Yes, you can smoke weed in LA if you are 21 or older, but only inside a private residence where the owner or tenant allows it. California legalized recreational cannabis in 2016, and adults can possess and consume it, yet the list of places where lighting up is actually legal is much shorter than most people expect. Almost every public setting is off-limits, and violations start at a $100 fine.
Where Smoking Cannabis Is Actually Legal
Private property is essentially the only legal venue. You can smoke inside your own home, at a friend’s house, or on any private property where the owner gives permission.1Department of Cannabis Control. What about a licensed consumption lounge? California state law authorizes them, but Los Angeles does not permit them. No licensed consumption lounge operates inside city limits, and outdoor commercial cannabis events are also banned under local law.2Department of Cannabis Regulation. Where You Can’t Smoke
Any public place is prohibited. Sidewalks, parks, beaches, restaurant patios, bars, and the common areas of apartment buildings are all public spaces for this purpose, and smoking or consuming cannabis in them is illegal.3California Health and Safety Code. California also prohibits cannabis smoking anywhere tobacco smoking is already banned. That covers workplaces, enclosed public buildings, and the buffer zones many jurisdictions impose around building entrances.3California Health and Safety Code. There is a school buffer. Smoking cannabis within 1,000 feet of a school, daycare, or youth center while children are present is prohibited. A narrow exception lets you smoke inside a private residence within that 1,000-foot radius, but only if the smoke is not detectable by anyone on the school or daycare grounds.3California Health and Safety Code. What the Fines Look Like
Violations are infractions, not misdemeanors or felonies. You won’t go to jail for smoking a joint on a sidewalk, but you will pay:
- $100 for smoking or consuming in a public place
- $250 for smoking where tobacco is already banned

Smoking near a school while children are present is treated more seriously than the flat infraction amounts suggest.
Smoking in a Car
Don’t. Smoking or consuming cannabis while driving or riding in a vehicle is a separate offense, and California treats cannabis-impaired driving the way it treats drunk driving. Officers can arrest you for DUI on observed impairment alone, since there is no established legal THC blood-level threshold in California; impairment is judged through officer observation, field sobriety tests, and drug recognition expert evaluations. A cannabis DUI conviction carries the same kinds of consequences as an alcohol DUI: license suspension, fines, and possible jail time.
Even transporting cannabis in the car has rules. It has to travel in a sealed container or in the trunk. An open container means any package with a broken seal, loose cannabis, or anything not fully sealed, and the rule applies to drivers and passengers alike.5California Legislative Information. Places California Law Doesn’t Reach
Some spots inside and around Los Angeles are governed by federal law, where cannabis remains a Schedule I controlled substance no matter what California says.
Federal Property
National parks, national forests, VA hospitals, military bases, federal courthouses, and any other federally managed land within LA County fall under federal jurisdiction. Possessing or using cannabis in any of them can result in federal criminal charges.6National Park Service. Airports
TSA checkpoints are federal. TSA officers are not actively searching for cannabis, but if they find it during screening they are required to notify law enforcement. Taking cannabis through a security checkpoint could technically produce federal charges, though most California airports refer the matter to local law enforcement, who typically apply state law. The safe move is to leave it at home.
Federally Subsidized Housing
Residents of public housing and Section 8 units cannot use cannabis on the premises, even where state law allows it. Federal housing authorities have confirmed they are statutorily required to enforce this, and a landlord managing federally assisted housing can evict a tenant for cannabis use. Proposed legislation to change this has not passed as of 2026.
Age and Medical Use
You must be 21 or older to buy, possess, or use recreational cannabis in Los Angeles, mirroring the alcohol rule.
