You cannot turn right on a red light in New York City unless a sign at the intersection specifically permits it. That is the opposite of the rule in most of the country and most of New York State, where a right on red is allowed after a full stop unless a sign forbids it. Inside the five boroughs, the default is no turn at all, and the only intersections that allow one are a small number in Staten Island marked with a posted sign.
Why the Rule Flips at the City Line
New York’s Vehicle and Traffic Law lets drivers turn right on red after stopping, but it carves out an exception for cities with a population of one million or more. NYC is the only city in the state that qualifies, so the exception operates as a blanket ban across Manhattan, Brooklyn, Queens, the Bronx, and Staten Island.1New York State Senate. Left on red is banned too. Even the maneuver most states allow from one one-way street onto another is off limits in NYC without a sign authorizing it.2NY DMV. Chapter 4: Traffic Control Cross into Westchester, Nassau, or anywhere else outside city limits, and the standard rules come back: you may turn after a full stop unless a sign says otherwise.
The Staten Island Exception
The only NYC intersections where a right on red is legal are in Staten Island, and each one is marked. Look for a sign reading “Right Turn on Red Permitted After Stop” or similar language. What a Permitting Sign Actually Requires
A sign is not a green light. You still have to come to a complete stop at the stop line, or before the crosswalk if there is no stop line, or at the point nearest the intersecting road where you have a clear view of oncoming traffic.1New York State Senate. After stopping, you yield to pedestrians in the crosswalk and to any vehicles with the right-of-way, including cars moving through on their green. Only when the intersection is clear can you go. Rolling through is the behavior that draws tickets and causes crashes.
What a Ticket Will Cost You
The penalty depends on how the violation is caught. Camera enforcement and officer enforcement produce very different consequences.
Red Light Camera Tickets
A camera-issued violation carries a $50 fine.4NYC Department of Finance. Financially painful if they accumulate, but limited in reach.
Officer-Issued Tickets
Getting pulled over is more expensive. A first-offense traffic infraction can carry a fine of up to $150, plus a mandatory state surcharge.6New York State Senate. Driver License Points and Penalties The points do more long-term damage than the fine.
The Driver Responsibility Assessment
Hit 6 or more points inside any 18-month window and New York imposes a Driver Responsibility Assessment on top of your fines. The base DRA is $100 per year for three years, totaling $300. Each point beyond six adds another $25 per year for three years, or $75 per extra point.8NY DMV. Insurance
Points on your record give your insurer a reason to raise your premium. Completing a state-approved Point and Insurance Reduction Program (PIRP) course reduces up to 4 points for DMV calculation purposes and cuts your auto insurance base rate by 10% for three years.9NY DMV. How To Fight the Ticket
Traffic tickets in the five boroughs go through the DMV’s Traffic Violations Bureau rather than a traditional court. To plead not guilty, check the “not guilty” box on the ticket, sign it, and mail it to the Albany address printed on the form within 15 days of the violation date.10NY DMV. Traffic Violations Bureau
A DMV Administrative Law Judge handles the hearing, which you can schedule online or by mail. You are not required to appear in person; a written “Statement in Place of Personal Appearance” is allowed, and the judge notifies you of the decision by email.10NY DMV. Traffic Violations Bureau
Ignore the ticket and the TVB enters a default guilty finding. Full fine, full points, and potential license suspension, with no hearing.
If You Hit Someone Making an Illegal Turn
An illegal right on red that injures a person is no longer just a traffic matter. Under NYC Administrative Code Section 19-190, a driver who fails to exercise due care and injures a pedestrian or cyclist can be charged with a misdemeanor punishable by up to 30 days in jail. The injury does not need to be severe; under New York’s Penal Law, “physical injury” generally means substantial pain, which is a low bar.
On the civil side, the injured person can sue. New York applies pure comparative negligence, so an injured party can recover even if partly at fault, with the award reduced by their assigned percentage of blame.11New York State Senate. The traffic violation itself is powerful evidence of negligence.
What Trips Up Out-of-Town Drivers
Right on red feels automatic if you learned to drive anywhere else, which is why visitors get most of these tickets. A few practical points:
- The rule covers every red signal. Steady circular red, red arrow, flashing red at an inactive intersection: no sign, no turn.
- Navigation apps generally do not warn you about jurisdiction-specific turn restrictions. Know the rule before you drive in.
- NYC runs one of the largest red light camera programs in the country. Cameras do not distinguish between running a red and turning right on one; if you enter the intersection on red, expect a notice.
- Rental cars are not a workaround. Camera tickets go to the registered owner, which is the rental company, and they pass the fine to you, often with an administrative fee added.
