In California, you generally cannot be fired for calling in sick when you are using legally protected sick leave. State law gives most workers at least 40 hours (five days) of paid sick leave a year, and firing, demoting, or otherwise punishing someone for using it is retaliation, even though California is an at-will employment state.1California Department of Industrial Relations. Healthy Workplace Healthy Family Act of 2014 (AB 1522) The protection is strong, but it has edges, and knowing where they are is what keeps you from losing your job or your claim.
What the Law Actually Protects
The Healthy Workplaces, Healthy Families Act covers full-time, part-time, and temporary employees who have worked for the same employer for at least 30 days in a year. You accrue one hour of paid sick leave for every 30 hours worked, and you can use at least 40 hours or five days per year, whichever is greater. Employers can cap accrual at 80 hours or ten days, and unused time carries into the next year up to that cap.1California Department of Industrial Relations. Healthy Workplace Healthy Family Act of 2014 (AB 1522)
You can use the leave for your own illness, preventive care such as a doctor’s appointment, or to care for a sick family member. California’s kin care law requires any employer that provides sick leave to let you use at least half of your annual accrual for a family member.2California Legislative Information. California Labor Code 233
The piece that most directly answers the question: your employer cannot fire you, demote you, cut your hours, or discipline you for using accrued sick leave. If any of that happens within 30 days of you using sick leave, the law presumes it was retaliatory, and your employer has to prove the action had nothing to do with your leave.1California Department of Industrial Relations. Healthy Workplace Healthy Family Act of 2014 (AB 1522) Your employer also cannot require you to find someone to cover your shift before you take sick time.
When You Can Still Be Fired
California is an at-will state, which means your employer can end your job at any time for any lawful reason.3California Legislative Information. California Labor Code 2922 Sick leave protection is a hard limit on that power, not a cancellation of it. A few situations where a termination after calling in sick may still be lawful:
- You used sick time you had not actually accrued, or you took unpaid days off without any protected-leave basis.
- You did not follow a reasonable call-in procedure that applies to everyone, and the absence was not an emergency.
- You have exhausted your paid sick leave and do not qualify for extended leave under another law, and your absences have become excessive under a neutral attendance policy.
- The employer can prove the termination was for a legitimate reason unrelated to the leave, such as a documented performance or misconduct issue predating the absence.
The last one is where the 30-day presumption matters most. The timing alone shifts the burden onto the employer to show the real reason.
How to Call In the Right Way
For a scheduled medical visit, give advance notice. For a sudden illness, you only need to tell your employer as soon as it is practical.4California Department of Industrial Relations. California Paid Sick Leave: Frequently Asked Questions If you are getting emergency treatment, you are not expected to follow the normal call-in process until your condition stabilizes and you are able to use a phone. Someone else can notify your employer on your behalf when you cannot.5eCFR. 29 CFR 825.303 – Employee Notice Requirements for Unforeseeable FMLA Leave
How much medical detail do you owe? For ordinary paid sick leave, very little. Your employer can ask for a doctor’s note only if the same rule applies to everyone. Under the Americans with Disabilities Act, your employer generally cannot ask whether you have a disability, demand a diagnosis, ask about your medications, or request your full medical records.6U.S. Equal Employment Opportunity Commission. Enforcement Guidance on Disability-Related Inquiries and Medical Examinations of Employees Under the ADA If you are requesting extended leave under FMLA or CFRA, you do have to give enough information for your employer to recognize that the leave may qualify, but you still do not have to disclose a diagnosis. Saying something like “I have a serious condition that needs treatment” or “I need to care for my hospitalized parent” is enough to put the employer on notice.5eCFR. 29 CFR 825.303 – Employee Notice Requirements for Unforeseeable FMLA Leave
Keep records. Save your call-in text, the email you sent, the voicemail timestamp. If you later have to prove you followed the rules, that paper trail is the case.
When Five Sick Days Is Not Enough
Paid sick leave does not cover a hospitalization, surgery recovery, chronic condition flare-ups, or caring for a seriously ill family member for weeks at a time. Three other laws take over at that point, and each creates its own protection against being fired.
