Chapter 7 Bankruptcy in Tennessee: Means Test, Exemptions, and Filing

Filing Chapter 7 bankruptcy in Tennessee can eliminate most credit card balances, medical bills, and other unsecured debts within about four months of filing.1United States Courts. Discharge in Bankruptcy – Bankruptcy Basics Three things decide how it goes for you: whether your income is low enough to qualify under the federal means test, which of your belongings Tennessee’s exemption laws let you keep, and whether your biggest debts fall into the categories that bankruptcy actually erases. A court-appointed trustee sells any non-exempt property, pays creditors from the proceeds, and the remaining qualifying debts are discharged.2United States Courts. Chapter 7 – Bankruptcy Basics

Do You Qualify Under the Means Test?

Eligibility turns on a two-part income analysis. First, your household’s current monthly income is compared to Tennessee’s median. For cases filed between November 2025 and March 2026, those medians are $62,339 for one earner, $80,722 for two, $95,011 for three, and $106,775 for four, with $11,100 added for each additional person.3United States Department of Justice. November 1, 2025 Median Income Table Fall below the figure for your household size and you pass automatically.

Exceed it and you move to the second step: subtracting allowed expenses from your gross monthly income to see what’s left. The expense allowances combine IRS national standards with Tennessee-localized figures for housing, transportation, and other living costs.4United States Department of Justice. Means Testing If the leftover amount is small enough, you still qualify. If not, the court will presume you can afford a Chapter 13 repayment plan and treat a Chapter 7 filing as abuse.

“Current monthly income” is a term of art. It means the average of your gross income from every source over the six full calendar months before you file, not just last month’s paycheck. Wages, self-employment earnings, rental income, and regular financial contributions from other household members all count. Understating income or leaving a source out can get the case dismissed for bad faith.

The Eight-Year Bar on Repeat Discharges

Even a clean pass on the means test will not help if you received a Chapter 7 discharge in a case filed within the previous eight years.5Office of the Law Revision Counsel. 11 USC 727 – Discharge The clock runs from the earlier filing date, not the discharge date. If your prior discharge was a Chapter 13, the wait is six years from that filing date, unless you paid at least 70 percent of allowed unsecured claims in that earlier plan.

What Property You Keep in Tennessee

Tennessee opted out of the federal exemption system, so filers here must use the state’s own exemption statutes. Anything not covered by an exemption becomes part of the bankruptcy estate and can be sold. Mapping your property against these numbers before filing is where most of the real planning happens.

Home Equity

An individual can protect up to $35,000 of equity in a primary residence. Joint owners who both live there can protect a combined $52,500, split equally. When only one of two joint owners is the one filing, that filer’s protection stays at $35,000.6Justia. Tennessee Code 26-2-301 – Basic Exemption If your equity exceeds the applicable cap, the trustee can sell the house, pay you the exempt amount, and give the rest to creditors.

The $10,000 Personal Property Wildcard

Tennessee gives you a $10,000 personal property exemption that functions as a wildcard. You pick which items to shelter, up to $10,000 in total equity value, and the choices can include furniture, electronics, cash, bank deposits, or part of a vehicle’s value.7Justia. Tennessee Code 26-2-103 – Personal Property Selectively Exempt From Seizure Because you choose, apply it where it protects the most value.

Items Protected Without a Dollar Cap

Necessary clothing for you and your family, family portraits and pictures, the family Bible, and school books are fully protected regardless of value.8Justia. Tennessee Code 26-2-104 – Additional Personal Property Exempt From Seizure Tools of the trade, professional books, and work implements are separately exempt up to $1,900.9Justia. Tennessee Code 26-2-111 – Additional Exemptions Retirement accounts that qualify for tax-exempt status under federal law, including 401(k) plans and IRAs, are also shielded from the estate.

Debts Chapter 7 Will Not Erase

Chapter 7 clears most unsecured debt, but federal law protects several categories from discharge. If your biggest obligations sit in these categories, filing may not solve the problem you came in with.

Support Obligations and Student Loans

Child support and alimony are immune from discharge. Enforcement for those debts can continue even while the case is open. Student loans survive too, unless you can show that repayment would impose an undue hardship on you and your dependents, a standard courts apply very narrowly.10Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge

Income Tax Debt

Some older income tax debt can be discharged, but only if three timing conditions all line up. The return must have been due at least three years before filing. You must have actually filed the return at least two years before filing. And the IRS must have assessed the tax at least 240 days before filing. Miss any one window and the tax survives. Returns the IRS filed on your behalf may not count toward the two-year requirement.

