Certificate of Rehabilitation in California: Eligibility and Filing

A Certificate of Rehabilitation in California is a Superior Court order declaring that someone convicted of a felony has been rehabilitated and is fit to exercise full civil and political rights. You file a free petition in the county where you live, meet a waiting period of seven, nine, or ten years, and prove your rehabilitation at a hearing. If the judge grants it, the certificate automatically becomes an application to the Governor for a pardon.

Who Qualifies

California law opens two paths. The broader one is for anyone convicted of a felony who served time in state prison or county jail. The narrower one covers people convicted of a felony sex offense who received probation, and people convicted of a misdemeanor sex offense listed in Penal Code section 290. To use the second path, your conviction must first be dismissed under Penal Code section 1203.4, you cannot have been jailed or imprisoned since the dismissal, and you cannot be on probation for any other felony.1California Legislative Information. California Code PEN 4852.01

Under either path, you must have lived in California continuously for at least five years immediately before filing.2California Courts. Certificate of Rehabilitation Moving within California is fine. Time spent outside the state does not count.

How Long You Have to Wait

The total wait is the five-year California residency requirement plus additional years tied to the severity of the conviction. The clock starts the moment you are discharged from custody, released on parole, placed on post-release community supervision or mandatory supervision, or released on probation, whichever happens first.3California Legislative Information. California Code PEN 4852.03

  • Seven years total (5 + 2) for most felony convictions that do not carry a life sentence and do not require sex offender registration.
  • Nine years total (5 + 4) for murder, kidnapping for ransom, train wrecking, assault by a life prisoner, and any other offense carrying a life sentence.
  • Ten years total (5 + 5) for any offense requiring sex offender registration under Penal Code sections 290 through 290.024.

If you were sentenced to consecutive terms, the court can extend the period beyond these minimums up to the combined maximum penalties for all crimes.3California Legislative Information. California Code PEN 4852.03 You cannot file until the full period has passed. A certificate issued early is void.

Who Cannot Apply at All

Some people are barred by statute regardless of how clean their record has been. The exclusions cover anyone serving a mandatory life parole term, anyone committed under a death sentence, and anyone currently in military service.1California Legislative Information. California Code PEN 4852.01 The military bar applies no matter what the underlying offense was.

Certain sex crimes involving minors permanently disqualify an applicant. These include continuous sexual abuse of a child (Penal Code section 288.5), lewd acts with a child under 14 (section 288), sexual assault of a child under 10 (section 288.7), aggravated sexual assault of a child (section 269), and specific forcible sex offenses listed in sections 286(c), 287(c), and 289(j).1California Legislative Information. The Felony Reduction Trap

If you reduce your felony to a misdemeanor, you lose eligibility. The certificate is only available for felony convictions, with the narrow misdemeanor sex-offense exception noted above.2California Courts. Certificate of Rehabilitation If you are weighing a reduction, think through that trade-off first.

Preparing the Petition

The form is titled “Petition for Certificate of Rehabilitation and Pardon” and is available from the Superior Court in your county or from the California Department of Corrections and Rehabilitation. List every felony conviction, with the date, the specific charge and code section, the county, and the sentence.4California Department of Corrections and Rehabilitation. Petition for Certificate of Rehabilitation and Pardon If you have misdemeanor sex-offense convictions requiring registration, list those as well.

The heart of the petition is proving that since your release you have lived honestly, obeyed the law, and shown good moral character. Back it up with real documentation. Utility bills, lease agreements, and tax returns establish continuous California residency. Beyond that, gather:

  • Pay stubs, employer letters, or tax filings showing steady work.
  • Transcripts, certificates, or enrollment records from schools or trade programs.
  • Character letters from people who can speak to your conduct since release.
  • Completion certificates from counseling, substance abuse treatment, or anger management.
  • Documentation of volunteer work or community service.

The petition includes a written declaration where you describe your rehabilitation in your own words. It is signed under penalty of perjury. Every statement needs to be truthful and verifiable; dishonesty alone can sink a petition that would otherwise have been granted.

