Can You Smoke Weed in Public in Maine? Vehicles and Fines

Smoking weed in public in Maine is illegal and carries a civil fine of up to $100 per violation.1Maine State Legislature. Maine Revised Statutes Title 28-B 1501 – Personal Adult Use of Cannabis and Cannabis Products Adults 21 and older can possess up to 2.5 ounces of cannabis (including up to 10 grams of concentrate), but the law restricts actual consumption to private property where the owner has given permission. The ban covers every form of use, not just smoking, so an edible on a park bench is treated the same as a joint on the sidewalk.

What Counts as Public Consumption

Maine’s Office of Cannabis Policy states that “cannabis use in any form, including smoking, eating, or vaping, is prohibited in public places.”2Office of Cannabis Policy. Frequently Asked Questions (FAQs) – Section: Consumers If a space is accessible to the general public, consumption in any form is off-limits. That reaches further than most people expect. Discreetly chewing a gummy on a beach, taking a vape hit in a parking lot, nibbling an infused chocolate at a concert — all are public consumption under the statute.

Beyond the obvious streets, parks, and sidewalks, the law spells out several specific prohibited settings:

That last category is the broadest. It sweeps in restaurant patios, outdoor eating areas, and many other spaces where tobacco smoking is already restricted. If you can’t light a cigarette there, you can’t light a joint there either.

Where You Can Legally Smoke or Consume

Legal consumption boils down to two places: your own home (including the yard, porch, or other outdoor areas attached to the residence), or someone else’s private property that isn’t generally accessible to the public, where that owner has explicitly given you permission.1Maine State Legislature. Maine Revised Statutes Title 28-B 1501 – Personal Adult Use of Cannabis and Cannabis Products “Explicit permission” is doing real work in that sentence. Being invited to a friend’s house doesn’t automatically mean you can light up on their deck; the owner has to actually okay it.

Maine does not currently have licensed cannabis consumption lounges, so there is no legal commercial venue where you can pay to consume. A bill (LD 1365) was introduced in 2025 to create “cannabis hospitality lounges” where adults could consume on-site, but it died in the legislature in early 2026. Until something similar passes, private property is the only legal option.

Renting, Hotels, and Short-Term Stays

If you rent, your home may not be a legal place to consume. Maine’s Office of Cannabis Policy confirms that “property owners can prohibit cannabis use and possession on their premises.”2Office of Cannabis Policy. Frequently Asked Questions (FAQs) – Section: Consumers A lease can bar smoking, edibles, vaping, and even keeping cannabis in the unit. Read your lease before assuming your apartment is a safe place to use.

Medical cannabis patients get a narrow protection. Under Maine’s medical marijuana law, a landlord cannot refuse to lease to someone or penalize them solely because they hold a patient card. A landlord can still prohibit smoking cannabis for medical purposes on the premises, provided the landlord bans all smoking and posts notice of the policy.3Maine State Legislature. Maine Revised Statutes Title 22 2430-C – Protections for Authorized Activity The protection is against discrimination based on patient status, not a right to smoke in a rental.

Hotels, Airbnbs, and other short-term rentals follow the same private-property logic. The proprietor sets the rules. Most hospitality businesses in Maine enforce smoke-free policies that include cannabis, and violating the policy can bring cleaning fees or removal from the property.

Smoking in a Vehicle Doesn’t Count as Private

People sometimes assume that a parked car on a public street is a private space. It is not. Consuming cannabis in a vehicle on a public road is a traffic infraction for the driver and any passenger. Maine also treats cannabis in vehicles like alcohol: an “open container” (any package with a broken seal or partially removed contents) cannot be anywhere in the passenger area, including the glove compartment.4Maine State Legislature. Maine Revised Statutes HP0412 – An Act To Promote Highway Safety by Restricting the Use of Marijuana and Possession of an Open Marijuana Container in a Motor Vehicle An opened product belongs in the trunk, or behind the last upright seat if the vehicle has no trunk.

A few narrow exceptions exist for passengers (not drivers): someone riding in the living quarters of a motor home or truck camper, a passenger who holds a valid medical marijuana card, and a fare-paying passenger in a vehicle designed for hired transportation other than a taxi.4Maine State Legislature. Federal Land Is a Separate Rule

Maine’s state rules stop at the boundary of federal property. Acadia National Park, national wildlife refuges, and federal buildings sit under federal law, where cannabis possession itself is still an offense. Acadia’s posted rules state that “use and possession of marijuana within Acadia National Park is prohibited by federal law.”5National Park Service. Park Rules and Regulations – Acadia National Park A legal dispensary purchase in Bar Harbor becomes contraband the moment it crosses onto park land. These are federal charges, not Maine’s $100 civil ticket.

What the Fine Actually Looks Like

Public consumption is a civil violation, not a criminal offense. The maximum fine is $100 per violation.1Maine State Legislature. Maine Revised Statutes Title 28-B 1501 – Personal Adult Use of Cannabis and Cannabis Products The statute does not escalate the fine for repeat offenses; each violation carries the same cap. Court fees may be added on top.

Because this is a civil infraction, it won’t bring jail time or a criminal conviction. Maine distinguishes between civil violations and criminal records, and standard criminal background checks typically do not surface civil infractions. The infraction still creates a court record, and Maine’s sealing process applies specifically to criminal convictions, not civil violations.6State of Maine Judicial Branch. Sealing Your Criminal Record For most people the practical impact is small, but the record exists.

One more line in the statute matters. The $100 fine applies “in addition to any criminal or civil penalties that may be imposed pursuant to other applicable laws or rules.”1Maine State Legislature. Maine Revised Statutes Title 28-B 1501 – Personal Adult Use of Cannabis and Cannabis Products Smoke in a car and you can pick up the vehicle infraction too. Smoke in Acadia and the state fine is the smallest piece of what you’re facing. The ticket by itself is minor; the stacking is where it adds up.
