CAPI Benefits for Immigrants: Eligibility, Payments, and Deeming

California’s Cash Assistance Program for Immigrants, known as CAPI, pays monthly cash benefits to aged, blind, or disabled non-citizens who meet every federal rule for Supplemental Security Income but are turned down solely because of their immigration status. In 2026, an eligible individual living on their own can receive up to $1,233.94 per month, and an eligible couple up to $2,098.83.1Santa Clara County Social Services Agency. CAPI Reference Table for January 2026 The program is funded entirely by the state and administered through county social services offices.2California Department of Social Services. Who Qualifies

You must be a California resident, be at least 65 years old or meet the Social Security Administration’s medical standards for blindness or disability, and have been denied SSI specifically because of your immigration status.2California Department of Social Services. Cash Assistance Program for Immigrants (CAPI) Anyone 65 or older is “aged” for these purposes.3Social Security Administration. SSI Chapter 5 Definition of Aged Issue Under 65, you qualify only on medical grounds.

Your resources must stay below $2,000 for an individual or $3,000 for a couple in 2026.4Social Security Administration. 2026 Cost-of-Living Adjustment (COLA) Fact Sheet Resources include bank accounts, vehicles, and real estate, though your primary home and certain other assets don’t count. Your income must also fall below the CAPI payment standard for your living arrangement.

One rule catches many applicants off guard. You must prove the SSA denied your SSI application because of immigration status, not because your income or resources were too high, and the denial letter must have been issued within six months of your CAPI application under Section 49-030 of the state’s Manual of Policies and Procedures.5California Department of Social Services. Manual of Policies and Procedures Chapter 49-000 Cash Assistance Program for Immigrants If you haven’t applied for SSI yet, the county will refer you, and you generally have 30 days to file that SSI application or risk losing CAPI eligibility.

If disability or blindness is the basis of your claim, California’s Disability Determination Services Division has to confirm the condition before the county can approve CAPI on those grounds. A current disability or blindness finding already on file from Social Security Title II, SSI/SSP, or Medi-Cal can be accepted without a new evaluation.6Los Angeles County Department of Public Social Services. Which Immigration Statuses Count

Two broad groups of non-citizens are eligible. The first is anyone who meets the federal definition of a “qualified alien” under 8 U.S.C. Section 1641, which includes lawful permanent residents, refugees, asylees, and several related categories.7Office of the Law Revision Counsel. 8 USC 1641 – Definitions

The second is PRUCOL, meaning Permanently Residing Under Color of Law. This covers non-citizens living in the United States with the knowledge of immigration authorities where the government has no plans to pursue removal.5California Department of Social Services. Manual of Policies and Procedures Chapter 49-000 Cash Assistance Program for Immigrants PRUCOL is broader than many people assume. It takes in people with deferred action, a stay of deportation, a pending adjustment-of-status application, or an order of supervision, as well as non-citizens who have continuously lived in the United States since before January 1, 1972. A catch-all provision also covers anyone whose presence immigration authorities know about and have chosen not to act on.

What CAPI Pays in 2026

CAPI payment standards track the combined federal SSI and State Supplementary Payment amounts, but are set $10 lower per month for individuals and $20 lower for couples.8California Department of Social Services. Manual of Policies and Procedures Chapter 49-000 Cash Assistance Program for Immigrants – Section 49-050 They rise each year with the federal cost-of-living adjustment. The maximum monthly rates for January 2026 for someone living independently are:1Santa Clara County Social Services Agency. CAPI Reference Table for January 2026

  • Aged or disabled individual: $1,233.94
  • Blind individual: $1,318.32
  • Couple, both aged or disabled: $2,098.83
  • Couple, both blind: $2,324.35
  • Couple, one blind and one aged or disabled: $2,238.44

These are ceilings. Your actual check depends on your living arrangement and your countable income, which the county subtracts from the maximum rate.

How Your Living Arrangement Changes the Rate

Four categories apply.8California Department of Social Services. Manual of Policies and Procedures Chapter 49-000 Cash Assistance Program for Immigrants – Section 49-050 Independent living, where you own or rent your home or pay your fair share of food and shelter costs when living with others, carries the highest rate. Independent living without cooking facilities applies when you meet the independent living test but have no stove and refrigerator and no meals are provided. Reduced needs applies when you live in someone else’s household for a full calendar month and receive both food and shelter at no cost, and the rate is lower because your basic expenses are partly covered. Nonmedical out-of-home care covers licensed care facilities or living with a relative who provides room, board, and personal supervision.