CFRA and FMLA
The California Family Rights Act and the federal Family and Medical Leave Act both give eligible employees up to 12 weeks of unpaid, job-protected leave in a 12-month period for a serious health condition, their own or a family member’s. When you return, your employer has to put you back in the same position or an essentially identical one.7U.S. Department of Labor. Fact Sheet 28H – 12-Month Period Under the Family and Medical Leave Act
CFRA applies at employers with five or more employees.8California Legislative Information. California Government Code 12945.2 FMLA kicks in only at employers with 50 or more employees within a 75-mile radius.7U.S. Department of Labor. Fact Sheet 28H – 12-Month Period Under the Family and Medical Leave Act Many Californians at smaller companies have CFRA protection without being eligible for FMLA. Under either law, you need at least 12 months of service and 1,250 hours worked in the year before the leave.
A serious health condition includes an overnight hospital stay, an incapacity of more than three consecutive calendar days that also involves ongoing treatment, and chronic conditions like asthma, diabetes, or epilepsy that cause recurring episodes.9eCFR. 29 CFR 825.115 – Continuing Treatment You can take the leave intermittently, in days or partial days, when medically necessary for things like chemotherapy, dialysis, or flare-ups.10U.S. Department of Labor Wage and Hour Division. FMLA Opinion Letter FMLA2026-2 If you have a valid medical certification for intermittent leave, your employer has to honor it. Scrutinizing your attendance more closely than others’, writing you up for protected absences, or pressuring you into a continuous block instead can itself be retaliation.
Pregnancy Disability Leave
Pregnancy has its own protection in California, separate from CFRA. You can take up to four months of leave for any period you are actually disabled by pregnancy, childbirth, or a related condition, and the leave is per pregnancy rather than per year.11California Legislative Information. California Government Code 12945 Once your doctor clears you, you can then use CFRA leave to bond with your new child. An employer with five or more workers must provide both.
Disability Accommodation Leave
If your illness qualifies as a disability, California’s Fair Employment and Housing Act requires your employer to provide a reasonable accommodation unless it would cause real hardship. A leave of absence for treatment or recovery can itself be a reasonable accommodation, and this applies even after you have used up your CFRA or FMLA weeks.12Cornell Law School. Cal. Code Regs. Tit. 2, 11068 – Reasonable Accommodation Before firing someone whose disability requires time off, the employer must engage in a good-faith interactive process to see whether leave or some other accommodation would work.13California Legislative Information. California Government Code 12940 Skipping that conversation is itself a FEHA violation. Blanket “100 percent healed” return-to-work policies are also prohibited; the employer has to assess individually whether you can do your essential job duties with or without accommodation.
Workers’ Compensation
If you are out because of a job injury, a separate rule applies. California makes it a misdemeanor for an employer to fire or discriminate against you because you filed a workers’ compensation claim or signaled your intention to file one. A retaliated-against employee is entitled to reinstatement, lost wages and benefits, and an increase in compensation of up to $10,000.14California Legislative Information. California Labor Code 132a
If You Were Fired After Calling In Sick
Start building the file before anything else. Gather every email, text, and written request about your leave, along with medical documentation, pay stubs showing accrued sick time, and any attendance warnings you received. You have the right to request your complete personnel file from your former employer under California Labor Code 1198.5, and the employer faces a $750 penalty for failing to produce it on time.15California Legislative Information. California Labor Code 1198.5
Where you file depends on what was violated:
- Retaliation for using paid sick leave goes to the California Labor Commissioner’s Office.
- CFRA, pregnancy, disability, and failure-to-accommodate claims go to the California Civil Rights Department (CRD), which handles complaints under FEHA.16Civil Rights Department. Complaint Process
- Workers’ compensation retaliation goes to the Workers’ Compensation Appeals Board.
FEHA-related claims must be filed with the CRD within three years of the termination.16Civil Rights Department. Complaint Process Do not wait. Memories fade, witnesses leave, and documents disappear.
A successful claim can produce back pay for the wages and benefits you would have earned, front pay if returning to the job is not realistic, compensatory damages for job search costs and emotional harm, and in cases of especially bad employer conduct, punitive damages under FEHA.17U.S. Equal Employment Opportunity Commission. Chapter 11 – Remedies If the facts fit, the remedies are real. The sooner you move, the more of them stay on the table.
