You can physically get through LAX with a California-legal amount of marijuana on a domestic flight, and Los Angeles Airport Police have publicly said they won’t arrest you for it, but every layer above them (LAWA’s own rules, TSA screening protocol, and federal law in the air) still prohibits it. So the honest answer to whether you can fly out of LAX with marijuana is: usually yes in practice on a domestic flight within state limits, no on paper, and no in any meaningful sense on an international one.
The Gap Between LAX’s Rules and Its Policing
The LAWA Rules and Regulations state that “all controlled substances, including marijuana are strictly prohibited on LAWA property.”1Los Angeles World Airports. The Los Angeles Airport Police Division has posted a separate policy saying its officers “have no jurisdiction to arrest individuals if they are complying with state law,” meaning adults 21 and over carrying up to 28.5 grams of flower or 8 grams of concentrate.2Los Angeles World Airports. LAX Marijuana Policy You’re technically violating airport rules the moment you step on the property with cannabis, but the officers who would encounter you have said they won’t treat state-legal amounts as an arrestable offense.
What Happens if TSA Spots It
TSA screeners aren’t hunting for marijuana. The agency states plainly that “TSA security officers do not search for marijuana or other illegal drugs.”3Transportation Security Administration. Medical Marijuana But if a screener notices cannabis while looking for something else, they are required to refer the matter to law enforcement.
At LAX that referral goes to Airport Police. Given APD’s stated position, the responding officer will typically check whether you’re within California’s limits. If you are, the most common outcome people report is a brief conversation and a wave through. If you’re over the limit, the situation changes fast: possession of more than 28.5 grams of flower is a misdemeanor under California Health and Safety Code Section 11357, carrying up to six months in jail and a $500 fine.

California’s Possession Limits
APD’s hands-off approach only applies if you’re within state law. The limits for adults 21 and older:
- Up to 28.5 grams (about one ounce) of dried flower.
- Up to 8 grams of concentrated cannabis, including vape cartridges and wax.
- Edibles count within the overall possession limits.

Federal Law Still Applies in the Air
Marijuana is a Schedule I controlled substance under the federal Controlled Substances Act, alongside heroin and LSD.5Office of the Law Revision Counsel. 21 USC 812 – Schedules of Controlled Substances The federal government has exclusive sovereignty over U.S. airspace, so the second cannabis is on a plane the offense is federal.6Office of the Law Revision Counsel. 49 US Code 40103 – Sovereignty and Use of Airspace
Under 21 U.S.C. ยง 844, a first simple-possession offense carries up to one year in prison and a minimum $1,000 fine, with penalties escalating for repeat offenses.7Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession Federal prosecutors have shown little interest in charging individual passengers over personal amounts at airports in legal states, but the authority is there. Larger quantities, distribution-style packaging, or cannabis paired with a lot of cash puts you in a different conversation entirely.
Hemp and CBD Are Treated Differently
The 2018 Farm Bill removed hemp from the Controlled Substances Act, defining it as cannabis with no more than 0.3 percent THC on a dry weight basis.8Congress.gov. The practical issue is proof. A clearly labeled CBD product from a licensed retailer showing THC content will move through easily. An unmarked tincture won’t, and if a screener can’t tell what it is, expect the same law enforcement referral you’d get for marijuana.
Where You’re Landing Changes the Risk
Clearing LAX is only half the trip. The destination state’s law applies the moment you step off the plane. Landing in another legal-recreational state with a personal amount is unlikely to cause issues, though you were violating federal law throughout the flight. Landing in Idaho, Kansas, South Carolina, or another prohibition state with cannabis in your bag can mean criminal charges on arrival, and local airport police have no obligation to consider California’s rules.
International Flights: Don’t
Everything about domestic enforcement changes at the international terminal. Foreign nationals face an added consequence. Under the Immigration and Nationality Act, anyone found to have violated federal or state controlled substance laws can be deemed inadmissible and barred from future entry, and that finding can attach even to admitting past use during a customs interview.9U.S. Customs and Border Protection.