Filing and the Hearing

File the petition with the Superior Court in the county where you currently live. There is no filing fee, and no court fees of any kind are charged for this process.5California Legislative Information. California Code PEN 4852.09 After filing, you must serve notice on the District Attorney in your county. In some counties the DA’s office handles hearing scheduling and notices; in others you arrange service yourself. Ask the clerk when you file.

The court can pull your full history: trial records, probation reports, prison conduct records, parole notes, and reports from any law enforcement agency about your behavior since release.6California Legislative Information. California Code PEN 4852.1 In many counties, the DA’s office or the probation department also runs its own investigation into your residency and conduct. Expect several months between filing and your hearing date.

At the hearing, the judge weighs whether your conduct since release shows rehabilitation and fitness to exercise full civil and political rights. You can present testimony and additional evidence. The DA may participate. If the judge is satisfied, the court issues the certificate and recommends a full pardon.7California Legislative Information. California Code PEN 4852.13 For sex-offense convictions, the court must also find you do not present a continuing threat to minors.

What the Certificate Actually Does

The certificate is a judicial finding that you have been rehabilitated and deserve the restoration of your civil and political rights. It carries weight with employers, licensing boards, and other decision-makers because a judge has looked at your history and said so in writing.

The main downstream benefit is the automatic pardon application. Once the certificate is issued, a certified copy goes directly to the Governor’s office. The Board of Parole Hearings must review it within one year and recommend whether the Governor should grant a full pardon.8California Legislative Information. California Code PEN 4852.16 The Governor can then grant the pardon without further investigation.

What the Certificate Does Not Do

The certificate does not erase or seal your conviction. Your record stays visible, and the conviction can still count as a prior if you are charged with a new crime. It is a judicial endorsement of your rehabilitation, not a clean slate.

It does not restore your right to own or possess firearms.2California Courts. Certificate of Rehabilitation Even a Governor’s pardon does not always restore firearm rights, and federal firearms prohibitions operate independently of state-level relief. Restoring gun rights is a separate legal matter.

Sex Offender Registration

Since July 1, 2021, a certificate of rehabilitation on its own no longer ends the duty to register as a sex offender. You must separately seek relief under Penal Code section 290.5 to terminate registration.3California Legislative Information. California Code PEN 4852.03 The certificate can support that separate petition, but it is not a substitute.2California Courts. Certificate of Rehabilitation

Immigration

A certificate provides no protection under federal immigration law. U.S. Citizenship and Immigration Services treats a conviction that was dismissed after a rehabilitative period as still being a conviction for immigration purposes.9U.S. Citizenship and Immigration Services (USCIS). Policy Manual – Adjudicative Factors If you are not a U.S. citizen, the certificate will not prevent deportation or improve your admissibility. Talk to an immigration attorney before relying on state-level record relief.

International Travel

Other countries apply their own rules. Canada, for example, treats pardons for offenses that occurred outside its borders differently from pardons under its own Criminal Records Act, and you may still be denied entry.10Immigration, Refugees and Citizenship Canada. Rehabilitation for Persons Who Are Inadmissible to Canada Because of Past Criminal Activity If travel matters to you, check the destination country’s admissibility rules on their own terms.

Alternatives If You Are Ineligible

If you fall into an excluded category or cannot meet the residency and waiting-period requirements, you still have options. A direct pardon application to the Governor is open to anyone, including people who live outside California or are otherwise ineligible for a certificate.2California Courts. Certificate of Rehabilitation You apply through the Governor’s office and the Board of Parole Hearings investigates.

If you received probation for a felony and your main goal is to clear the conviction from your record rather than seek a pardon, a dismissal under Penal Code section 1203.4 may be the more practical path.11California Legislative Information. California Code PEN 1203.4 That process lets you withdraw your guilty plea and have the case dismissed, though it does not eliminate the conviction for all purposes. The right choice depends on which disability you are trying to overcome.
