CAPI Program: Eligibility, Payment Amounts, and How to Apply

The CAPI program in California, formally the Cash Assistance Program for Immigrants, pays monthly cash benefits to aged, blind, or disabled non-citizens who meet every requirement for federal Supplemental Security Income except immigration status. It is entirely state-funded, mirrors SSI/SSP payment levels, and runs through your county social services office. The maximum individual payment in 2026 is roughly $1,234 per month.1Social Security Administration. SSI Federal Payment Amounts2Legislative Analyst’s Office. Who Qualifies for CAPI

You have to meet three separate tests at the same time: a categorical test, an immigration test, and a financial test.3California Department of Social Services. Cash Assistance Program for Immigrants

Age, Blindness, or Disability

You must be at least 65 years old, legally blind, or have a medically determinable physical or mental impairment that prevents substantial gainful activity and is expected to last at least 12 continuous months or result in death. These are the same standards the Social Security Administration uses for SSI.3California Department of Social Services. Cash Assistance Program for Immigrants Applicants under 65 generally need records from treating physicians, and the county may require an independent medical examination.

Immigration Status

Your status must meet the SSI eligibility rules as they stood on August 21, 1996, with CAPI covering you if you are currently denied SSI/SSP solely because of federal immigration restrictions.4California Legislative Information. California Welfare and Institutions Code WIC 18938 In practice this covers people within the federal definition of a “qualified alien”: lawful permanent residents, refugees, asylees, people granted withholding of deportation, Cuban and Haitian entrants, certain parolees admitted for at least one year, and battered immigrants who meet specific conditions.5Office of the Law Revision Counsel. 8 USC 1641 – Definitions

The battered-immigrant category is worth flagging because many eligible people don’t know it exists. If you or your child have been subjected to battery or extreme cruelty by a spouse, parent, or household member, and you have a pending or approved immigration petition, you may qualify even without a green card in hand.5Office of the Law Revision Counsel. 8 USC 1641 – Definitions

Income and Resources

Countable resources cannot exceed $2,000 for an individual or $3,000 for a couple.6California Department of Social Services. Cash Assistance for Immigrants That count includes cash, bank accounts, stocks, and additional vehicles. Your primary home is excluded, so is one vehicle, and so are burial funds and certain life insurance policies with a face value of $1,500 or less.

Income is evaluated by taking your gross earnings, subtracting specific disregards, and arriving at countable income. Both earned and unearned income count, including in-kind support like free rent or meals from someone in your household. If your countable income falls below the maximum CAPI payment, you receive the difference. If it meets or exceeds the maximum, you’re ineligible.

Basic CAPI vs. Extended CAPI

When you entered the United States determines which track applies and whether a sponsor’s finances will be counted against you.

Basic CAPI

If you entered the U.S. before August 22, 1996, you fall under Basic CAPI, and sponsor restrictions are generally lighter. You can also qualify for Basic CAPI if you entered on or after that date and one of three things is true about your sponsor: the sponsor has died, the sponsor is disabled, or you are a victim of abuse by your sponsor or your sponsor’s spouse. Abuse claims require a sworn statement plus at least one piece of supporting evidence such as a police report, documentation from a domestic violence program, or medical records. If no additional evidence is available, the county can accept the sworn statement alone after making a credibility determination.4California Legislative Information. California Welfare and Institutions Code WIC 18938

Extended CAPI and Sponsor Deeming

If you entered on or after August 22, 1996, and your sponsor is alive, not disabled, and not an abuser, you fall under Extended CAPI. This track has been available since October 1, 1999, and it also covers applicants who have no sponsor at all.7California Department of Social Services. Eligibility and Assistance Standards Cash Assistance Program for Immigrants

Under Extended CAPI, a portion of your sponsor’s income and resources may be “deemed” to you for up to 10 years from the date the sponsor signed the Affidavit of Support or from your arrival in the U.S., whichever is later.7California Department of Social Services. Figure out whether it applies to you before you file.

How Much CAPI Pays in 2026

CAPI mirrors the combined federal SSI and California State Supplementary Payment, which adjust annually based on the Social Security cost-of-living increase. The 2026 COLA is 2.8 percent.8Social Security Administration. Cost-of-Living Adjustment (COLA) Information The federal SSI rate for 2026 is $994 per month for an individual and $1,491 for a couple.1Social Security Administration. SSI Federal Payment Amounts California adds a State Supplementary Payment on top of those figures, projected at roughly $240 for an individual and $608 for a couple in the 2026 fiscal year.2Legislative Analyst’s Office. Supplemental Security Income/State Supplementary Payment (SSI/SSP)

That puts the maximum CAPI payment for an individual living independently at approximately $1,234 per month, and approximately $2,099 for a couple. Your actual payment will be lower if you have countable income or receive in-kind support. Benefits arrive on the first of each month through an Electronic Benefit Transfer card or direct deposit.

