Can You Ship Alcohol to Florida? Carriers, Wine, and Limits

Shipping alcohol to Florida is legal only in one narrow situation: wine sent by a licensed out-of-state winery that holds a Florida direct-shipping permit. Beer and liquor cannot be shipped to a Florida consumer at all, and no individual, friend, or family member in another state can legally mail you alcohol of any kind. Every other bottle you want has to move through Florida’s licensed wholesaler and retailer system before it reaches your door.

What Florida Prohibits

Florida law bars common carriers, private vehicle operators, and out-of-state manufacturers or suppliers from delivering any alcoholic beverage to anyone in the state other than a licensed manufacturer, distributor, exporter, or bonded warehouse.1Florida Senate. Florida Code 561.54 – Certain Deliveries of Beverages Prohibited There is no personal-gift exception. There is no small-quantity loophole. A bottle of bourbon your cousin wants to mail you for your birthday is contraband the moment it enters the shipping stream.

When an unauthorized shipment is caught, a court can order the alcohol confiscated and destroyed, and any licensee harmed by the delivery can sue to recover what the carrier or shipper earned from it.1Florida Senate. Florida Code 561.54 – Certain Deliveries of Beverages Prohibited An individual who ships alcohol without a permit faces a second-degree misdemeanor, punishable by up to 60 days in jail, a fine of up to $500, or both.2The Florida Legislature. Florida Statutes 775.083 – Fines Enforcement sits with the Florida Division of Alcoholic Beverages and Tobacco, which issues every license needed to manufacture, import, distribute, or sell alcohol in the state and investigates shipments that skip the mandated channels.3MyFloridaLicense.com. USPS Will Not Carry It. Private Carriers Will, With Conditions.

Federal law classifies all spirituous, vinous, malted, fermented, or other intoxicating liquors as nonmailable. The United States Postal Service will not accept them, and depositing them in the mail is a federal offense.4Office of the Law Revision Counsel. 18 U.S. Code 1716 – Injurious Articles as Nonmailable No exceptions exist for gifts, small quantities, or personal use.

FedEx and UPS do handle alcohol, but only from commercially licensed shippers who have signed an approved agreement with the carrier and apply the required alcohol labeling to every package.5UPS. The Wine Exception: Licensed Out-of-State Wineries

Florida permits one direct-to-consumer pathway. An out-of-state winery that holds a valid Florida shipping permit can ship wine straight to a Florida resident’s home for personal consumption.7Florida Senate. Florida Code 561.545 – Certain Shipments of Beverages Prohibited; Penalties; Exceptions The wine has to be for private enjoyment. Reselling anything you receive this way is illegal and can bring felony charges.

The permitted winery also has to collect and remit Florida’s excise tax on each shipment.8The Florida Legislature. Florida Statutes 564.06 – Taxes on Wines and Beverages That obligation sits with the winery, not with you, but it is one of the things that distinguishes a compliant shipper from one that is simply hoping not to get caught.

Practical takeaway for you: if a winery’s checkout page asks for an adult’s ID verification, flags shipping to specific Florida counties, and uses FedEx or UPS Adult Signature Required service, those are signs it is working inside the permit system. A winery that will ship anywhere without those checks is a warning sign, not a convenience.

Out-of-State Wine Retailers Are a Gray Area

Florida’s statute was written for winery-to-consumer shipping, not retailer-to-consumer shipping. Federal courts have been examining whether blocking out-of-state retailers while allowing out-of-state wineries creates the kind of discrimination the U.S. Supreme Court rejected in Granholm v. Heald, which struck down state laws that favored in-state wineries over out-of-state ones under the Commerce Clause.9Justia U.S. Supreme Court Center. Granholm v. Heald, 544 U.S. 460 (2005) The status of retailer shipping into Florida remains unsettled. If an out-of-state retailer ships to you without problems, it may be operating under a court order rather than a traditional state permit. Verify any retailer’s authorization before ordering.

