You can legally own an SBR in Illinois, but only under narrow conditions: you need a Curios and Relics license from the ATF (or membership in a nationally recognized military re-enacting group), a valid Illinois FOID card, and federal registration of the rifle under the National Firearms Act with a $200 tax stamp. Miss any one of those pieces and possession is a felony under both state and federal law.
What Counts as a Short-Barreled Rifle
Illinois uses the same measurements as the federal government. A rifle is “short-barreled” if the barrel is less than 16 inches, or if the overall length (stock fully extended to muzzle) is less than 26 inches.1Illinois General Assembly. Barrel length is measured from the closed bolt face to the muzzle. A permanently attached muzzle device can count toward that length; a device you can remove by hand generally does not. If your rifle falls below either threshold, it’s an SBR regardless of how the manufacturer marketed it.
The Illinois Exemption
Illinois treats possession of a short-barreled rifle as a criminal offense but carves out two exemptions under 720 ILCS 5/24-1(c)(7).1Illinois General Assembly. Illinois Compiled Statutes 720 ILCS 5/24-1 – Unlawful Possession of Weapons
The first, and the one nearly every civilian SBR owner in Illinois uses, is a valid Curios and Relics license (a Type 03 FFL) from the ATF. Nothing in the statute requires the SBR itself to be a curio or a relic — you just need to hold the license. The ATF issues the C&R to hobbyist collectors, the application is free, processing typically takes 30 to 60 days, and the license runs for three years.
The second exemption covers active members of a nationally recognized military re-enacting group, but only when the short barrel is necessary to portray a historical weapon accurately, the member carries a valid group credential, and the overall length is at least 26 inches.
One point that trips people up: the C&R license satisfies the Illinois exemption, but it does not substitute for federal NFA registration. Every SBR still needs its own tax stamp.
FOID Card
Every firearm owner in Illinois must carry a valid Firearm Owner’s Identification card, and an SBR is no exception. Without a FOID, you cannot legally possess any gun or ammunition in the state.3Illinois State Police. If your FOID expires or gets revoked, you lose the legal right to possess the SBR (and every other firearm you own) the moment it lapses. Keep it current.
Federal NFA Registration
Every SBR must be entered in the National Firearms Registration and Transfer Record, and the ATF collects a one-time $200 tax for each registration.5Bureau of Alcohol, Tobacco, Firearms and Explosives. National Firearms Act Which form you file depends on whether you’re building or buying.
Form 1 is what you file when you plan to make an SBR yourself — converting an existing rifle with a shorter barrel, or assembling one from parts. Approval must come back before you make any modifications. Form 4 is what a dealer files on your behalf when you’re buying a pre-built SBR. The transfer cannot happen until approval comes through.7Bureau of Alcohol, Tobacco, Firearms and Explosives. Firearms Forms
On both forms, every detail — manufacturer, model, caliber, serial number, barrel length, overall length — must match the markings on the receiver exactly. Inconsistencies cause delays and denials.
Filing, Fingerprints, and Photos
The ATF accepts paper and electronic submissions, but the eForms portal is faster, catches data-entry errors, and lets you pay the $200 tax by credit card at the time of filing.6Bureau of Alcohol, Tobacco, Firearms and Explosives. eForms Applications
Each applicant submits two fingerprint cards in the FBI FD-258 format, done at a local police department or a private fingerprinting service. Electronic filers can upload an EFT-format print file through the portal or mail paper FD-258s within 10 days of the eForms submission.8Bureau of Alcohol, Tobacco, Firearms and Explosives. CLEO Notification
Current federal rules require you to send a copy of your completed Form 1 or Form 4 to the chief law enforcement officer for your area — usually the local police chief or county sheriff. It’s notification, not permission; the CLEO does not approve or deny anything. The ATF published a proposed rule in 2026 to eliminate this step, so it may go away.9Bureau of Alcohol, Tobacco, Firearms and Explosives. Reduce Burden
Processing Times
Waits have dropped sharply from what they once were. Current averages published by the ATF run about 36 days for a Form 1 filed through eForms, 20 days for a paper Form 1, 10 days for a Form 4 filed by an individual through eForms, and 26 days for a Form 4 filed through a trust.10Bureau of Alcohol, Tobacco, Firearms and Explosives. When your application is approved, the tax stamp is attached to the returned form. That stamped form is your proof of registration. Keep a copy at home, keep a digital backup, and be able to produce it if asked by law enforcement.
Engraving Requirements if You Build Under a Form 1
Form 1 builders have one additional step. Before you take possession of the finished SBR, federal regulations require permanent engraving on the receiver or frame showing:11eCFR. 27 CFR 479.102 – Identification of Firearms
- the maker’s name (yours, or the trust’s) as it appears on the approved Form 1
- the city and state where the firearm was made
- a serial number, engraved at least .003 inches deep and at least 1/16 inch tall
Most people use a professional engraving service, which typically runs $50 to $75. Do the engraving before you assemble the SBR configuration, and don’t assemble it until your Form 1 comes back approved.
Individual Registration vs. NFA Trust
You can register the SBR to yourself or to a legal entity such as an NFA trust. Both work in Illinois; they differ in who else can lawfully touch the rifle.
If you register as an individual, you are the only person who may possess that SBR. Handing it to a friend at the range while you step away puts them in possession of an unregistered NFA firearm as far as federal law is concerned. A trust names multiple trustees, each of whom can lawfully possess and use the trust’s firearms without the original registrant present. A trust also gives your heirs a cleaner path than a post-death transfer.

Taking an SBR Out of Illinois
Crossing state lines with a registered SBR requires advance permission from the ATF. Federal law prohibits unlicensed individuals from transporting short-barreled rifles interstate without prior authorization.13Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts The authorization comes from filing ATF Form 5320.20, which lists the destination, the travel dates, and the specific firearm.14Bureau of Alcohol, Tobacco, Firearms and Explosives. Approval currently averages about 2 days through eForms and 8 days on paper.10Bureau of Alcohol, Tobacco, Firearms and Explosives. Current Processing Times The approval is good only for the dates you request; a longer trip means a new form.
Moving within Illinois does not require Form 5320.20, but standard state transport rules apply: unloaded and enclosed in a case.
Who Cannot Own One
Federal law bars several categories of people from possessing any firearm, and that includes NFA items. Your application will be denied, and possession itself is a crime, if any of these apply:13Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts
- a felony conviction (any crime punishable by more than one year, regardless of the sentence served)
- fugitive status
- current unlawful use of or addiction to a controlled substance
- an adjudication of mental defect or commitment to a mental institution
- a misdemeanor conviction for domestic violence, or a qualifying restraining order
- a dishonorable discharge from the armed forces
- renounced U.S. citizenship
- most nonimmigrant visa status, or being unlawfully in the U.S.
Illinois adds its own filter through the FOID system. If the Illinois State Police denies or revokes your FOID, you cannot legally possess an SBR in the state even if federal law wouldn’t independently bar you.
Penalties and the Lapse Trap
The consequences come from two directions and they stack. Under Illinois law, possessing a short-barreled rifle without the required exemption is a Class 3 felony carrying 2 to 5 years in prison, with extended-term sentencing reaching 5 to 10.1Illinois General Assembly. The most common way owners stumble is a lapsed C&R license or a lapsed FOID card. The federal registration on your SBR stays valid, but the Illinois exemption vanishes the moment either document expires, and continued possession becomes a felony. Renew before the dates on the cards, not after.