How In-Kind Support Reduces Your Benefit

If someone else pays your rent, mortgage, or food costs, Social Security rules treat that help as income under the “presumed maximum value” rule. The reduction equals one-third of the federal SSI benefit rate plus $20. With the 2026 federal rate at $994, that’s a maximum reduction of about $351 per month for an individual receiving full room and board.1Social Security Administration. SSI Federal Payment Amounts The reduction is applied regardless of what the help is actually worth, so even modest support from a family member can trigger the full deduction. This is the rule that most often surprises recipients.

How to Apply

Applications go through your local county social services office. The core form is the SOC 814, “Statement of Facts — Cash Assistance Program for Immigrants,” which runs about 20 pages and asks for detailed information about your personal data, living arrangements, shelter costs, household members, and any assistance you receive.9California Department of Social Services. Statement of Facts Cash Assistance Program for Immigrants You can request the form by calling your county, picking it up in person, or in some counties downloading it online.3California Department of Social Services. Documents to Gather

  • Identity and immigration status: Permanent Resident Card, I-94 Arrival/Departure Record, asylum approval letter, or other documents showing your status.
  • Financial records: recent bank statements for all accounts, proof of any income (pay stubs, pension statements, support letters), and documentation of any other resources.
  • Housing costs: rental agreement or mortgage statement and utility bills. These feed directly into the benefit calculation.
  • Sponsor information: your sponsor’s financial details and contact information, plus any evidence that the sponsor is deceased, disabled, or abusive if you’re claiming a Basic CAPI exemption.
  • Medical evidence: records from treating physicians documenting your condition, if you’re applying based on disability or blindness.

Pay close attention to the shelter-cost sections of the SOC 814. Those figures determine whether in-kind support reductions apply and at what level, and an error can mean a lower monthly payment for the entire benefit period until the next redetermination catches it.

The Interview

After the county receives your paperwork, an eligibility worker is assigned to your case and schedules a mandatory interview, usually by phone or in person. The worker walks through your SOC 814, clarifies any income or resource questions, and may request additional documentation.3California Department of Social Services. Cash Assistance Program for Immigrants You then receive a Notice of Action by mail stating whether you’re approved or denied, with the start date and monthly amount if approved, or the specific reason for denial and instructions on how to appeal.

Keeping the Benefit: Reporting and Redetermination

Once you’re on CAPI, you have to report any change in your circumstances to the county within 10 days.3California Department of Social Services. Cash Assistance Program for Immigrants Reportable changes include:

  • Income changes: starting or losing a job, receiving a lump sum such as an inheritance or settlement, changes in pensions or support payments.
  • Resource changes: opening or closing bank accounts, buying or selling property, receiving a significant gift.
  • Living situation changes: moving, someone joining or leaving your household, changes in who pays your rent or food costs.
  • Immigration status changes: becoming eligible for SSI, obtaining citizenship, or any change in your documented status.

The county also conducts a full redetermination every 12 months, at which point you’ll provide updated bank statements and other documentation confirming you still meet all requirements.3California Department of Social Services. Cash Assistance Program for Immigrants Missing the 10-day window or the annual redetermination can trigger overpayments that the state will recover by reducing future benefits until the debt is repaid. Intentionally failing to report changes that would have reduced your payment can bring fraud penalties on top of repayment.

Appealing a Denial or Benefit Reduction

If your application is denied or your benefits are cut, the Notice of Action explains the reason and tells you how to challenge it. You have 90 days from the date on the notice to request a state hearing.10California Department of Social Services. State Hearing Requests After 90 days you can still request one, but you’ll need to show good cause for the delay.

A state hearing is an administrative proceeding before a hearing officer from the California Department of Social Services. You can represent yourself or bring someone to help, and you have the right to submit documents, call witnesses, and question the county’s evidence. If you request the hearing before the effective date of a benefit reduction, your benefits may continue at the existing level until the hearing is decided. That alone is a strong reason not to wait. Hearings are typically conducted by phone, with in-person hearings available, and decisions come in writing. If you disagree with the result, you can seek judicial review in state court.

Taxes and Other Benefits You Can Stack

CAPI payments are not taxable. Like SSI, they are need-based assistance rather than earned income, so you do not report them on your federal or state tax return, and the state does not issue a Form 1099 for them.

CAPI does not automatically enroll you in anything else, but if you qualify financially for CAPI you’ll generally qualify for CalFresh (California’s food assistance program) and Medi-Cal (California’s Medicaid program) as well. Applying for all three through your county office at the same visit saves effort and avoids leaving benefits unclaimed.

If Your Immigration Status Changes

CAPI is a bridge, not a destination. If your status changes and you become eligible for federal SSI, the move to SSI is mandatory. Under Welfare and Institutions Code Section 18938, the department periodically redetermines eligibility, and part of that check is whether you now qualify for SSI/SSP. When you gain SSI eligibility, CAPI requires a repayment agreement for any interim assistance the state provided that overlaps with retroactive SSI payments.4California Legislative Information. California Welfare and Institutions Code WIC 18938 Because CAPI mirrors SSI/SSP rates, the dollar amount of your payment generally doesn’t change, but the funding source shifts from state to federal and SSI’s own reporting rules take over.
