Car Tax in Delaware: Document Fee, Exemptions, and Trade-In Credit

Delaware does not levy a sales tax on cars. Instead, the state charges a motor vehicle document fee, and that fee is what most people mean when they ask about car tax in Delaware. As of October 1, 2025, the rate is 5.25% of the vehicle’s value, collected by the Division of Motor Vehicles when you title or register a car in the state.1State of Delaware News. How the Document Fee Is Calculated

The 5.25% is applied to the vehicle’s purchase price or its NADA book value, whichever is greater. The DMV uses the higher figure to prevent underreporting on private-party sales. Buy a car from a friend for $1,000 when it books at $8,000, and you’ll pay 5.25% of $8,000. When the purchase price on the title application differs from the price shown on the lien contract, the DMV again uses the higher figure.4Delaware Regulations. Trade-In Credit

A trade-in can reduce the amount subject to the document fee, but only if the vehicle being traded in is currently titled in Delaware. The DMV subtracts the trade-in allowance from the gross purchase price before applying the 5.25%. The credit cannot exceed the document fee you originally paid on that trade-in vehicle.4Delaware Regulations. Delaware Administrative Code Title 2 2266

Two exceptions let you claim the credit without a current Delaware title. The first covers a vehicle that was previously titled in Delaware, then registered out of state, and is now being traded in on a new Delaware purchase. The second applies when you bought and registered a vehicle in another state, paid that state’s sales or transfer tax, and are trading it in within 90 days of the out-of-state registration. Who and What Is Exempt

Delaware exempts several categories of owners from the document fee entirely:

  • Vehicles owned by the State of Delaware and its agencies, political subdivisions, the American Legion, Veterans of Foreign Wars, volunteer fire companies, the Delaware Civil Air Patrol, the American Red Cross, and the Salvation Army.
  • Vehicles meeting school bus requirements under a contract with a public school district.
  • Active-duty service members (active, reserve, or National Guard) and their dependents stationed in Delaware on temporary or permanent orders. Orders must be presented within 90 days of relocating or purchasing the vehicle.5Division of Motor Vehicles. Veterans Services

Certain transfers are also exempt regardless of who is involved:

  • Gifts of a Delaware-titled vehicle between immediate family members, including spouses, parents, children, siblings, grandparents, and step and in-law relationships.
  • Transfer of a jointly titled vehicle to one of the joint owners without money changing hands, provided the vehicle was jointly titled for at least 30 days.
  • Vehicles inherited from or bequeathed by a deceased person. Vehicles purchased from an estate do not qualify.
  • Title changes due to marriage, adoption, or court order.

One claim that circulates online is worth flagging: there is no senior citizen discount on the document fee under the current statute or DMV regulations. Veterans with service-connected disabilities who qualify for VA adaptive vehicle equipment benefits are exempt from the annual registration fee on one vehicle, but that exemption does not extend to the document fee.5Division of Motor Vehicles. If You’re Moving to Delaware

New residents have 60 days to title and register their vehicles with the Delaware DMV.6Division of Motor Vehicles. The out-of-state tax credit is the biggest thing to know here. If you paid a sales tax, transfer tax, or similar levy in your previous state within 90 days before registering in Delaware, the document fee is waived.2Delaware Code Online. Leased Vehicles

On a lease, the document fee is calculated on the full purchase price of the vehicle, not on your monthly payments. The leasing company typically rolls the 5.25% into the lease terms, and it’s assessed upfront when the vehicle is titled and registered.4Delaware Regulations. If your lease includes a purchase option and you buy the vehicle at the end of the term, you won’t owe the fee a second time, provided you’ve had continuous possession for at least one year and can produce a letter from the leasing company confirming that the document fee was paid when the lease started.4Delaware Regulations. Annual Registration and the EV Surcharge

Beyond the one-time document fee, Delaware charges an annual registration fee. A standard passenger car costs $40 per year. Renewing late adds a $20 penalty.3Division of Motor Vehicles. Starting October 1, 2025, Delaware added an annual surcharge on electric, plug-in hybrid, and other alternative fuel vehicles to offset the gas tax revenue they don’t generate. For passenger vehicles under 6,000 pounds:8Division of Motor Vehicles. Alternative Fuel Vehicle Registration Fee

  • Battery electric vehicles: $110 per year
  • Plug-in hybrids: $85 per year
  • Non-plug-in electric hybrids: $60 per year

Heavier alternative fuel vehicles pay more, on a scale that runs up to $900 per year for a fully electric vehicle over 26,000 pounds.9Delaware Department of Transportation. 2025 Fee and Toll Increases The surcharge stacks on top of the $40 base registration, so a typical EV owner pays $150 per year in registration costs.

Title Transfer Deadline and Late Penalty

When you buy a vehicle already titled in Delaware, you have 30 days to apply for a new title in your name. The transfer fee is $35, and missing the 30-day window adds another $35 penalty, doubling the cost.10Delaware Code Online. Beyond the late fee, driving an unregistered vehicle is a violation of state law. The Secretary of Transportation can suspend operating privileges for registration violations, and the DMV can impound nonresident vehicles operating in violation of registration requirements, with towing and impound costs charged to the owner.11Delaware Code Online. If You Think the Fee Was Calculated Wrong

If the DMV assessed a document fee you believe is incorrect, for example by using an inflated NADA value on a vehicle in poor condition, the appeal runs through Delaware’s tax dispute process. You have 60 days after receiving a notice of proposed assessment to file a written protest with the Director of Revenue, explaining why the amount is wrong.12Division of Revenue – State of Delaware. If the Director’s decision doesn’t resolve the issue, you can petition the Tax Appeal Board. A ruling against you at the Board can be appealed to Delaware Superior Court, filed within 30 days of the Board’s decision.12Division of Revenue – State of Delaware.
