FanDuel works in Georgia, but only in part. If you are physically inside the state, you can enter daily fantasy sports contests, play FanDuel Faceoff games, and use FanDuel Predicts. The sportsbook, online casino, and horse racing wagering are all blocked.1FanDuel Support. FanDuel in Georgia The split comes down to Georgia law: the state constitution bans casino gambling and pari-mutuel betting, and the criminal code treats most wagering on sporting events as a crime,2Georgia Secretary of State. Constitution of the State of Georgia – Article I, Section II, Paragraph VIII while daily fantasy sports slip through a skill-contest exception that no Georgia statute has ever closed.
What You Can and Cannot Do
FanDuel’s own support page confirms three products are accessible from Georgia: Fantasy (traditional daily fantasy sports), FanDuel Faceoff (with some card-style games like Solitaire Sprint excluded), and FanDuel Predicts.1FanDuel Support. FanDuel in Georgia Everything else shuts off the moment geolocation places your device inside the state. That includes the sportsbook, the casino product, and FanDuel Racing, which stays dark even for the Kentucky Derby and the Breeders’ Cup.
Why Daily Fantasy Sports Are Allowed
Georgia’s gambling statute defines a “bet” as an agreement where someone stands to win or lose based on an outcome that depends on chance, even if some skill is involved. The same statute carves out prizes offered to contestants in “a bona fide contest for the determination of skill, speed, strength, or endurance.”3Justia. Georgia Code 16-12-20 – Definitions DFS platforms rely on that exception. Drafting a lineup under a salary cap, the argument goes, is a statistical exercise rather than a wager.
Worth being clear about: Georgia has never passed a law that explicitly legalizes or regulates daily fantasy sports, and it has never passed one that bans them either. FanDuel’s DFS product operates in that silence, without a state licensing framework or regulator looking over it. You are not playing in a state that has blessed DFS. You are playing in a state that has not addressed it, and a future legislature could move the line in either direction.
Why the Sportsbook and Horse Racing Are Blocked
The Georgia Constitution draws a hard line. Article I, Section II, Paragraph VIII states that “all lotteries, and the sale of lottery tickets, and all forms of pari-mutuel betting and casino gambling are hereby prohibited,” with narrow exceptions only for the state-run lottery and nonprofit bingo.2Georgia Secretary of State. Constitution of the State of Georgia – Article I, Section II, Paragraph VIII Because the prohibition sits in the constitution rather than in an ordinary statute, the legislature cannot authorize sports betting by simple bill. It takes a constitutional amendment, which requires a two-thirds supermajority in both chambers followed by a statewide vote.
Georgia’s criminal code reinforces the ban. Placing a bet on the result of a game or contest is simple gambling, a misdemeanor.4Justia. Georgia Code 16-12-21 – Gambling Running a bookmaking operation, which the code calls commercial gambling, is a felony carrying one to five years in prison and fines up to $20,000.5Justia. Georgia Code 16-12-22 – Commercial Gambling That is why FanDuel’s sportsbook is physically blocked for anyone inside Georgia, regardless of device or browser.
The horse racing side is blocked by the same constitutional language. Pari-mutuel wagering, the pooled-bet system used at racetracks, is explicitly named in the ban. Georgia has no horse racing commission, no licensed tracks, and no advance deposit wagering framework, so FanDuel Racing has nothing to plug into even for out-of-state races.
Will Sports Betting Become Legal Here?
Lawmakers have tried, and the constitutional amendment requirement has killed every attempt. In the 2026 session, Rep. Matt Hatchett introduced HB 910, which was assigned to the Higher Education Committee. A House study committee on gaming in the prior session issued a nine-page report with no recommendations. A Senate study committee on tourism suggested legal sports betting could help attract major events. None has come close to the two-thirds vote needed to put a measure on the ballot. Until one does, the sportsbook will not unlock.
Who Can Play and How to Sign Up
You must be at least 18 to deposit money or enter a daily fantasy contest on FanDuel in Georgia.6FanDuel. Trust and Safety Registration asks for your full legal name, a verified residential address, date of birth, and the last four digits of your Social Security number. The platform uses this to confirm your identity, so a false date of birth will not clear the verification step.
Deposits can run through online banking, debit cards, PayPal, Venmo, Apple Pay, credit cards, or prepaid cards. Credit cards, prepaid cards, and Apple Pay work for deposits only; you cannot withdraw to them. Most withdrawal methods require that you first deposited the same way. Three paths work without a prior deposit on that method: online banking, a mailed check to your verified address, and cash pickup at a FanDuel retail location with valid ID.7FanDuel Support. Withdrawing with FanDuel Bonus funds and promotional credits cannot be withdrawn at all.
Do Not Try to Use a VPN
FanDuel checks your location through cell towers and Wi-Fi signals each time you open the app or try to enter a contest. If the system cannot place you, it locks you out until it can. Trying to defeat the check with a VPN or a GPS spoofer is a fast way to lose the account for good. The terms of use allow FanDuel to terminate accounts of anyone who fails the physical location requirement, forfeit any prizes, and either redistribute the money to other contestants or keep it under fraud prevention.8Fanduel. Terms of Use A suspended account can only be addressed through live chat with support, and FanDuel may impose a minimum deactivation period at its discretion.9FanDuel Support. Taxes on Your Winnings
Fantasy sports winnings are taxable even though the activity is legal in Georgia. The IRS treats them as income to be reported on Schedule 1 of Form 1040.10Internal Revenue Service. Gambling Income and Losses If your net profit for the year reaches $600, FanDuel will send you and the IRS a 1099. Smaller amounts are still taxable; you report them yourself.
Losses are deductible only if you itemize on Schedule A, and the deduction cannot exceed your reported winnings for the year. A $2,000 loss against $800 in winnings caps out at $800. The IRS also expects you to keep a log of entries, results, and amounts won or lost, along with any platform statements.10Internal Revenue Service. Gambling Income and Losses Georgia taxes personal income, so winnings land on your state return too. For a large win, an estimated tax payment is often smarter than waiting until April.
