of this protection, and travelers who stop for anything beyond fuel or a breakdown face real prosecution risk. An overnight hotel stop or a sightseeing detour can void the defense because you are no longer merely transporting through.

Flying is its own category. TSA rules require firearms to travel as checked baggage only, unloaded and inside a locked hard-sided container, and you must declare the firearm to the airline at the ticket counter. Ammunition must be in its original packaging or a container designed for it and can go in the same locked case.11Transportation Security Administration. Transporting Firearms and Ammunition If your flight is canceled or you reclaim your bag for any reason, you are now holding a firearm in New York City without an NYPD license, and the federal safe-passage protection may not apply because the airport was your destination rather than a waypoint.

Renewal and Reporting Changes

A Carry Business License runs for three years. Renewal costs another $340 and must be completed before the license expires.1Government Portal. New Application Instructions A lapse is not just the loss of carry authority: possessing the handgun at all without a valid license can expose you to criminal charges. Processing times mean you should start renewal months ahead.

During the license term, you have to report changes that affect eligibility, including arrests, orders of protection, address changes, and mental health commitments. Any of those can trigger review or revocation without waiting for your renewal.

Penalties for Getting It Wrong

Carrying a loaded handgun in New York City without the proper NYPD license is Criminal Possession of a Weapon in the Second Degree under Penal Law Section 265.03, a Class C violent felony.12New York State Senate. New York Penal Law 265.03 – Criminal Possession of a Weapon in the Second Degree Sentencing falls under Penal Law Section 70.02, which sets a mandatory minimum determinate prison term of three and a half years and a maximum of fifteen years for a first-time offender with no prior felonies.13New York State Senate. New York Penal Law 70.02 – Sentence of Imprisonment for a Violent Felony Offense

The minimum is mandatory. Visitors from permissive-carry states are not exempt, and not knowing the rule is not a defense. Carrying in a sensitive location while licensed is a separate offense under Penal Law Section 265.01-e; it is charged at a lower level than unlicensed possession but still produces a criminal record and will likely cost you the license.6New York State Senate.
