Can You Conceal Carry in West Virginia Without a Permit?

You can carry a concealed handgun in West Virginia without a permit if you are at least 21 years old, a U.S. citizen or legal resident, and not otherwise barred from possessing a firearm under state or federal law.1Office of the West Virginia Attorney General. On the Mark: A Guide to Concealed Handgun Laws in West Virginia This is often called “constitutional carry.” No application, training course, background check, or registration is required to carry on your person or inside a vehicle. The rest of this article is about the limits that still apply: who is excluded, where carry remains illegal, what the penalties look like, and why many carriers still choose to hold a license.

Who Qualifies

Four conditions must all be true:

  • You are at least 21 years old.
  • You are a U.S. citizen or legal resident.
  • You are legally allowed to possess a firearm under West Virginia law.
  • You are not prohibited under federal law.

The rule applies the same way to West Virginia residents and to visitors from other states, as long as each person meets all four requirements.1Office of the West Virginia Attorney General. On the Mark: A Guide to Concealed Handgun Laws in West Virginia Open carry is a separate matter and remains legal for anyone who can lawfully possess a firearm.

Who Is Prohibited Regardless

Permitless carry does not override federal firearm prohibitions. Under the Gun Control Act, you cannot possess a firearm or ammunition if you fall into any of these categories:

  • You have a felony conviction, meaning any crime punishable by more than one year of imprisonment.
  • You are a fugitive from justice.
  • You unlawfully use or are addicted to a controlled substance.
  • You have been committed to a mental institution or adjudicated as mentally defective.
  • You are in the country without legal status.
  • You received a dishonorable discharge from the U.S. Armed Forces.
  • You have renounced your U.S. citizenship.
  • You are subject to a qualifying protective order restraining you from harassing, stalking, or threatening an intimate partner or that partner’s child.
  • You have a misdemeanor domestic violence conviction.

Possessing a firearm as a prohibited person is a federal crime, and West Virginia’s permitless carry law does nothing to change that.2Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons

Where You Still Cannot Carry

Permitless carry is not carry-anywhere. Several location-based restrictions remain in force.

Schools and School Functions

You cannot possess a firearm on a school bus, in or on the grounds of any public or private primary or secondary school, or at a school-sponsored function held in a space controlled by a school board or the state Department of Education for the duration of the event.3West Virginia Legislature. West Virginia Code 61-7-11A Private schools may adopt written policies allowing firearms on their premises; public schools cannot.

A narrow vehicle exception exists, but only for licensed holders. If you are 21 or older and hold a valid West Virginia Concealed Handgun License, you may keep a concealed handgun in your vehicle in a school parking lot or traffic circle, as long as it is stored out of view while you are in the vehicle and locked in a trunk, glove box, interior compartment, or locked container when you leave.1Office of the West Virginia Attorney General. On the Mark: A Guide to Concealed Handgun Laws in West Virginia Permitless carriers without a license do not get this exception. The safe practice without a CHL is to leave the firearm at home on school days.

Courthouses, the Capitol, and Federal Buildings

Firearms are prohibited in facilities housing a court of law or family law court.3West Virginia Legislature. West Virginia Code 61-7-11A The State Capitol Complex has its own restrictions. Federal buildings such as post offices and federal courthouses are off-limits under federal law whether or not you hold a state license.

Private Property

Property owners decide what happens on their land. Walking onto posted property with a concealed firearm is not itself a crime. The offense occurs when the owner or the person in charge asks you to leave or to hand over the weapon and you refuse. That refusal is a misdemeanor punishable by up to $1,000 in fines, up to six months in jail, or both.4West Virginia Legislature. West Virginia Code 61-7-14

A separate protection runs the other way for parking lots. Property owners cannot prohibit customers, employees, or visitors from keeping a lawfully possessed firearm locked and out of view inside a vehicle in their parking lot, and they cannot even ask whether a firearm is in a locked vehicle.1Office of the West Virginia Attorney General. What a Violation Costs

Penalties vary sharply by location, and the school rule is the one that catches people off guard.

Possessing a firearm on school grounds is a felony. A conviction carries two to ten years in a state correctional facility, a fine of up to $5,000, or both.5Office of the West Virginia Attorney General. Locations in West Virginia Where Firearms Are Forbidden or Restricted This is where the licensed-holder vehicle exception matters most. Without a CHL, there is no lawful way to have a firearm on school property.

