Driving to school with a junior license on Long Island is only allowed without a supervising driver for a narrow set of educational programs, and a regular daytime high school is not one of them. Which School Trips You Can Drive to Alone
New York’s graduated license law lists specific educational programs a Long Island junior driver may drive to and from unsupervised, at any hour, as long as the route is direct between home and the program:
- A state-approved cooperative work-study program
- An approved program for credit at a post-secondary institution (college or university)
- A state-approved registered evening high school
- An approved driver education course
- Farm employment
If your “school” is a community college class, a registered evening high school, a state-approved work-study placement, or a driver ed course, you can drive yourself there and back on your own, even after 9 PM, provided you go directly.2New York State Department of Motor Vehicles. Why Regular Daytime High School Is Not on the List
This is where most families get tripped up. A standard 7 AM to 3 PM high school schedule does not appear anywhere in the statute’s list of approved unsupervised trips for Long Island drivers. The law names post-secondary institutions, registered evening high schools, work-study programs, and driver education. It does not name regular high school.1New York State Senate. The rest of upstate New York uses a broader rule that lets junior license holders drive to and from “school” more generally. Long Island’s provision is written more narrowly, with that specific list of programs instead of the general term. If your school day is a normal daytime high school schedule, the unsupervised exception does not apply to you.
Driving to High School With a Supervising Driver
To get yourself to a regular high school by car under a junior license on Long Island, you need someone in the front passenger seat who qualifies as a supervising driver. On Long Island, that person has to be one of the following:
- A parent or legal guardian
- A person standing in loco parentis, meaning someone who has taken on parental responsibilities on a regular, extended basis due to the natural parent’s death, disability, or absence
- A person authorized in writing by your parent, guardian, or person in loco parentis
- A driver education teacher or driving school instructor
The supervising driver must be at least 21 and hold a valid license for the type of vehicle being driven. Supervised driving is only permitted between 5 AM and 9 PM. That window covers a normal school day comfortably, but a late supervised trip home from an evening event is not legal on Long Island unless the destination is on the unsupervised approved list.1New York State Senate. School Events, Games, and Clubs Don’t Count
Even for programs that do qualify, the exception is limited to the academic program itself. New York defines “school” for this purpose as instruction, education, or training that is licensed or approved by a state department or agency, or training conducted by the U.S. Armed Forces. Extracurricular activities, sports, and social events where no scholastic credit is awarded are explicitly excluded from the definition.2New York State Department of Motor Vehicles. Practically, this means you cannot drive yourself unsupervised to a football game, a club meeting, or a school dance, even at a campus where you take a qualifying class. Those trips need a supervising driver and have to happen inside the 5 AM to 9 PM window.
Passengers Under 21
One more rule that affects the school ride: a junior license holder on Long Island cannot carry more than one passenger under age 21 unless the additional passengers are members of your immediate family. Piling classmates into the car for the morning drive to school runs into this rule quickly.
Penalties for Driving to School Outside the Rules
The DMV lists failure to follow junior driver rules as a common cause of license suspension.3New York State Department of Motor Vehicles. Suspensions and Revocations A first conviction for violating the time, passenger, or purpose restrictions on a Class DJ license results in a 60-day suspension. A conviction for a serious traffic violation, meaning any violation carrying three or more points, also triggers a 60-day suspension. Handheld phone and texting convictions are treated more harshly still: a first conviction results in a 120-day suspension of the junior license. For a student who depends on driving to reach an approved school program, that suspension leaves few legal options during the suspension period.
