You can drive in California with a foreign license as long as you are a non-resident visitor, your license is valid and in your possession, and you are at least 18. There is no day limit on this. What ends the privilege is not time but action: the moment you do something that makes you a California resident, you have 10 days to apply for a California driver’s license.
Driving as a Visitor
California Vehicle Code section 12502 lets any non-resident over 18 drive in the state on a valid license issued by their home country.1California Legislative Information. California Vehicle Code 12502 A tourist here for three weeks and a consultant here for a six-month project are both covered, provided neither one takes a step that establishes residency. The license must be current, not expired, and you must have the physical card on you every time you drive.
Commercial drivers moving hazardous materials sit under separate rules, including a minimum age of 21 and the appropriate endorsements.1California Legislative Information. California Vehicle Code 12502
Do You Need an International Driving Permit?
California does not require foreign visitors to carry an International Driving Permit. It is still one of the most practical documents you can bring. An IDP translates your license into several languages, including English, which makes a traffic stop or a rental counter much easier to navigate. If your home license is printed in a non-Latin script, treat an IDP as close to essential in practice even though it is not required by law.
An IDP is valid for one year from the date it is issued and must be carried together with your original license, never in place of it.2AAA. International Driving Permit You have to get it in your home country before you travel; it cannot be issued to you in the United States. The U.S. recognizes IDPs issued under the 1949 Geneva Convention on Road Traffic.3UN Treaty Collection. Convention on Road Traffic
Insurance You Have To Carry
Everyone who drives in California must carry proof of financial responsibility, no matter where the license came from.4California Legislative Information. California Vehicle Code 16020 As of January 1, 2025, the minimum liability coverage is:
- $30,000 for bodily injury or death per person
- $60,000 for bodily injury or death per accident
- $15,000 for property damage per accident
These limits doubled from the prior minimums under legislation that took effect at the start of 2025.5California Department of Insurance. New Year Means New Changes for Insurance If you are renting, buying coverage through the rental agency is the simplest route because it lasts for the rental period. If you are borrowing a car or staying longer, some insurers write temporary policies for stays under six months, and non-owner liability policies are available for drivers who regularly use someone else’s vehicle.
Renting a Car With a Foreign License
Major rental companies will generally rent to foreign license holders, but they layer their own requirements on top of California’s. Expect to show your valid foreign license and your passport, and expect to pay with a credit or debit card in the renter’s name. If your license is not in English, bring an IDP; agencies may refuse the rental if staff cannot read your license.
Age minimums vary by company and location. Most require renters to be at least 20, though some set the floor at 18 or 19. Drivers under 25 usually pay a daily young-driver surcharge and may be shut out of premium vehicle categories. These are company policies, not state law, so confirm the specifics with your provider before you book.
When You Become a California Resident
The visitor exemption ends the moment you become a California resident. Residency does not turn on how many days you have been here. It turns on specific acts that show your presence is more than temporary. Vehicle Code section 12505 lists the main triggers:
- Registering to vote at a California address
- Paying resident tuition at a California public college or university
- Filing for a homeowner’s property tax exemption on California property
- Any other act showing your stay is more than temporary, which in practice includes signing a long-term lease or accepting permanent employment
Once a trigger occurs, you have 10 days to apply for a California driver’s license. The employment trigger carries an extra catch that surprises people: if you accept employment in California, you cannot drive for work purposes at all until you have your California license. The 10-day grace period does not cover driving on the job.6California Legislative Information. California Vehicle Code 12505
If you brought a vehicle with you, a related clock applies to the car itself. A foreign-plated vehicle is fine to drive while you are a non-resident, but once you become a resident or accept employment, you have 20 days to register it with the California DMV.7State of California Department of Motor Vehicles. New California Resident Portal Permanently importing a car also means meeting federal emissions and safety standards, which is a serious hurdle for vehicles not originally built for the U.S. market.
Applying for the California License
You apply in person at a DMV office. The fee for an original Class C license is $46.8State of California Department of Motor Vehicles. Licensing Fees Bring your existing foreign license; the DMV will also collect any previously issued U.S. state license or permit you hold.9California Department of Motor Vehicles. Documents
For a REAL ID-compliant license, which you will want if you plan to board domestic flights or enter federal buildings, the DMV asks for documents in three categories:
- One identity document. For most foreign nationals this is an unexpired foreign passport with a valid U.S. visa and an approved I-94.
- Two different proofs of California residency, such as a lease agreement plus a utility bill.
- Proof of your Social Security number: the card itself, a W-2, or a pay stub showing the full number. If you are not eligible for an SSN, bring a denial letter from the Social Security Administration.
Tests
At the office you will take a vision screening, which requires at least 20/40 acuity with both eyes together.11Legal Information Institute. 13 CCR 20.03 – Vision Screening You will also take a written knowledge test covering California traffic laws and road signs. The California Driver Handbook is published online and is worth studying because the rules often differ from what you learned at home.
Most applicants transferring from a foreign license also have to pass a behind-the-wheel driving test.9California Department of Motor Vehicles. FFDL 5 – Requirements for a California Driver License You have to bring a vehicle for the test, along with proof of insurance on it. If you do not own a car yet, some driving schools offer packages that include a car for the DMV road test.
International Students and Exchange Visitors
If you are in California on an F-1 student visa or a J-1 exchange visa, you sit in a middle ground. You may be physically present for years without becoming a “resident” for driver’s license purposes, as long as you keep your foreign domicile. Many international students drive on their home-country license for their entire program, and that is common. The residency triggers above still apply, though: a lease signed, a voter registration filed, or similar steps toward permanence can shift you into resident status.
If you do apply for a California license, your SEVIS record has to be in Active status, and you will need your Form I-20 (F or M visa) or Form DS-2019 (J visa) in addition to the standard documents.12U.S. Immigration and Customs Enforcement. Applying for a Driver’s License or State Identification Card California may also require at least six months remaining on your I-20 or DS-2019. Check with your school’s international student office before you go, since they can confirm your SEVIS status and help you assemble the paperwork.
Penalties for Driving Without a Valid License
Driving without a valid license violates Vehicle Code section 12500, and the statute catches both residents who missed the 10-day window and visitors whose foreign license has expired.13California Legislative Information. California Vehicle Code 12500 It can be charged as an infraction or as a misdemeanor, depending on the circumstances and your history.
As an infraction, the fine runs up to $250, plus mandatory court assessments that typically multiply the base fine several times over. As a misdemeanor, it carries up to six months in county jail, a fine of up to $1,000, and a criminal record. For a driver who has never been issued any license, the vehicle can be impounded for 30 days at the owner’s expense.14California Legislative Information. California Vehicle Code 14602.6
Immigration Consequences
For non-citizens, a misdemeanor conviction reaches beyond the fine. It can affect visa renewals, applications for permanent residency, and eligibility for programs like Temporary Protected Status. Federal immigration authorities have denied TPS benefits to applicants with two or more misdemeanor convictions, including convictions for driving without a license, with no waiver available. Even a single misdemeanor creates a record you will have to disclose on future immigration applications. If you are cited for a licensing violation, talking to an immigration attorney before you enter a plea is worth the cost.
