Lane splitting in Missouri is effectively illegal. No statute names the maneuver, but Section 304.015 of the Missouri Revised Statutes requires every vehicle to stay within a single marked lane, and the Department of Revenue lists “Drive Mtrcycle Between Veh’s” as a citable traffic violation. A standard ticket is a non-criminal infraction, but the charge escalates to a misdemeanor if the move creates danger or causes a crash, and the two points on your record are only part of the cost.
The Law That Makes It Illegal
On any road divided into two or more clearly marked lanes, Section 304.015 requires a vehicle to be driven “as nearly as practicable entirely within a single lane,” and the driver cannot leave that lane until the move can be made safely.1Missouri Revisor of Statutes. RSMo Section 304.015 – Drive on Right of Highway, Traffic Lanes, Signs, Violations, Penalties Riding along the line between two lanes breaks that rule no matter how slowly the cars around you are moving.
The same section covers passing. Overtaking by threading between lanes, rather than moving fully into a clear adjacent lane, does not satisfy the pass-and-return rule, so a lane-splitting maneuver can draw both an improper-lane-use charge and an improper-pass charge from the same statute.
What a Lane Splitting Ticket Costs
The default violation under 304.015 is an infraction: a non-criminal ticket you pay, plus court costs that vary by jurisdiction. It becomes a criminal matter only in two situations.2Missouri Revisor of Statutes. RSMo Section 304.015 – Drive on Right of Highway, Traffic Lanes, Signs, Violations, Penalties
- If the violation creates an immediate threat of an accident, it is a Class C misdemeanor, carrying up to 15 days in jail and a fine of up to $300.3Missouri Revisor of Statutes. - If an accident actually results, it is a Class A misdemeanor, punishable by up to one year in jail.3Missouri Revisor of Statutes. RSMo Section 558.011 – Sentence of Imprisonment, Terms
A Class A misdemeanor is a criminal conviction that will show up on background checks. An infraction will not.
Either way, the Department of Revenue adds two points to your driving record. The official point schedule lists “Drive Mtrcycle Between Veh’s” as a two-point violation.5Missouri Department of Revenue. Reach 8 points in 18 months and your license is suspended for 30 days on a first offense, 60 on a second, 90 on a third. Hit 12 points in 12 months, 18 in 24 months, or 24 in 36 months, and your license is revoked for a year.6Missouri Department of Revenue. Tickets and Points FAQs
How It Changes an Accident Claim
The ticket is often the smaller problem. Missouri uses pure comparative fault, which means your compensation in a personal injury case is reduced by whatever percentage of blame gets pinned on you. You can still recover something even if you were mostly at fault, but “something” can be a lot less than you expect.
If you were lane splitting when a driver changed lanes into you, an adjuster or jury will almost certainly assign you a share of fault for riding between lanes in violation of 304.015. The other driver may never have checked a mirror, and you can still walk away with a reduced award because your maneuver was illegal. A claim that would have paid in full after a routine sideswipe can come back cut by 30%, 40%, or more. The violation does not bar the claim; it just hands the defense a ready-made argument.
Lane Filtering and Two-Abreast Riding
Lane filtering, where a rider moves between lanes of stopped cars at a light or in a jam, falls under the same rule. Section 304.015 requires staying within a single lane and makes no exception for stationary traffic. Moving cars or dead-still cars, the rule is the same.
Two-abreast riding is the lane-sharing move Missouri does permit. Two motorcycles may ride side by side within one lane, and no more. The logic tracks the statute: two bikes sharing a lane stay inside its boundaries, while a bike riding the line between two occupied lanes does not.
If You Ride Into Another State
A short list of states allow some version of the maneuver, each with its own conditions. California allows lane splitting with the general guidance that riders stay within 10 mph of surrounding traffic. Arizona permits filtering on roads posted at 45 mph or lower when traffic is stopped and the motorcycle is going no faster than 15 mph. Utah allows a similar low-speed filtering approach. Montana permits passing stopped or slow traffic at no more than 20 mph under its 2021 rule.
None of Missouri’s immediate neighbors permit lane splitting or filtering, so for most trips the Missouri rule is the one that matters. What is legal in Phoenix will get you a ticket in Kansas City.