Refusing to leave or surrender a weapon on private property after being asked is a misdemeanor with up to $1,000 in fines and up to six months in jail.4West Virginia Legislature. West Virginia Code 61-7-14

For a person under 21 carrying concealed without a provisional license, a first offense is a misdemeanor with a fine of $100 to $1,000 and up to twelve months in jail. A second or later offense becomes a felony with one to five years in prison and fines of $1,000 to $5,000.6West Virginia Legislature. West Virginia Code 61-7-3

If You Are 18, 19, or 20

Permitless carry starts at 21. Adults aged 18 through 20 cannot carry concealed in West Virginia unless they obtain a Provisional Concealed Handgun License through their county sheriff’s office.7West Virginia Legislature. West Virginia Code 61-7-4a

The application calls for proof of West Virginia residency with a valid driver’s license or state photo ID, and completion of a handgun safety course that includes live fire. Qualifying courses include any official NRA handgun safety course, a course offered by a law enforcement agency or college, or one taught by an NRA-certified or state-certified instructor. Current or former military service also satisfies the training requirement.8West Virginia Legislature. West Virginia Code – Dangerous Weapons The total statutory cost is $30: a $15 application fee to the sheriff and a $15 fee for the State Police background check. The provisional license stays valid until you turn 21, when permitless carry takes over automatically.7West Virginia Legislature. West Virginia Code 61-7-4a

One pending change is worth tracking. In February 2026, the West Virginia Senate passed Senate Bill 30, which would let 18-to-20 year olds carry concealed without a provisional license. The bill moved to the House of Delegates and had not been signed into law.9Wrap Up: Official Blog of the West Virginia Legislature. Senate Passes No Conceal Carry Permit for 18- to 20-year-olds Until it becomes law, the provisional license requirement stands.

Why Some People Still Get a License

West Virginia continues to issue standard Concealed Handgun Licenses to residents 21 and older, and a license carries two practical benefits that permitless carry does not.

The first is reciprocity. Many other states recognize a West Virginia CHL but do not honor permitless carry from another state. Without a license, you may be legal in West Virginia and committing a crime the moment you cross certain state lines. The West Virginia State Police maintain the official reciprocity list and the Attorney General’s office publishes a reciprocity map, both of which are worth checking before any trip, because recognition can change and some states treat nonresident licenses differently.10Office of the WV Attorney General John B. McCuskey. Gun Reciprocity Information

The second is the federal background check exemption. A valid standard CHL can substitute for the NICS check when buying a firearm from a licensed dealer. A provisional license does not carry that benefit; its face explicitly states that a NICS check must still be performed. The resident license fee is $50, paid to the sheriff at application.11West Virginia Legislature. Enrolled Senate Bill 147 The school parking lot exception described earlier is a third reason people hold onto their license.

Traffic Stops and Encounters With Police

West Virginia law does not require you to tell an officer you are carrying. There is no statutory duty to volunteer that information at a traffic stop or any other encounter. Absence of a duty, though, is not advice to stay silent. The State Police note that an unconcealed weapon in a vehicle will immediately draw the officer’s attention and may lead them to draw their own weapon, order you out, or conduct a pat-down.12West Virginia State Police. Frequently Asked Questions Calmly telling the officer up front, keeping your hands visible, and following instructions tends to make the stop go smoothly.

Carrying Is Not the Same as Using

Being allowed to carry does not settle when you may use the firearm. West Virginia recognizes both the castle doctrine and stand-your-ground, so you generally have no duty to retreat before using force in self-defense.

Inside your home, you may use deadly force against an intruder if you reasonably believe the intruder could kill or seriously injure you or others in the home, or if you reasonably believe the intruder intends to commit a felony and deadly force is necessary to stop them.13West Virginia Legislature. West Virginia Code 55-7-22 – Civil Relief for Persons Resisting Certain Criminal Activities

Outside your home, if you are in a place you have a legal right to be and are not engaged in unlawful activity, you may use deadly force without retreating if you reasonably believe you or someone else faces imminent death or serious bodily harm that can only be stopped with deadly force.13West Virginia Legislature. West Virginia Code 55-7-22 – Civil Relief for Persons Resisting Certain Criminal Activities The operative words are “reasonable” and “imminent.” A generalized fear, or a threat that has already passed, will not meet this standard, and drawing a firearm when the facts do not support an imminent deadly threat can bring criminal charges no matter how lawfully you were carrying it.