How Income Reduces the Payment

The county counts both earned income from wages and unearned income from pensions or other benefits, but not every dollar counts equally. Some income is excluded outright, and standard deductions reduce the rest, including a disregard for part of earned income to encourage employment. The remaining “countable income” is subtracted from your maximum payment standard to produce your monthly benefit.

Sponsor Deeming Can Shrink or Block Your Benefit

If someone signed an affidavit of support to bring you to the United States, part of that sponsor’s income and resources may be counted as yours when the county decides eligibility. How long this “sponsor deeming” lasts depends on your situation:9Los Angeles County Department of Public Social Services. Sponsor Deeming

  • Basic CAPI: deeming runs indefinitely until the sponsor dies, you naturalize, or you accumulate 40 qualifying work quarters.
  • Extended CAPI: deeming runs ten years from the sponsor’s signature date or your arrival, whichever is later.
  • Older Form I-134 affidavits filed before December 19, 1997: deeming ends after three years of U.S. residence following your admission as a permanent resident.

Sponsor deeming can push an applicant above the income or resource limits even when the sponsor provides no actual support. In that situation, the indigence exception may help. Your total income from all sources must fall below the SSI rate, your resources must be below the CAPI limit, and you must not be living with your sponsor or receiving free room and board. You sign an Indigent Exception Statement, form SOC 809, and if the county approves it, sponsor deeming is suspended for 12 months and can be renewed.10California Department of Social Services. How to Apply

Contact your local county social services office to request the CAPI application, form SOC 814.2California Department of Social Services. Cash Assistance Program for Immigrants (CAPI) Many counties let you complete it by phone. The form asks you to list every person in your household and to account in detail for all bank accounts, vehicles, real estate, and monthly income from any source.

Gather these supporting documents:

  • Immigration documents such as your Permanent Resident Card (Form I-551) or Arrival/Departure Record (Form I-94).
  • Your SSI denial letter from the SSA, issued within the past six months, showing the denial was based on immigration status.
  • Proof of California residency, such as utility bills or a lease.
  • Income and asset records, including pay stubs, pension statements, and bank statements.
  • Sponsor information where an affidavit of support was filed; the county uses form SOC 860 to collect the sponsor’s income and resource details.11California Department of Social Services. Cash Assistance for Immigrants

Submit the packet in person, by mail, fax, or email, depending on what your county accepts. The county will schedule a required interview, which can usually happen by phone. You will then receive a written notice with the decision, your benefit amount, and the payment start date. Benefits go out at the beginning of each month, by check or direct deposit.

Keeping Your Benefits

Once you are receiving CAPI, report any change in income, resources, household composition, or address to your county within 10 days.2California Department of Social Services. Cash Assistance Program for Immigrants (CAPI) A new roommate, a small pension bump, or a move across town can all shift your benefit, and late reporting is the fastest route to an overpayment. The county also redetermines your eligibility every 12 months.

If the county decides it paid you more than you were owed, it sends a notice stating the amount, the months involved, and your repayment options. Full repayment is preferred, but if that isn’t realistic the county will reduce your ongoing CAPI payment by 10 percent of the applicable payment standard until the debt clears, or set up an installment plan.12California Department of Social Services. All-County Letter No. 00-73 – Overpayments/Underpayments in the Cash Assistance Program for Immigrants (CAPI) Recovery can’t start sooner than 30 days after the notice. If the overpayment wasn’t your fault and repaying would cause serious hardship, you can request a waiver.

Appealing a Denial, Reduction, or Closure

When your application is denied, your benefits are reduced, or your case is closed, the county must send a written notice explaining why. You have 90 days from the notice date to request a state hearing. If no proper notice was ever sent, that clock never starts and you can request a hearing at any time.

To keep your current payments running while the appeal is decided, file your hearing request before the reduction or termination date listed in the notice. This is “aid paid pending.” If you win, nothing changes; if you lose, you may need to repay what was issued during the appeal.

CAPI can continue while you appeal an SSI denial on disability or immigration grounds through the Social Security Administration, as long as you fully cooperate with that SSA appeal. Dropping the SSI appeal without good reason can cost you CAPI as well.

CAPI Does Not Include Medi-Cal

SSI recipients are automatically enrolled in Medi-Cal. CAPI recipients are not. Many people on CAPI meet Medi-Cal’s income rules, but the coverage won’t start unless you apply separately through your county social services office.
