Can You Gamble Online in Florida? What the Law Says

Online gambling in Florida is legal in two forms: sports betting through Hard Rock Bet, which has an exclusive statewide license, and pari-mutuel wagering on horse races through licensed advance deposit platforms. Online casino games, real-money poker, and most other internet wagering are prohibited under state law. Daily fantasy sports and sweepstakes-style casinos operate in gray zones that the state has not actively enforced against. Because Florida has no state income tax, your winnings are only taxed at the federal level, but federal rules changed in 2026 in ways that affect anyone who gambles seriously.

Sports Betting: Hard Rock Bet Only

Hard Rock Bet is the only legal mobile sportsbook in Florida. It launched statewide on December 7, 2023, under the 2021 Gaming Compact between the state and the Seminole Tribe, which the Legislature ratified at § 285.710.1Official Internet Site of the Florida Legislature. Florida Code 285.710 – Indian Reservations and Affairs The compact uses a hub-and-spoke structure, treating every mobile bet as if it occurs on tribal land because the servers sit on Seminole property. That is what allows one app to take wagers anywhere in the state.

No other sportsbook, whether a national brand or a smaller operator, can legally take your bet in Florida. The Tribe holds exclusive rights under a 30-year compact, and if any court or federal agency ever invalidates the exclusivity, the entire compact collapses.1Official Internet Site of the Florida Legislature. Florida Code 285.710 – Indian Reservations and Affairs A federal challenge from a parimutuel competitor reached the U.S. Supreme Court, which in October 2023 denied the application for a stay and allowed the Tribe to resume operations.2Supreme Court of the United States. 23A315 West Flagler Associates, Ltd. v. Haaland

To bet, you must be at least 21 and physically inside Florida.3Florida Legislature. Chapter 2021-268 – Implementation of the 2021 Gaming Compact The app uses geofencing to confirm your location. Attempting to spoof the geofence or otherwise work around the system can lead to account closure and loss of your balance.

Online Horse Race Wagering

Betting on horse races through an app is legal and is the oldest form of regulated online wagering in Florida. Section 550.3551 authorizes pari-mutuel wagering on races broadcast into and out of the state and requires compliance with the federal Interstate Horseracing Act.4Official Internet Site of the Florida Legislature. Florida Statutes 550.3551 – Transmission of Racing and Jai Alai Information; Commingling of Pari-Mutuel Pools

Under the federal statute, an advance deposit wagering platform can accept your bets on races nationwide, but only when the host track, the host state’s racing commission, and Florida’s racing commission have each consented.5Office of the Law Revision Counsel. 15 USC Chapter 57 – Interstate Horseracing The major ADW apps handle those approvals in the background. The Florida Gaming Control Commission oversees these operators. Unlike sports betting, horse race wagering is not limited to a single provider.

Online Casinos and Poker Are Illegal

Real-money online slots, blackjack, roulette, and poker are prohibited. Florida’s general gambling statute makes it a second-degree misdemeanor to play any game of chance for money, in person or online.6Florida Senate. Florida Code 849.08 – Gambling A conviction carries up to 60 days in jail and a maximum $500 fine.7Official Internet Site of the Florida Legislature. Florida Statutes 775.083 – Fines

No Florida law authorizes any company to run a state-licensed online casino. The Seminole Tribe operates physical casinos on its reservation properties, but those rights don’t extend to online casino play. Any site offering real-money casino games or poker to Florida residents is operating offshore and sits outside the Florida Gaming Control Commission’s reach.8Florida Senate. Florida Statutes 16.712 – Florida Gaming Control Commission Authorizations, Duties, and Responsibilities

The practical risks of using an offshore site are bigger than the criminal statute. Federal law requires banks and payment processors to block transactions tied to unlawful internet gambling, so deposits and withdrawals through U.S. accounts often get declined or frozen.9eCFR. Part 233 Prohibition on Funding of Unlawful Internet Gambling (Regulation GG) And if the site refuses to pay out or disappears, Florida courts and regulators can’t help you. Most people who lose money on these platforms lose it that way, not through prosecution.

Daily Fantasy Sports: A Real Gray Area

DraftKings, FanDuel, and similar daily fantasy platforms operate in Florida, but their legal status is genuinely unsettled. The state has never passed a law specifically authorizing or regulating paid daily fantasy contests. The operators argue that building a lineup is a game of skill, which would place it outside the gambling prohibitions.