Recent Luxury Purchases and Cash Advances

Debts from luxury purchases over $900 to a single creditor within 90 days of filing are presumed non-dischargeable, as are cash advances totaling more than $1,250 within 70 days before filing.10Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge “Luxury” means anything beyond what’s reasonably necessary to support yourself and your family. Groceries and utilities don’t count; a new television or vacation charges do. The presumption can be rebutted, but timing a filing around recent spending matters.

Fraud and Willful Harm

Debts incurred through fraud, false pretenses, or false financial statements cannot be discharged. Neither can debts from willful and malicious injury to another person or their property, court-ordered restitution, or most government fines or penalties.10Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge

Before You File

Federal law requires you to complete a credit counseling briefing from an agency approved by the U.S. Trustee Program within the 180 days before your filing date.11Office of the Law Revision Counsel. 11 USC 109 – Who May Be a Debtor The U.S. Trustee publishes an approved list for Tennessee.12United States Department of Justice. Credit Counseling Agencies – Tennessee File your completion certificate with the petition.

Gathering documents takes longer than most people expect. You need federal tax returns for the two most recent years, pay stubs from the past six months, and a complete inventory of what you own and what you owe. The official forms require you to list every account, every creditor and amount, categorize debts as secured or unsecured, identify which property you’re claiming exempt under Tennessee law, and disclose any property transfers you made in the two years before filing. Leaving things out invites trouble; the trustee’s job is finding assets, and incomplete disclosures look like fraud.

At the 341 meeting of creditors, you’ll verify your identity under oath. Bring a government-issued photo ID and proof of your Social Security number, such as the card itself or a W-2. Without both, the trustee can continue the meeting to another date and delay your whole case.

What Happens After You File

The moment your petition reaches the clerk, an automatic stay takes effect. Creditors have to stop calling, suing, garnishing wages, or proceeding with foreclosure while the case is open. Certain debts, like ongoing child support collections, have exceptions.

The court appoints a trustee who reviews your paperwork, investigates your assets, and runs the 341 meeting. You answer questions under oath about your finances and documents. Creditors are invited but rarely appear in consumer cases, and if your paperwork is in order the meeting usually lasts 10 to 15 minutes. After it concludes, creditors have 60 days to file formal objections to the discharge of specific debts.13Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 4004 – Granting or Denying a Discharge If none are raised and nothing else surfaces, the court issues a discharge order roughly four months after your original filing date, permanently barring creditors from ever trying to collect the discharged debts.1United States Courts. The Second Required Course

After filing but before discharge, you must complete a personal financial management course. This is separate from the pre-filing credit counseling. File the completion certificate with the court within 60 days of your 341 meeting.14District of Delaware | United States Bankruptcy Court. What Is Credit Counseling and Personal Financial Management Skip it or miss the deadline and the court can close your case without discharge, which means the entire process produced nothing. Approved providers are listed on the U.S. Trustee’s website, and most offer online options that take a couple of hours.

Keeping a Car or Other Secured Property

If you want to keep a car loan or another secured debt, you may need to sign a reaffirmation agreement. That’s a new contract keeping you personally liable for the debt in exchange for keeping the collateral. Some lenders require reaffirmation; others let you keep paying informally.

Reaffirmation is voluntary, and the risk runs with you. Once approved, the debt sits outside your discharge. Fall behind later and the lender can repossess the collateral and come after you for any remaining balance, exactly as if you’d never filed. The agreement must be filed within 60 days of the 341 meeting, and if you don’t have an attorney, the court holds a hearing to confirm you understand the consequences before approving it.

Credit Afterward

A Chapter 7 filing stays on your credit reports for 10 years from the filing date.15Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports Individual accounts included in the bankruptcy, like specific credit cards or medical collections, drop off sooner because negative account history follows a seven-year reporting window. The bankruptcy entry itself persists for the full decade.

The practical impact fades well before the 10-year mark. Many filers qualify for a secured credit card within months of discharge and start rebuilding immediately. FHA-insured mortgages become available two years after discharge if you’ve reestablished on-time payments and can explain what led to the filing. Conventional mortgages typically require a four-year wait. The discharge itself often improves your debt-to-income ratio sharply, which is the number lenders care about most. People who file and then manage credit responsibly often find themselves in a stronger position within two to three years than they were in the months before filing.
