Can You Rent a Car at 21 in Florida? Surcharge, Waivers, Tolls

Yes, you can rent a car at 21 in Florida from every major rental company, but you’ll pay a daily young driver surcharge that typically runs $25 to $35 on top of the base rate until you turn 25. Florida has no state law setting a minimum rental age; the 21-year floor is an industry policy the companies set themselves. A few membership programs can knock that surcharge out entirely, which is worth checking before you book.

Why the Minimum Age Is 21

Florida law only requires that a rental company verify you hold a valid, unexpired driver’s license before handing over the keys. The statute says nothing about how old you need to be.¹ The 21-year minimum comes from the rental companies, and virtually every national brand enforces it at Florida locations. You can legally get a Class E driver’s license in Florida at 16, but that license alone won’t get you past the rental counter for another five years.²

Florida has no consumer-protection law forcing agencies to rent to drivers under 21, so if you’re 18 to 20, a traditional rental at a Florida counter isn’t happening outside of narrow programs like the U.S. Government Rental Car Program for active-duty military and federal employees on official travel orders.³

What the Young Driver Surcharge Costs

Every national rental company charges a daily surcharge for drivers between 21 and 24. The fee is baked into the final price at checkout and applies to each day of the rental, not as a one-time charge. Current rates at the major brands:

Hertz: $25 per day⁴
Enterprise: about $25 per day on average, varying by location⁵
Budget: $27 per day at most locations⁶
Avis: $35 per day for renters aged 21 to 24⁷

On a seven-day rental, that adds $175 to $245 to your total before taxes. Often that’s more than the base rate on an economy car. The surcharge is also subject to Florida’s 6% sales tax and a separate $2-per-day state rental car surcharge that applies to every renter regardless of age.⁸ If you add a second driver who is also under 25, some companies charge a separate young driver fee for that person on top of the standard additional-driver fee.

How To Get the Surcharge Waived

A handful of memberships eliminate the young driver fee entirely. If you qualify for any of them, use them.

AAA Membership

AAA members aged 20 to 24 pay no young renter fee at Hertz when they include their AAA discount code in the reservation. The offer also waives the additional driver fee, includes a free child safety seat, and provides up to 20% off the base rate. At pickup, bring proof of AAA membership, a valid driver’s license held for over a year, and a credit card in the same name.⁹

USAA Membership

USAA insurance-eligible members get underage driver fees waived at six national brands: Hertz, Avis, and Budget waive the fee for ages 18 to 24, and Enterprise, Alamo, and National waive it for ages 21 to 24.¹⁰ You have to be eligible for USAA insurance, not just a general member, so this mostly helps active military, veterans, and their families.

Corporate and University Codes

Employers and universities often negotiate rental agreements that waive the underage fee as part of a corporate rate. Budget, for instance, waives its standard age restrictions for renters 21 and older who book under certain employer corporate rates.⁶ Check your employer benefits portal or alumni association before paying retail.

What To Bring to the Counter

Every rental counter in Florida asks for three things: identification, a payment method, and proof you can cover damage.

Your driver’s license must be valid, unexpired, and generally held for at least one year. Most agencies won’t rent to someone who received their license less than twelve months ago, no matter their age. It needs to be a government-issued physical card, not a photo on your phone. If you’re carrying a temporary paper license, call the specific location beforehand because policies differ.

A credit card in the renter’s name is the simplest payment. The agency will place a hold for the estimated rental total plus a deposit, commonly $300 to $400 depending on the location and vehicle class.¹¹ That hold ties up your available credit until the car is returned and the final charges post, which can take a few business days.

For insurance, you have two paths. You can buy the agency’s collision damage waiver at the counter, which typically runs $15 to $30 per day. Or you can decline and rely on your own auto insurance policy, your credit card’s rental car benefit, or a non-owner auto insurance policy if you don’t own a car. If you decline, bring your insurance declaration page showing your policy limits and coverage dates. A non-owner policy acts as primary coverage on a rental, paying from the first dollar of a claim, which can work out cheaper than the agency’s daily waiver on longer trips.

Renting With a Debit Card

You don’t need a credit card at most agencies, but a debit card adds friction. The rental company can’t just place a hold against a credit line; they’re tying up real money in your checking account, and they’ll ask for more assurance you’ll return the car.

At airport locations, most agencies require a ticketed return flight or cruise itinerary that lines up with your rental dates. Without proof of return travel, you may be denied the rental entirely or asked for a credit card instead.¹¹ Several companies also run a credit check on debit card users and require two forms of identification instead of one. At non-airport locations, some agencies ask for a current utility bill with your home address dated within the last 30 days, plus a secondary document like a phone bill or pay stub.

The deposit hold on a debit card tends to be larger too, running to $500 plus the estimated rental cost at some agencies, and it directly reduces the cash available in your account until the hold releases. Confirm the specific requirements with your rental location before you show up.

Vehicle Restrictions Under 25

Clearing the age and payment hurdles doesn’t get you the full fleet. Drivers under 25 are generally limited to economy, compact, and standard sedans. Luxury vehicles, high-performance sports cars, and large passenger vans are off the table at most agencies. Hertz, for instance, excludes its Dream Car, Prestige, and Adrenaline collections for anyone under 25, even AAA members who otherwise get expanded access to car classes from economy through SUVs.⁹ Full access to premium tiers typically opens up at 25.

Florida Toll Roads Are the Hidden Cost

This trips up almost every first-time Florida renter. Most of the state’s major expressways are cashless, with no toll booths to feed coins into. Drive through a toll gantry in a rental without your own transponder or a pre-purchased toll plan, and the rental company’s electronic toll system charges you an administrative fee on top of the toll itself.

Admin fees vary by company and add up fast:

Hertz, Dollar, Thrifty (PlatePass): $9.99 per day when tolls are incurred, plus tolls at the highest undiscounted rate
Avis, Budget (eToll): $6.95 per day when tolls are incurred, capped at $34.75 per rental month
National, Alamo, Enterprise (TollPass): $4.95 per day when tolls are incurred, capped at $30 per rental period
Fox Rent a Car: $15 per toll event, capped at $90 per rental agreement

Those daily fees are charged only on days you actually use a toll road, but a single wrong turn onto a toll expressway triggers the charge for that whole calendar day.¹²

If you already have a SunPass Uni transponder, you can move it to the rental car, but you must update your SunPass account with the rental vehicle’s license plate number before driving on any toll road. Out-of-state transponders like E-ZPass, I-PASS, and Peach Pass work on many Florida toll roads, but again, you need to update the vehicle information on your transponder account first. E-PASS stickers cannot be transferred between vehicles.¹³