The complication: § 849.14 doesn’t only prohibit bets on games of chance. It also makes it a misdemeanor to bet on any contest of skill, speed, or endurance.10Florida Senate. Florida Statutes 849.14 – Unlawful to Bet on Result of Trial or Contest of Skill, Etc. The Florida Attorney General issued an advisory opinion raising the possibility that paid daily fantasy contests fall within that statute.11My Florida Legal. Gambling / Fantasy Sports League Even so, the state has not prosecuted individual players or taken enforcement action against the major operators, and the platforms continue to offer large-prize contests to Florida residents. Because no licensing framework exists for daily fantasy, these operators don’t pay state gaming taxes, and the arrangement could change if the Legislature decides to regulate or ban the activity.

Social and Sweepstakes Casinos

Social and sweepstakes casinos offer casino-style games without triggering the gambling statutes, because they strip out one of the three legal ingredients of gambling: prize, chance, and consideration. Remove consideration, meaning payment for the chance to win, and it is not gambling in the legal sense.

Sweepstakes casinos provide free entries to every user. You get virtual coins for signing up or logging in. You can buy additional “social” coins for entertainment, and those purchases come bundled with bonus sweepstakes entries at no extra charge. The sweepstakes entries are what can be redeemed for cash or gift cards. Federal rules reinforce the model: a lawful sweepstakes must allow free entry, and a purchase cannot improve your odds of winning.12USPIS.gov. A Consumers Guide to Sweepstakes and Lotteries

Legitimate operators also offer an alternative free entry method, usually a mail-in request. If a site forces you to pay before you can play, it is probably not operating a lawful sweepstakes model.

When Your Bank Blocks the Payment

The Unlawful Internet Gambling Enforcement Act of 2006 targets the money rather than the player. Banks, card issuers, and payment processors must maintain policies to identify and block financial transactions connected to unlawful internet gambling.9eCFR. Part 233 Prohibition on Funding of Unlawful Internet Gambling (Regulation GG) This is why a credit card deposit to an offshore site often gets declined. Your bank is following a federal regulation, and institutions that block these transactions are shielded from liability, so disputing the block will not change the outcome.

The Federal Wire Act is the other federal piece. It prohibits anyone in the gambling business from using interstate wire communications to transmit bets on sporting events, with violations carrying up to two years in federal prison.13Office of the Law Revision Counsel. 18 USC 1084 – Transmission of Wagering Information; Penalties It is one reason Hard Rock Bet’s servers sit on tribal land inside Florida rather than out of state.

Taxes on Florida Gambling Winnings

Every dollar you win is taxable at the federal level, whether it comes from Hard Rock Bet, a horse racing app, a sweepstakes payout, or a daily fantasy contest. The IRS treats gambling winnings as ordinary income. Florida has no state income tax, so there is nothing owed to the state, but the federal obligation applies to all winnings regardless of whether a form is issued.

Reporting and Withholding in 2026

Starting in 2026, the IRS set the threshold for issuing a Form W-2G at $2,000, replacing the older thresholds that varied by game type. The amount will be adjusted for inflation annually.14Internal Revenue Service. Instructions for Forms W-2G and 5754 (01/2026) For sports wagers, horse racing bets, and most other wagers, a W-2G is required only when winnings reach $2,000 and are at least 300 times the amount wagered.

Withholding is a separate trigger. Operators must withhold 24% of your winnings when the payout minus your wager exceeds $5,000 from sports bets, sweepstakes, lotteries, or pari-mutuel wagers that hit the 300-to-1 ratio.14Internal Revenue Service. Instructions for Forms W-2G and 5754 (01/2026) Even when no form is issued and nothing is withheld, you still have to report the income.

The 90% Loss Deduction Rule

The One Big Beautiful Bill Act, signed into law on July 4, 2025, changed how gamblers deduct losses. For the 2026 tax year and beyond, you can deduct only 90% of your gambling losses against your winnings, down from the previous 100%. The deduction remains capped at the amount of your winnings; losses can never offset other income.

In practice: if you win $201,000 and lose $200,000, you might expect to owe tax on $1,000. Under the new rule, your deductible losses are $180,000, so you pay tax on $21,000 of gambling income. For casual bettors, the hit is small. For higher-volume players, it is a meaningful cost.

The deduction is also only available if you itemize. Roughly 86% of taxpayers take the standard deduction instead, and anyone in that group pays federal tax on every dollar of gambling winnings with no offset for losses at all.
