Can You Smoke Cigarettes on the Beach in Florida?

Whether you can smoke cigarettes on the beach in Florida depends on which beach you’re standing on. There is no statewide ban, but a 2022 state law lets every county and city prohibit filtered tobacco products on the public beaches it owns, and dozens of local governments have done exactly that. At most popular Gulf and Atlantic tourist beaches, smoking a cigarette is either already illegal or likely to become so.

How the Local Ban System Works

Until 2022, Florida reserved all smoking regulation to the state, which meant no city or county could pass its own outdoor smoking rules. House Bill 105 changed that. The law amended the Florida Clean Indoor Air Act (renamed the Florida Clean Air Act), took effect on July 1, 2022, and authorized each county and municipality to restrict smoking on public beaches and public parks the local government owns.1The Florida Legislature. Florida Statutes 386.209 – Regulation of Smoking Preempted to State The state itself did not ban beach smoking; it handed the decision to local officials.

The statute also handles overlapping ownership. A city can restrict smoking on a county-owned beach inside the city’s boundaries, as long as that restriction does not conflict with an existing county ordinance.1The Florida Legislature. Florida Statutes 386.209 – Regulation of Smoking Preempted to State That is why rules can shift along a single stretch of sand.

The focus throughout is litter. Cigarette filters are one of the most common items pulled from coastal cleanups, and the plastic in them breaks down into microplastics. The bill’s sponsor framed the law as a response to that pollution problem, which is why the ban targets filtered products specifically.2Florida Senate. Where Major Beach Destinations Have Banned It

Miami Beach was among the first, prohibiting smoking on its public beaches and parks effective January 1, 2023, for all lighted tobacco products except unfiltered cigars.3City of Miami Beach. Ordinance 2022-4509 – Smoking in Parks and on the Beaches Is Prohibited Clearwater passed its own ordinance covering city-owned parks and beaches in 2023.4City of Clearwater. Ordinance 9680-23 – Prohibition of Smoking and Vaping on City Owned Public Parks and Beaches Lee County (Fort Myers Beach) enacted a ban in mid-2025, and St. Johns County (St. Augustine Beach) followed in late 2025.

The direction of travel is toward more bans, not fewer. Smaller or less tourist-heavy communities have not all acted, and until a local government passes an ordinance, smoking stays legal there by default. If you’re heading to a well-known destination in 2026, assume the beach is restricted unless you have confirmed otherwise.

Unfiltered Cigars Are Still Allowed

Even on a beach where cigarettes are banned, you can still smoke an unfiltered cigar. The state statute explicitly prohibits local governments from restricting unfiltered cigars on public beaches and parks, and no local ordinance can override that carve-out.1The Florida Legislature. Florida Statutes 386.209 – Regulation of Smoking Preempted to State The exemption tracks the litter rationale: no plastic filter, no debris problem. Cigars with plastic tips or filters are not exempt and can be restricted the same as cigarettes.

Vaping Is a Separate Question

Vaping and e-cigarettes sit under a different legal framework. The state does not preempt local regulation of vapor-generating electronic devices the way it once preempted cigarettes, and Florida’s constitution already gave local governments authority to pass vaping rules more restrictive than state law.1The Florida Legislature. Florida Statutes 386.209 – Regulation of Smoking Preempted to State

Many local bans cover both. Clearwater’s 2023 ordinance, for example, prohibits smoking and vaping on city-owned parks and beaches.4City of Clearwater. Ordinance 9680-23 – Prohibition of Smoking and Vaping on City Owned Public Parks and Beaches Others cover cigarettes but say nothing about vaping. Don’t assume the two are treated the same at any given beach.

State Parks and Federal Beaches Follow Different Rules

Section 386.209’s local-control model applies to beaches owned by counties and municipalities. Florida’s state parks, run by the Department of Environmental Protection, go the other way: SB 1576, passed in 2024, prohibits smoking and vaping within state park boundaries effective July 1, 2024.5The Florida House of Representatives. SB 1576 (2024) – Prohibition of Smoking and Vaping in State Parks A beach inside a state park is off-limits for smoking no matter what the surrounding county allows.

Federally managed shorelines are different again. Places like Gulf Islands National Seashore and Canaveral National Seashore operate under National Park Service rules in Title 36 of the Code of Federal Regulations, not Florida law. Gulf Islands does not post a blanket smoking prohibition for general outdoor areas, but individual parks can add restrictions through a superintendent’s compendium.6National Park Service. What a Ticket Costs

Violating a local beach smoking ban is a civil infraction, not a criminal offense, so there is no criminal record attached. Each local government sets its own fines, and amounts vary. Miami Beach’s schedule is a reasonable illustration:3City of Miami Beach. Ordinance 2022-4509 – Smoking in Parks and on the Beaches Is Prohibited

  • First offense: $100
  • Second offense within 12 months: $200
  • Third or subsequent offense within 12 months: $500

Local police or code enforcement handle these cases. First-time violations often result in a warning rather than a citation, but repeat offenders can expect the full fine.

Checking the Rules Before You Go

Because the answer changes beach by beach, a quick check saves money. Look up the city or county’s ordinance on its official website, read the signs at the beach entrance, or call the local parks and recreation department. Tourist beaches tend to post the rules clearly at public access points. For a state park beach, the statewide smoking and vaping ban applies. For a federal shoreline, pull the park’s superintendent’s compendium from the National Park Service site for that park. At any high-traffic Florida beach in 2026, the safe default is to assume cigarettes are prohibited until a sign or ordinance tells you otherwise.