Beer and Liquor Have No Direct-Ship Path

The winery permit does not extend to breweries or distilleries. No permit exists that would let an out-of-state brewery or distillery ship directly to your home in Florida. Whiskey, craft beer, tequila, and every other non-wine alcoholic beverage has to move through a licensed Florida wholesaler and then be sold by a licensed Florida retailer before it reaches you.1Florida Senate. Florida Code 561.54 – Certain Deliveries of Beverages Prohibited

This is where most people get into trouble. A small-batch bourbon site takes your credit card without blinking, and it is easy to assume the seller has handled the legal side. Often they haven’t. If the package is intercepted, the alcohol is confiscated, you are out the money, and the shipper is exposed to civil penalties. Buying from a Florida-licensed retailer, in person or through its own delivery service, is the only reliable way to get spirits or beer legally.

What Happens When the Package Arrives

Every legal alcohol shipment coming into Florida requires a face-to-face handoff. The carrier has to verify that the person accepting the package is at least 21 by checking a valid government-issued photo ID, and the package itself has to be labeled as containing alcohol.10The Florida Legislature. Florida Statutes 561.57 – Common Carriers No doorstep drops. No leaving it with a neighbor who did not show ID.

FedEx and UPS enforce this through mandatory Adult Signature Required service. The recipient must be at least 21, present government-issued photo identification, and physically sign.6FedEx. How to Ship Alcohol: Regulations, Licenses and Services5UPS. UPS Tariff/Terms and Conditions of Service – United States If nobody of legal age is there to sign, the package goes back on the truck. After several failed attempts, it goes back to the sender.

Plan for someone 21 or older to be at the delivery address during the carrier’s delivery window. You can often redirect the package to a FedEx or UPS facility for pickup, but you still have to show ID in person.

Carrying Alcohol Into Florida Yourself

The shipping rules do not apply when you are physically transporting the alcohol. Driving back from a trip with a few bottles of wine does not violate the carrier-delivery prohibition. Florida does impose a reporting requirement if you bring in more than one gallon of alcohol for personal use, which includes paying applicable state excise tax to the Division of Alcoholic Beverages and Tobacco. Enforcement against casual travelers is rare in practice, but the obligation is on the books.

For international arrivals, U.S. Customs and Border Protection allows each traveler aged 21 or older to bring one liter of alcohol into the country duty-free. More than that is permitted for personal use, but anything over the one-liter allowance is subject to federal duty and excise tax collected at the port of entry, and large quantities will be treated as commercial.11U.S. Customs and Border Protection. Bringing Alcohol (Including Homemade Wine) Into the United States for Personal Use After clearing customs, you would still owe Florida excise tax on quantities above the state’s personal-use threshold.

Dry Counties and Tribal Land

A legal shipment under state law can still be blocked by local rules. The Florida Constitution lets every county decide whether alcohol sales are legal within its borders, and that status changes only by special election.12Florida Senate. The Florida Constitution – Article VIII, Section 5 A few Florida counties have gone dry or limited sales to sealed packages only.13The Florida Legislature. Florida Statutes 567.13 – Sale by the Package Only Lafayette County and Liberty County have historically been classified as dry. A wine shipment that is perfectly legal in Miami can violate local law the moment it crosses into one of these counties. Check with your county clerk if you are unsure about your area.

Tribal land adds a separate federal layer. Introducing any intoxicating liquor into Indian country without authorization is punishable by a fine and up to one year in prison for a first offense, and up to five years for later offenses.14Office of the Law Revision Counsel. 18 USC 1154 – Intoxicants Dispensed in Indian Country The Seminole Tribe and the Miccosukee Tribe both have reservation land in Florida, and tribal governments set their own alcohol policies. A reservation can be dry even when the surrounding county is wet. If your delivery address sits on or near tribal land, that federal prohibition applies in addition to Florida’s rules.
